HomeMy WebLinkAbout38381 2 4 5 6 a 9 1Q 11 1z 13 ~~ 15 16 17 1a 19 ao z1 zz 23 z4 25 Ordinance No. ss3s AN ORDINANCE AMENDING SECTIONS 19-5, 19-9 AND 19-13 OF THE BUTTE COUNTY CODE PERTAINING TO SEWAGE DISPOSAL SYSTEM PERMITS, SEPTIC TANKS AND DEVELOPMENT OF LOTS AND PARCELS WITHIN THE CHICO URBAN AREA, AND PROVID[NG FOR IMPLEMENTATION OF THE "CHICO URBAN AREA NITRATE COMPLIANCE PLAN" The Board of Supervisors of the County of Butte ordains as follows: Section 1. Section 19-5 ofi the Butte County Code is amended to read as follows: ii$eCi. 19-5. Permits-Required. (a) No person shall begin or cause to have begun construction of any building or any sewage disposal system without first submitting plans of the means of sewage disposal to the health officer and obtaining a permit therefor from the health officer. (b) No person shall construct an auxiliary sewage disposal system for a building presently served by a sewage disposal system without first submitting plans of the proposed means of sewage disposal to the health officer and obtaining a permit therefor from the health officer. (c) No person shall extensively alter, repair, relocate, add to or replace any existing sewage disposal system without first securing a permit therefor from the health officer. (d) Permits issued pursuant to this section shall be valid for one {1) year and shall automatically become void one {1) year from the date of issuance, unless renewed prior to the expiration date. Permits for repair, alteration, replacement or enlargement shall be valid for one (1) year from the da#e of issuance and are not renewable. (e) Applications for permits to cons#ruct sewage disposal systems shall be submitted on forms provided by the health officer and shall include the following information: (1} A scale plot plan depicting the proposed building and its sewage disposal system along with other information deemed necessary by the health officer to insure compliance with this ordinance. (2) A scale floor plan of the building to be served by the proposed sewage disposal system. {3) Any other information including soil tests, calculations or documents deemed necessary by the health officer to insure compliance with this ordinance. (f} Any changes to an approved site plan, issued in conjunction with a county permit to construct a sewage disposal system, shall first be submitted to the health officer for approval and at the request of the health officer, document the revision on a scale site plan ("as-built")." Section 2. Section 19-9 of the Butte County Code is amended to read as follows: "Section 19-9. Septic tanks generally -2- ~- {a) Specifrcafions. Septic tank shat! be of two-compartment construction and a shall be the size and type constructed in accordance with the recommendations ~ ~ of the county health officer. The septic tank and all inlets and outlets thereto 4 shall be watertight, 6 {9 } Size. The minimum liquid capacity of the septic tank shall be ~ one thousand (1,000) gallons. s s ~ {2) Materials. The septic tank steal! be constructed of concrete '-0 ~ or other equally durable material satisfactory #o the county ~~ ~ health officer. as ~~ (b) Drainage Field. The effluent from the septic tank shall be discharged ~~ into an absorption field of the size and type constructed in accordance ~5 with the recommendations of the county health officer. 16 ~' The effluent line steal! be laid at a grade not to exceed four {4) inches per one 1e hundred (100) feet; provided, however, that where topography is flat and the soil i9 is porous and wel! drained, he may approve grades exceeding the above. 20 Effluent lines shall be installed in a trench not less than eighteen (18} inches wide 21~ on the bottom of which has been placed asix-inch layer of one-half to two and zz one-half {2-112) inch loose clean rack. Effluent lines shall be covered with a layer a3 of one-half inch to two and one half (2-112) inch rock at least two {2) inches thick. z4 A minimum of one hundred ffty (150) square feet of leaching area shall be zs provided in the trench bottom. When conditions are such #hat an absorption field -3- ~- _ cannot reasonably be expected to function, the health officer shall allow other a means of underground effluent disposal, provided that such other means of ~ disposal do not violate the laws of the state, or do not endanger the public health, g or create a nuisance. s 6 With respect to the construction of an additional or auxiliary sys#em to serve an ' existing building presently served by an adequate septic tank system, the health s officer may allow such lesser size septic tank and drainage field as will 9 accomplish the general purpose and intent of this chapter, u ~o x~ _ Section 3. Section 19-13 of the Butte County Code is amended to read as follows: ~.a i~ "Section 19-13. Develo ment of lots and arcels within the Chico Urban Z4 Area zs 16 (a }Definitions, i~ (1) Nitrate Compliance Plan -That plan adopted by the Butte ~s County Board of Supervisors on September 25, 2001 ~~ titled "Chico Urban area Nitrate Compliance Plan." 20 {2} Environmental Impact Report -That environmental impact ai report adopted by the Board of Supervisors on September 11, 2007 2z titled "Environmental Impact Report Chico Urban Area Nitrate 23 Compliance Plan". 24 (3} Chico Urban Area -That area shown by Appendix P of the Nitrate 25 Compliance Plan iden#ified as CSA 7 74 (Greater Chico Urban Area). -4- 1 i. Septic Tank Area -All of that area within the Chico ~ Urban Area not shown on Figures 1-3a and 1-3b of s Environmental Impact Report as an area to be sewered. 4 ii. Planned Sewered Area -All of that area within the Chico 5 Urban Area shown on Figures 1-3a and 1-3b of 6 Environmental Impact Report as an area to be sewered. (b) Septc Tank Development Density. s (1) Sewage Flaws -Unless approved in writing by the California State g Regional Water Quality Control Board, Central Valley Region (RWQCB), ~0 the maximum allowable sewage flow to a new septic tank system within zs the Chico Urban Area shall be one (1) dwelling unit (334 gallonslday) per 7-2 acre equivalent, In addition, parcel development shall comply with the as density standards of Section 19-21 (Table III) of this Chapter. ~4 - (2) Regional Board Review -For projects of over 1000 gallonlday ss wastewater flow within the Chico Urban Area, septic tank permits and ~6 related entitlements shall not be issued or authorized until the project l~ ~ applicant has secured concurrence of RWQCB. ~a (c) Future Public Sewer Connection lnfrastr~cture. sg Within the Planned Sewered Area, septic tank development shall include the ~~ construction of sewer laterals and/or public sewer fines adjacent to the property z~ for future sewer connection. Sewer laterals shall mee# installation criteria as approved by Department of Public Health. Sewer service mains shall meet zs standards of the expected sewer service provider and if the expected provider is z4 not known, of the Butte County Subdivision Ordinance Standards (Chapter 20, ~~ Butte County Code). -~- ~- ~ (d }Sewer Connection. z New development and/or substantial upgrades to existing development on ~ parcels within the Chico Urban Area shall be connected #o a public sanitary ~ sewer, if a public sanitary sewer exists within 250 feet of the _. property s boundaries and if all of the conditions set forth in subparagraphs {2}, (3) and 6 (4) of Section 19-t4(b) of this Chapter are also present." 7 e 9 Sec#ion 4. Findings The Board of Supervisors hereby fnds that the adoption of this zo Ordinance is a component ofi implementing the Chico Urban Area Nitrate Compliance ii ~ Plan. ~.z ~3 Section 5. Authority This Ordinance is enacted pursuant to Health and Safety Code ~-~ Section 1025, Article I of the Butte County Charter, and Article XI, Section 7 of the is ~ California Constitution. 16 ~'' Section 6. Severability.
