When any work for which a permit is required by the Butte County Cad is commenced prior to obtaining said permit, the investigation fee equal to sixty {60) percent of the amount of the permit fee shall be imposed, in addition to the payment of the permit fee. The payment of this fee shall not relieve any person from fully complying with the requirements of the Butte County Cade in the execution of the work, nor from other investigations prescribed therein. The fire chief may waive this investigation provision on written request by the applicantlpermittee showing that circumstances beyond the control of the applicant/permittee have prevented him/her from obtaining said permit. This investigation provision shall not apply to emergency work when it shall be proved to the satisfaction of the fire chief that such work w~ urgently necessary and that it was not practical to obtain a permit therefor before the commencement of work. In all such cases, a permit must be obtained as soon as it is practical to do so, and if there be an unreasonable delay in obtaining such a permit, the investigation fee as herein provided shall be charged, in addition to the permit fee. (18) Special event permit (one that requires inspection): $100.00. Section 6. Butte County Code Section 3-53 is added to read as follows: 3-53 Fire Department Fee Schedule-Emergency Response (1) Excessive Residential False Alarm--after 3 in 6 mo. period: $130.00 per incident. (2) Excessive Commercial False Alarm--after 3 in 6 mo. period: $193.00 per incident. 4 Usez Fee ~zdinance Section 7. Butte County Code Section 3-54 is added to read as follows: 3-54 Fire Department Fee Schedule-Non-Emergency Response {1) Certified Fire Report: $15.00. (2) Engine Company Standby Response: $140.00 per hoax. 4 Section S: Butte County Code Section 3-61 is amended to read as follows: 3-61 Schedule of fees. 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 zs A fee shall be charged for each service as specified below: (a} Agricultural pest control operator registration. (I) Twenty-five dollars ($25.00) per year for maintenance gardeners performing pest control. {2) Fifty dollars ($50.00) per year for agricultural pest control operators: (3) There shall be no fee charged for registration of fee exempt agricultural pest control operators. {b} Agricultural pest control advisor's registration. Ten dollars ($10.00) per year for pest control advisors who register in person in the county and who have listed on their license an address in the county or who choose this as the county of occupational choice, as the case maybe, and five dollars ($5.00) per year for an advisor who is now registering in an additional county. (c) Agricultural pest control aircraft pilots registration. Ten dollars ($10.00) per year for aircraft pilots who register in person in this county and five dollars ($5.00) per year for pest control aircraft pilots already registered in another county who is now registering in an additional county {as evidenced by possession of a pest control aircraft pilot county registration application imprinted by another county). (d) Structural pest control operator notification. Ten dollars ($10.00) per year for structural pest control operator notifying the agricultural commissioner that they intend to work in this county. (e) Apiary inspection services. (1) Interstate movement. Upon request of the owner or shipper of an apiary or apiary appliance who requires a certificate of apiary inspection in order to move such apiary to another state, the county agricultural commissioner shall make such inspections as may be necessary to determine the facts required by the state of destination of such apiary or apiary appliance. The fees for such inspections shall be as specified in paragraph {n}below. (2} Certification of colony strength. Upon request of the beekeeper or agricultural producer involved who requires a certificate of colony strength for bees used in pollination of agricultural crops, the commissioner may make such inspections as are necessary to determine the facts required. The fees for such inspections shall be as specified in paragraph (n) below. (3) Issuance of certificate. After making the inspection provided for in paragraph (1) or {2} and upon receipt of the required fee, the commissioner shall issue a certificate of apiary inspection stating the facts determined. (f} Plant shipment inspection far certification and or federal and state phytosanitary certificates shall be charged at the following rate: (1 }Field inspection required by the receiving country, state or county shall be charged as follows: a. A thirty-two dollar and fifty cent ($32.50) application inspection fee and b. An inspection rate of four dollars and fifty cents ($4.50) per acre per inspection. {2} All phytosanitary certif cotes will be charged a service fee of thirty-five dollars ($35.00) for each certificate issued. s User Fee Ordiaaance 4 6 9 10 11 12 I3 14 15 16 17 18 19 20 2i 22 23 24 25 26 27 28 {3} Fee exemptions: No fee shall be charged for one package (non-commercial) only, when the package is brought to the agricultural commissioner's office for inspection. (g} Fruit, nut and vegetable certification inspection; inspection and certification authorized. Upon request by owners, shippers, or other interested parties, the county agricultural commissioner may make such inspections as may be necessazy to issue such certificates. The fees for such inspection shall be as specified in paragraph (n) below. (h) Certification of farmers markets and certifed producers. (1) Fifty dollars ($50.00) for issuing certified producer's direct marketing certificate and five dollars ($5.00) for replacement or modification of a valid certificate. (2) Fifty dollars {$50.00) for each certified farmers mazket direct marketing certificate. (3) The fee for any additional inspection will be calculated and charged in accordance with subsection {n} to this section (i} Farm labor contractor registration. Fifty dollars ($50.00) per yeaz far farm labor contractors. (j}Investigation and confirmation of destruction of commodities required by research authorization. For the purpose of inspecting and config the destruction of commodities as required in a research authorization, the commissioner shall be paid actual costs incurred by the person who has the research authorization, as specified in paragraph {n) below, but not to exceed sixty-five dollars {$65.00) per inspection. (k) Planning fees shall be charged as follows: (1) Agricultural Waiver ministerial processing charge is sixty five dollars ($65.00) per application. (2) Land Conservation Agreement inclusion charge is one hundred dollars {$100.00). (3) Land Conservation Agreement cancellation or easement exchange charge is three hundred and one dollars ($301.00). (4) All planning applications that are referred to the Agricultural Commissioner for review or when an individual or business requests review by the Agricultural Commissioner will be charged at an hourly rate of sixty five dollars ($65.00) per hour with a minimum ofthirty-two dollars and fifty cents ($32.50) for one-half hour. Any additional or subsequent review of planning matters by the Agricultural Commissioner shall also be charged at this same rate. (m) For other services or inspections not specified, for which the Agricultural Commissioner enters into an agreement or contract, the Agricultural Commissioner may charge the hourly rate specified in paragraph (n) for such services or inspections. (n) Fees for inspections. For all inspections indicated in this section 3-61 for which there is not otherwise established a specific fee schedule, the fee charged shall he at the weighted hourly charge ofsixty-five dollars ($65.00) per hour plus mileage based on the then content Internal Revenue Service mileage reimbursement rate. In addition to the above, if an inspection and/or certification is requested at times other than normal working hours of the department, and personnel are available to conduct such inspection andlor certification, cost shall be at the rate of ninety-seven dollars and fifty cents {$97.50) per hour plus mileage based on the then current Internal Revenue Service Mileage reimbursement rate. (o} Non-domestic azaaimal damage control fees. {1}The fee for the placement of a trap to capture skunk, possum or raccoon or other non- domestic animal that is causing damage to urban property where the praperry owner or tenant requests service for two {2) weeks or less, shall be fifteen dollars ($15.00) (2} The fee for each servicing of a trap to remove non-domestic animals on urban property shall be ten dollars ($10.00). (3) The fee for each removal ofnon-domestic animals from non-ADC {animal damage control) program traps, assessment ofnon-domestic animal damage, and recommendation for remediatior where implementation may be performed by another party, shall be fifteen dollars ($15.00). 