HomeMy WebLinkAbout38671 2 3 4 5 6 7 8 9 10 11 7.2 13 14 15 16 17 18 19 20 21 22 23 24 25 ORDINANCE No. 3867 ORDINANCE OF THE BOARD OF SUPERVISORS OF THE COUNT'Y' OF BUTTE APPROVING THE AMENDMENT OF CERTAIN TIME LIMTTATIONS WzTH RESPECT TO THE REDEVELOPMENT PLAN FOR THE GREATER CHICO URBAN AREA REDEVELOPMENT PR0~3ECT WHEREAS, Section 33213 of the Health and Safety Code states that th legislative body of a community may authorize the redevelopment of an are within its territorial limits by another community if such area is contiguou to such other community and requires that a redevelopment plan for such are shall be approved by ordinance enacted by the authorizing legislative body land WHEREAS, by adoption of County Ordinance No. 3046 on ~Tanuary 12, 1993 the Board of Supervisors of the County of Butte (the "Board of Supervisors" authorized, pursuant to Section 33213 of the Health and Safety Code, th Chico Redevelopment Agency to redevelop certain areas of the County subjec to further approval of the County; and WHEREAS, the City Council of the City of Chico, California (the "Cit Council"}, adopted City Ordinance No. 1968 on October 25, 1993, approving an adopting the Redevelopment Plan for the Greater Chico Urban Are Redevelopment Project, which included area incorporated within the City o Chico and area in the unincorporated portions of the County of Butte (th "Redevelopment Plan"); and WHEREAS, the Board of Supervisors adopted County Ordinance No. 3102 0 October 26, x,993, approving and adopting the Redevelopment Plan for th unincorporated areas of the County as described an the Redevelopment Plan and -1- 1 2 3 4 5 6 7 S 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 WHEREAS, the Redevelopment Plan was subsequently amended by Cit Ordinance Nc. 2110 on July 2 1995, consistent with Butte County Resolutio No. 93-162, adopted October 26, 1993; and WHEREAS, Section 33681.9 of the Health and Safety Code was added by 1045 which took effect on September 1, 2003, and requires the Agency durir. the 2003-04 fiscal year to make a payment for deposit in Butte County' Educational Revenue Augmentation Fund; and WHEREAS, Section 33333.6 of the Health. and Safety Code was amended b~ SB 1045 to provide that when an agency is required to make a payment pursuant to Section 33581.9 the legislative body may amend the redevelopment plan tc extend by one year the time limit of the effectiveness of the plan and the time limit to repay indebtedness; and WHEREAS, the City adopted Ordinance No. 2279 on December 16, 2003, which amended the Redevelopment Plan to extend by one year the time limit of the effectiveness of the Redevelopment Plan and the time limit to repay indebtedness; and WHEREAS, pursuant to Section 33213 of the Health and Safety Code, the County must approve the amendment of the time limit on the effectiveness of the Redevelopment Plan and the time limit to repay indebtedness, as adopter by City Ordinance No. 2279; NOW, THEREFORE, THE BOARD OF SUPERVISORS OF THE COUNTY OF BUTTE, DOE HEREBY ORDAIN AS FOLLOWS: Section 1. As set forth in City of Chico Ordinance No. 2279, th time limit on the effectiveness of the Redevelopment Plan, as set forth i Part VIII of the Redevelopment Plan, currently scheduled to terminate 4 years from the date of adoption of the Redevelopment Plan shall be extends -2- 1 2 3 4 5 5 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 by one year. Based upon such. extension, the effectiveness of th Redevelopment Plan will terminate on October 25, 2034. The time limit o repayment of indebtedness, currently scheduled to terminate ten years afte the date of termination of the effectiveness of the Redevelopment Plan shal also be extended by one year. Based upon such extension, the time limit a repayment of indebtedness will terminate on October 25, 2044. Section 2. Except as amended by this Ordinance, all the previou ordinances cited above shall remain in full force and effect. Section 3. This Ordinance shall be in full force and effect 3 days after its adoption. Section 4. If any part of this Ordinance is held to be invali for any reason, such decision shall not affect the validity of the remainin portion of this Ordinance, and this Board of Supervisors hereby declares tha it would have passed the remainder of this Ordinance if such invalid portio thereof had been deleted. Section 5. The Clerk of the Board of Supervisors will certify t the adoption of this Ordinance by the Board of Supervisors of the County o Butte, California, and cause the same to be published once in the Chic Enterprise Record, a newspaper of general circulation, published an circulated in the County of Butte, California.
