HomeMy WebLinkAbout3834ORDINANCE NO. 383+ 1 2 3 4 5 6 7 8 9 is ZI 12 13 I4 I5 1B 17 ?8 19 20 21 22 23 24 23 26 A CONDITIONAL ZONING ORDINANCE, LIMITING USES TO THAT WHICH ARE SHOWN ON FIGURE 3-7 OF THE NEAL ROAD LANDFILL EXPANSION PROJECT ENVIRONMENTAL IMPACT REPORT, ZONING A PORTION OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA, A P-Q {PUBLIC-QUASI PUBLIC) DISTRICT, PURSUANT TO SECTION 24-25.40. THE LAND TO BE REZONED LIES ADJACENT TO THE NEAL ROAD LANDFILL AND IS INTENDED TO BE INCORPORATED INTO THE LANDFILL The Board of Supervisors of the County of Butte, State of California, under and pursuant to Section 24-25.40 of the Butte County Code of said County, ORDAINS, as follows: SECTION 1. The hereinafter described area situate in the County of Butte, State of California, shall be and it is hereby zoned as a P-Q (Public, Quasi-Public) Dist~'ict, and such area shall be subject to the restrictions and restricted uses and regulations pursuant to Butte County Code Section 24-215. Said area so zoned being located in the unincorporated area of Butte County, Chico area, more particularly described as follows: Being a portion of Parcel 2 as shown on that certain map entitled "Parcel Map B", as filed in Book 132 of Parcel Maps at Pages 93 through 47 together with a portion of Parcel 2 as shown on that certain map entitled "Parcel Map, a Division of Parcel 3 of Parcel Map B", as filed in Book 136 of Parcel Maps at Pages 14 through 16, on file in the Office of the County Recorder of the County of Butte, State of California, mare particularly described as follows: COMMENCING at the most northerly corner of Parcel 1 as shown on that said Parcel Map entitled "Parcel Map, a Division of Parcel 3 of Parcel Map B", said corner lying on the westerly right-of way line of Nance Canyon Drive, said point also lying on the easterly line of a 100' wide electrical easement as recorded in the Office of the County Recorder of the County of Butte, State of California in Book 322 of Official Records at Page 145; THENCE leaving said westerly right-of=way line of Nance canyon Drive, South 41°15'50" East, along the easterly line of said Parcel 1 and the easterly line of said electrical easement, a distance of 152.02 feet to a point on the easterly right-of- 1 2 3 4 5 6 7, S 9 10 1 ~. 12 13 ~4 15 16 17 18 19 20 2Z 22 23 24 2S 26 way line of Nance Canyon Drive and the True Point of Beginning of the herein- described parcel; THENCE leaving said easterly right-of way line of Nance Canyon Drive, said easterly line of Parcel 1 and said easterly line of said electrical easement, North 04°27'59" East, a distance of 1030.81 feet; THENCE North 53°25'35" East, a distance of 970.00 feet to a point on the southerly line of said Parcel 2 as shown on said map entitled "Parcel Map, a Division of Parcel 3 of Parcel Map B"; THENCE leaving said southerly line of said Parcel 2, South 66°25'10" East, a distance of 613.47 feet to a point on the northwesterly line of the Butte County Disposal Site as described in deed as recorded in the Office of the County Recorder of the County of Butte, State of California, under Recorders Serial No.92-003801 ; THENCE along said northwesterly line, South lI°33'07" West, a distance of 1035.00 feet to the most westerly comer of said Butte County Disposal Site; THENCE along the southwesterly line of said Butte County Disposal Site, South 36°34'25" East, a distance of 1000.00 feet to the most southerly corner of said Butte County Disposal Site; THENCE leaving said southwesterly line, South 60°34'04" West, a distance of 1082.29 feet to a point on the easterly line of said Parcel 1, said paint also lying on the said easterly line of a 100 foot wide electrical easement; THENCE along said easterly line of Parcel 1 and said easterly line of said electrical easement, North 41 ° 15'50" West, a distance of 1315.33 feet to the True Point of Beginning. The above-described parcel contains 64.3 acres, more or less. Assessor Parcel Number: 040-600-082 (portion), containing 64.3 acres, more or less. SECTION 2.