6 User Fee Ordinance 4 5 6 7 8 9 10 11 12 13 14 15 lfi 17 18 19 20 21 22 23 24 25 25 z~ 28 {4} The fee for the control of depredating animals on nonresidential property such as ranch or farm property for the protection livestock and other animal control services where the property operator requests service for eight (8) weeks or more shall be one hundred dollars ($100.00}. {5} The fee for services provided in subparagraph {4) above, for non-residential property for an interval of two (2) weeks or less shall be twenty-five dollars {$25.00). The property owner may request services for additional two-week intervals at twenty-fve dollars ($25.00) per interval up to a maximum total charge of one hundred dollars ($100.00) per calendar year. (p) Fees far miscellaneous services: The Agricultural Commissioner shall charge the following fees for miscellaneous services provided upon request (e.g. abatement of weeds and pests, certification of organic crops, data research): (a) Licensed staff (b) Non-Licensed staff (c) Materials and equipment county must rent or buy to perform the service (d) Mileage $65.04 per hoax $32.50 per hour Actual cost Current mileage reimbursement rate set by the IRS Staff time shall be calculated in quarters of an hour, and mileage shall be calculated in tenths of mile. Section 9. Butte County Code Section 3-81 is amended to read as follows: 3-81 Land development division fee schedule. Land development division fees shall be as follows: {a} Filing fees: (1}Subdivision map (1--49 lots}: $380.00 + $5.40 per lot. {2} Subdivision map (50 + lots}: Hourly billingl$650.00 deposit. {3}Parcel map: $491.00. (4) Revised map: $391.00. (5) Preliminary subdivision: $647.00. (6) Lot line adjustment: $359.00. (7) Legal lot determination/certificate of compliance: $621.00. (8) Waiver application: $489.00. (9) Reversion to acreage: $489.00. (10) Application for certificate of merger: $359.00 + $20.00 per resulting lot. (11 }Application for certif cate of merger into one single parcel: $243.00. Butte County Code Sectian 1.1-12 is amended to read as follows: User Fee Ordinance 11-12 Fees. {a} junk dealer, thirty-five dollars per year. (b} Junk collector, ten dollars per quarter for each vehicle used. {c} Secondhand dealer, thirty five dollars per year. {d}Pawnbroker, thirty-five dollars per year. {e} Peddlers, five dollars per month. Section 11. Butte County Code Section 14-22 is amended to read as follows: 14-22 Application. 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 A person seeking issuance of a parade permit shall file an application with the sheriff. (1}Filing period. An application for a parade permit shall be filed with the sheriff no less than thirty (30) days nor more than sixty (60) days before the date an which it is proposed to conduct the parade. (2) Content. The application for a parade permit shall set forth the following information: (a) The name, address and telephone number of the person or persons seeking to conduct such parade; (b) If the parade is proposed to be conducted, on behalf of, or by any organization, the name, address and telephone number of the headquarters of the organization, and of the authorized and responsible heads of such organization; (c) The name, address and telephone number of the person or persons who will be responsible for the conduct of the parade; (d) The date when the parade is to be conducted; (e) The route to be traveled, the starting point and the termination point; (f) The approximate number of persons who, and animals and vehicles which, will constitute such parade; the type of animals and descriptions of the vehicles; (g) The hours when such parade shall start and terminate; {h) A statement as to whether the parade will occupy all or only a portion of the width of the streets, roads, highways, alleys or thoroughfares proposed to be traveled; (I) The location by streets, roads, highways, alleys or thoroughfares of any assembly areas for such parade; (j) The time at which units of the parade will begin to assemble at any such assembly area or areas; (k) The interval of space to be maintained between units of such parade; (1} If the parade is designated to be held by, or on behalf of, any person other than the applicant, the applicant for such permit shall file with the sheriff a communication in writing from the person proposing to hold the parade, authorizing the applicant to apply for the permit on his behalf; {m) Any additional information which the sheriff shall fmd reasonably necessary to a fair determination of the regulation and conduct of such parade. {3} Late applications. The sheriff, where good cause is shown therefore, shall have the authority to consider any application hereunder which is filed less than thirty (30) days before the date such parade is proposed to be conducted. (4} Service fee. The sheriff will levy afifty-eight dollar ($58.00) service fee for processing of a parade permit. Section 12. Butte County Code Section 23-5 is amended to read as follows: 9 User Fee Ordinance 23-5 Permit to ship Christmas trees. 