NOTICE OF THE BOARD OF SUPERVISORS ADOPTION OF ORDINANCE N0.3666 SUMMARY OF ORDINANCE (AMENDING CHAPTER 43 OF THE BUTTE COUNTY CODE REGARDING FEES FOR SERVICES RENDERED BY THE PUBLIC HEALTH DEPARTMENT) The Board of Supervisors of the County of Butte gives notice pursuant to Government Code Section 25124(b)(1) of its adoption of an ordinance amending Chapter 43 of the Butte County Code regarding fees for services rendered by the Public Health Department. The ordinance was adopted at a public hearing of the Board on December 19, 2000 at 11:35 a.m. A copy of the full text of the ordinance is available for public viewing in the Off ce of the Clerk of the Board at 25 County Center Drive, Oroville, California. The following is a summary of the ordinance: Section 1. Amends Chapter 43 of the Butte County Code entitled "Public Health Department Fees", which chapter includes the following sections. Section 43-1 Fees Charged for Services. Identifes the fees the Public Health Department is authorized to charge, in addition to any other fees required by the County of Butte or the State of California, for the services it provides. Section 43-2 Payment of Fees Required. Requires the payment of fees at the time of the filing of an application or request for service. Section 43-3 Late Renewal Fees. Specifies late renewal fees for annually billed Servlces. Section 43-4 Refund Policy. Specifies a fee refund policy and procedure. Section 2. EfFective date of fees. The fees amended and adopted by this ordinance shall be effective commencing February 19, 2001. Section 3. Findings. Makes findings that the fees amended and adopted by this ordinance do not exceed the estimated reasonable cost of providing the service for which each such fee is to be charged. Section 4. Authority,- Recites that the ordinance is enacted pursuant to Health and Safety Code Sections 101325, 116340, 116565, 113920, 25286 and 25287, and 25513. Government Code Sections 54985, 66017 and 66018, Article I, Section 1 of the Butte County Charter, and Article XI, Section 7 of the California Constitution. Section 5. Severabilit~ States that if any part of this ordinance shall be held void by a court of competent jurisdiction, such part shall be deemed severable, and the invalidity thereof shall oat affect the remaining parts of this ordinance. Section 5. Effective Date of Ordinance and Publication thereof. States that the ordinance shall be in effect 30 days after the date of its adoption. Within. fifteen (15) days after its passage, a summary shall be published with the names of those supervisors voting for and against it, and a certified copy of the full text shall be pasted in the Office of the Clerk of the Board of Supervisors. Medical Services The charges for medical visits, screening procedures, laboratory examinations and medications are based upon estimates of the actual cost of delivering the services. Selected charges are based upon State established reimbursement rates. All charges are updated as necessary. P. Sliding Scale The Department utilizes a sliding scale to determine payment for selected medical services. This process insures that the cost of services is not a prohibitive barrier to the receipt of medically necessary services. Chapter 43 - 11/i4100 C-15 Section 43-Z. Payment of Fees Required. The fees specified in this Chapter shall be paid at the time of the filing of the application ar request for service. In no event will an application or request be determined or deemed complete and action taken thereon unless and until the applicable fees have been paid in full. Section 433. Late Renewal Fees. Late renewal flees for annually billed services shall be charged as follows: Payment received 0-30 days of billing date - 0% Payment received 31-60 days of billing date - 10% Payment received 61+ days of billing date - 50% Section 43-4. Refund Policy a. Refunds shall be made for all fees erroneously paid or collected. b. Refunds shall be made for services not rendered. All refunds sha[I be less departmental costs (e.g. filing fee, plan review, inspection}. c. No refunds shall be made for renewal fees or annual operational permits. d. Claims for refunds shall be submitted on Butte County General Claim Forms by the person who paid the fee. e. Claims for refunds must be made within one year of the date the fee was paid. Section 2. Effective date of fees. The fees amended and adopted by this ordinance shall be effective commencing February 19, 2001. Section 3. Findings. The Board of Supervisors hereby fnds that the fees amended and adopted by this ordinance do not exceed the estimated reasonable cast of providing the service for which each such fee is to be charged and that they are amended or adopted to recover actual expenses of the Health Department in performing the activities or providing the services specified. Authority.- This ordinance is enacted pursuant to Health and Safety Code Sections 101325, 11 fi340, 116565, 113920, 25286, 25287,and 25513 Government Code Sections 54985, 66017 and 66018, Article 1 of the Butte County Charter, and Article XI, Section 7 ofthe California Constitution. This Ordinance shall be and it is hereby declared to be in full force and effect from and after thirty (30) days after the date of its passage, and before the expiration of fifteen {15} days after its passage, this Ordinance shall be published once with the names of the members of the Board of Supervisors voting for and against it in the Chico Enterprise, a newspaper published in the County of Butte, State of California.
