AN ORDINANCE AMENDING CHAPTER 2 OF THE BUTTE COUNTY CODE
REGARDING FEES FOR SERVICES RENDERED BY THE
COUNTY CLERK RECORDER
The Board of Supervisors of the County of Butte ordains as follows:
Section 1. Butte County Code Section 211.2 County Clerk Fees is repealed.
Section 2. Butte County Code Section 2-11.3 County Recorder Fees is repealed.
Section 3. Butte County Code Section 2-11.4 Election Fees is repealed.
Section 4. Findings. The Board of Supervisors makes the following findings:
a. Government Code Section 54985 authorizes a county to increase certain
statutory and other fees as necessary to recover the costs of providing any product or service.
b. A fee study has been conducted to determine the cost of the Butte County
Clerk-Recorder's office providing specified services and products and said study has been
made available to the public pursuant to Government Code Section 54986.
c. A public hearing has been duly noticed and held on August 27, 2002, at 10:45 am
pursuant to the requirement of Government Code Section 54986 to consider said study and to
receive oral or written presentations pertaining thereto.
d. This ordinance is enacted pursuant to Article I, Section 1 of the Butte County
Charter, Article XI, Section 7 of the California Constitution, and Government Code Sections
54985 and 54986.
Section 5. That new Section 2-11.3 of the Butte County Code is hereby added to read
as follows:

The fees specif ed below are hereby determined necessary to recover the costs of providing
the respective products or services for which they relate and are hereby establ ished and
adopted as the applicable fee therefor.
(a) Certification and Copes:

27 Section 7. Severability . If any part of this ordinance shall be held void by a court of
28 competent jurisdiction, such part shall be deemed severable, and the invalidity thereof shall
29 not affect the remaining parts of this ordinance.

1 Section $. Effective Date of Ordinance and Publication thereof: This Ordinance shall be
2 and it is hereby declared to be in full force and effect from and after thirty {30) days after the
3 date of its passage, and before the expiration of fifteen {15) days after its passage, this
4 Ordinance shall be published once with the names of the members of the Board of
5 Supervisors voting for and against it in the Chico Enterprise Record, a newspaper published
6 in the County of Butte, State of California.