2 3 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 It shall be unlawful for any person to transport more than five Christmas trees over any public road in the county without having in his possession a Christmas tree shipping permit, which shat cost twenty-three dollars ($23.00) and shall contain the following: {a} The approximate number of Christmas trees being transported; {b} The dates during which such transporting is authorized; {c) The license number and description of the vehicle upon which such Christmas trees are being transported; {d) The written consent to such transportation dated and signed by the person who cut such Christmas trees; and {e) The written authorization for such ixansportation of Christmas trees dated and signed by federal forest office, officer of the state division of forestry, or peace officer having jurisdiction in the district from which such Christmas trees are to be shipped. Section 13. Butte County Code Section 23C-3 is amended to read as follows: 23C-3 Definitions. For the purpose of this chapter, the following terms and phrases shall be defined as set out below. (a) Weighing and measuring instruments shall include the following devices, and all other devices classified by the Secretary of Food and Agriculture as coming within section 12241 of the Business and Professions Code. {1) Electric meters--up to 200 AMP maximum capacity.* {2} All cordlwire and fabric meters. {3} Liquid meters--up to 30 GPM maximum capacity. {4) Liquefied petroleum gas meters--stationary LPG dispensers only--60 GPM maximum capacity. {5}Taximeters. {6) Vapor meters--up to 450 CFH maximum capacity.* (7} Water meters--up to 30 GPM maximum capacity. {$} Computing scales/POS systems/counter sales. *Each house or mobile home is considered to be one (1) location, except in a mobile home park or apartment complex where the park or complex is considered one (1) location. {9} Monorail and meat beam scales--up to and including 1,000 lbs. {10} Platform scales--up to and including 1,000 lbs. {11) Jewelers', prescription and precious metal scales. (12) Hanging scales--up to and including 1,000 lbs. {13} Odometers. {b) "Commercial purposes" shall have the meaning assigned to it by section 12500(e) of the Business and Professions Code. {c} "County sealer" shall mean the sealer ar Director of Weights and Measures appointed by the county board of supervisors and his/her duly authorized agents. {d} "Location" means the room, enclosure, building, space or area where one (1) or more weighing and measuring instruments are located or operated. Section 14. (c) For weighing devices, other than livestock and motor truck scales, with capacities of 20,000 pounds or greater, the registration fee shall be two hundred dollars ($200.00) per device. {d} For motor truck scales, the registration fee shall be one hundred dollars ($1.00.00) per device. {e) For livestock scales with capacities of 20,000 pounds or more, the registration fee shall be one hundred dollars ($100.00) per device, except that the fee for not more than three devices at a single lacation shall be one hundred dollars ($100.00). f) Only upon the written request of any person, firm or corporation, the sealer shall calibrate, test weigh, measure, and certify to the accuracy of, non commercial weights and measures and weighing and measuring devices, and instruments, tools, and accessories connected therewith. The monthly cost for supervision is ninety-four dollars (94.00). The cost of each adult drug testis fourteen dollars ($14.00). The cost of each supplemental report (new law violation} is three hundred seventy one dollars ($371.00}. The cost of each supplemental report regarding a technical violation of probation is two hundred seventy nine dollars {$279.00}. Section 16. Inability to pay shall not preclude participation in the home detention program. Section 17. Butte County Code Section 36-50 is amended to read as follows: ARTICLE VI. Work Alternative Program Fees 3b-50 Generally. Pursuant to Penal Code section 4024.2(e), thee is hereby established the following fees for the administration of Butte County `s work alternative program: (1} Initial implementation fee $55.00 (2} Daily program administration fee, per day 6.00 These fees shall be based upon the offender's ability to pay. Inability to pay shall not preclude participation in the work alternative program. Section 1$. Butte County Cade Section 40-4 is amended to read as follows: 40-4 Alarm System Permit. (a) Permit Required: (1) Except as otherwise provided hereafter, an ar after .Ianuary 1, 198$, it shall be unlawful far any person to install, connect, operate, or