AN ORDINANCE OF THE COUNTY OF BUTTE
The Board of Supervisors of the County of Butte, State of California, ordains as follows:
Section 1. Amendments to Butte Coun Cade Cha ter 33.
Initiative Ordinance No. 3303-A, titled "An Ordinance to Protect the Groundwater Resources
in Butte County", codified as Chapter 33 of the Butte County Cade, is amended in part to read as
follows:
"Sec. 33-3. Groundwater planning process.
The association, unless otherwise designated by the water commission ,shall present the
reports described in this section to the Department by February 21 of each year. These reports shall
guide groundwater planning within county and shall be considered. in accordance with section 33-9.
(a} A groundwater status report based upon the data gathered and analyzed pursuant to
section 33-4.
{b) Using groundwater data for at least the prior twenty (20} years, a report that analyzes
the amount of groundwater pumping that can occur during the water year within each
county subbasin without exceeding the safe yield of each subbasin."
Section 2. Authority. This ordinance is enacted pursuant to the authority of Section 9.01 or
Ordinance 3303-A and Elections Code Section 9125.
Section 3. Severability. If any provision of this chapter or the application thereof to any person or
circumstances is for any reason held to be invalid by a court of competent jurisdiction, such
provision shall be deemed severable, and the invalidity thereof shall not affect the remaining
provisions or other applications of the chapter which can be given effect with the invalid provision
or application thereof.

Section 4. Effective Date and Publication. This ordinance shall take effect thirty (30) days after the
date of its passage. The clerk of the Board of Supervisors is authorized and directed to publish this
ordinance before the expiration of fifteen (15) days after its passage. This Ordinance shall be

published once, with the names of the members of the Board of Supervisors voting for and against it,
in the Chico Enterprise Record, a newspaper of general circulation published in the County of Butte,
State of California.
PASSED AND ADOPTED by the Board of Supervisors of the County of Butte, State of
California, on the 10th day of October 2000, by the following vote:
AYES: Supervisors feeler, Houx, ,Tosiassen, Davis and Chair Dolan