cause to be installed, connected, or operated, an alarm system in Butte County without first obtaining a valid alarm system permit. (2} Persons in possession of property which an alarm system is intended to protect shall be responsible for securing the alarm system permit, and said permit shall be issued only to the person who is in possession of the property which the alarm system is intended to protect. An alarm company which installs and/or connects an alarm system on a site other than the alarm company's awn place of business shall not be in violation of this section, notwithstanding at the 12 User Fee Ordinance I time of such installation and/or connection, no alarm system permit has been secured for the alarm system installed or connected. 2 (3) Except as provided hereafter, an alarm system permit shall be issued to such person named in subsection (2) above only if, at the; time the permit is applied for, the alarm system operated or 3 maintained or to be operated or maintained by such person has an automatic shutoff or reset 4 feature which deactivates the alarm within thirty (30) minutes after it is first activated and which has an auxiliary power system capable of operating the system for at least four (4) hours in the 5 event of the interruption or failure of utility power. Notwithstanding the foregoing, a permittee who maintains or operates an alarm system without an automatic shutoff or reset feature shall be 6 subject to the provisions of section 40-10(f}. (4) The sheriff shall issue the alarm system permit not later than forty-five (45} days following 7 the date of application, unless the alarm system does not comply with the specifications contained in this chapter, the applicant has failed to pay the required fee, or the application s contains misrepresentation of fact. {S} In the event the sheriff denies a permit to an applicant for any of the reasons set forth in 9 subsection (5) above, the applicant shall have the right to a hearing concerning the denial I0 pursuant to section 40-7. {b} Application for Permit: 11 {1}Applications for alarm system permits shall be filed with the sheriff on such forms as fhe sheriff may prescribe. 12 {2) An applicant may apply for a single permit for multiple alarm sites on the same parcel or for separate permits for each alarm site. If an applicant chooses to apply for a separate permit for 13 each alarm site, a separate application and permit fee shall be filed for each permit. (c) Required information: 14 {1) Each alarm system permit application shall contain the following information: a. Name, address and telephone number of the person who will be the permit holder and of the I5 person responsible for the proper maintenance and operation of the alarm system and payment of I6 feeslpenalties assessed under this chapter. b. Classification of the alarm site as either residential or commercial. I~ c. Purpose of the alarm system; i.e., burglary, robbery, panic. d. Name, address and telephone number of the person(s) who will respond or will cause a I8 response to the alarm site when notified of an alarm situation. e. System description of the automatic shutoff or reset feature of the alarm system which will 19 deactivate the audible portion of the alarm system within thirty (30} minutes after it is fast activated. 20 f. System description of the auxiliary power supply of the alarm system which will sustain the 2I alarm system for at least four (4) hours in the event of an interruption or failure of the utility power. 22 g. Other information as may be reasonably required by the sheriff. (d} Information Changes: A permit holder shall inform the sheriff or any change that alters any 23 information listed on the permit application within ten (10) days after such change. (e) Permit Fee: 24 (1) Every applica#ion for an alarm system permit shall be accompanied by a nonrefundable fee in the amount of eighty-seven dollars ($87.00). This fee is imposed for the purpose of defraying the 25 cost of processing and overseeing the permit process. {2} Every applicant shall be given a receipt for the aforesaid permit fee at the time such fee is 26 paid and the application is approved. Persons exempt from payment of fees shall be issued a 27 receipt as if a fee has been paid. The receipt shall serve as a temporary alarm system permit for a period not to exceed forty-five (45) days from the date on which the fee was paid, and shall be of 28 13 Usez k'ee Ordinance no force or effect after the forty-five-day period expires, or after the alarm system permit is issued, whichever event occurs first. {3} Permit fees are for athree-year duration unless: a. The permit user moves to a different address; or h. The permit is revoked. In either case, the unused portion of the fee shall be forfeited. {4} Persons exempt from permit fees include: a. Persons pursuant to Government Code section 6103; and b. Residential alarm users over the age of sixty-five {65) who are the primary resident of the residence and if no business is conducted at the residence. (f) Transferability: An alarm system permit shall not be transferred to another person. If the person in possession of an alarm site protected by an alarm system changes, the new possessor shall obtain a new permit. Butte County Code Section 40-5 is amended to read as follows: 40-5 Service fees. {a) Required: Any person who maintains or has an alarm system which signals a false alarm (any signal by an alarm system which causes a police response when an emergency situation does not exist) shall pay a service fee to the County of Butte as follows: (1}For the first through the third false alarm during any period of twelve (12) consecutive calendar months, there shall be no charge; (2} For the fourth through the sixth false alarm during any period of twelve (12) consecutive calendar months, there shall be a charge of fifty dollars ($50.00) per alarm. (3}For the seventh through the ninth false alarm during any period of twelve (12) consecutive calendar months, there shall be acharge ofone-hundred dollars ($100.00} per alarm. (4} For each false alarm in excess of nine during any period of twelve {12) consecutive calendar months there shall be a charge ofone-hundred and fifty dollars {$150.00}. Section 20. This process insures that the costs of services is not a prohibitive barrier to the receipt of rnedically necessary services. Section 21. Butte County Code Section 44-1 is amended to read as follows: 44-1 Liability for cost of minor's support in juvenile hall. A parent of a minor, the estate of a parent, and the estate of the minor shall, pursuant to Welfare and Institutions Code section 903 and this section, be liable for the reasonable cost of support of the minor while the minor is placed, detained in, or committed to the Butte County Juvenile Hall pursuant to an order of the Juvenile Court. The liability of these persons and estal shall be a joint and severable liability. The reasonable cost of support of a minor chargeable pursuant to this section, based upon the average actual costs incurred by the county for food and food preparations, clothing, personal supplies and medical expenses, and excluding costs of incarceration, treatment or supervision, is 23 Usez Fee ~xdinance determined {pursuant to Welfare and Institutions Code section 904) to be twenty dollars and thirty one cents ($20.31) per day. Section 22. Butte County Code Section 44-2 is amended to read as follows: 44-2 .luvenile hall rate billable to other counties. Other counties which place or detain or commit minor persons to the Butte County Juvenile Hall pursuant to the order of a Juvenile Court shall be liable to Butte County for the costs far the care, support and maintenance of such minor persons at the Juvenile Hall. The average cost of such care, support and maintenance is determined (pursuant to Welfare and Institutions Code section 904) to be one hundred thirty two dollars and sixty four cents ($132.64) per day. Section 23. Authority. This ordinance is enacted pursuant to Government Cade Sections 10 11 12 13 14 15 16 17 18 14 20 21 22 23 24 25 2b 27 28 66017(a) and 66016(b), Article I, Section 1 of the Butte County Charter, and Article XI Section 7 of the California Constitution. Section 24. Severability. If any provision of this Ordinance or the application thereof to any person or circumstances is for any reason held to be invalid by a court of competent jurisdiction, such provision shall be deemed severable, and the invalidity thereof shall not affect the remaining provisions or other applications of the Ordinance which can be given effect without the invalid provision or application thereof. Section 25. Findings. The Board of Supervisors hereby finds that the amounts of the fees adopted herein were evaluated and determined by MAXIlVIL7S in a fee study presented to the Board of Supervisors on May 25, 2004. In reliance on this fee study, all the fees adopted in this ordinance are set at or below the full cost of providing the service or product for which the fee is charged. Section 26. Effective Date and Publication. This Ordinance shall take effect sixty (60) days after the date of its passage. The Clerk of the Board of Supervisors is authorized and directed to publish this ordinance before the expiration of fifteen (15) days after its passage.
