AN ORDINANCE OF THE COUN'T'Y OF BUTTE AMENDING
SECTIONS 3-178, 3-194, 3-197, 3-213, 3-216, 3-232, 3-235, 3-251, 3-254, 3-270 AND
AND ADDING SECTIONS 3-185, 3-204, 3-223, 3-242, 3-261 AND 3-280
OF CHAPTER 3 OF THE BUTTE COUNTY CODE
The Board of Supervisors of the County of Butte ordains as follows:
Section 1. Butte County Code Section 3-178 is amended as follows:
3-178 Exemption From library facilities and equipment fees.
1~lotwithstanding any provisions of this article to the contrary, a Library facilities and equipment feE
l not be authorized and levied upon an owner of real property located in the unincorporated
ncorporated area of Butte County adding or enlarging one (1) or more structures to such property c
onverting the use thereof to a more intensive use under the following circumstances:
a) Where the structure is owned by a governmental agency.
b) Where the structure is a building, or is within a building, which is being reconstructed followir
mage or destruction by fire or other casualty, or the voluntary demolition thereof, provided that

Butte County Code Section 3-197 is amended as follows:
197 Exemptions from general government facility fees.

17. Butte County Code Section 3-280 is added as follows:

18. Severability. If any provision of this Ordinance or the application thereof to any person
circumstances is for any reason held to be invalid by a court of competent jurisdiction, such
rovision shall be deemed severable and the invalidity thereof shall not affect the remaining
isions or applications or the Ordinance which can be given effect without the invalid provision
application thereof.
Effective Date and Publication. This Ordinance shall take effect sixty (60) days after
he date of its passage. The Clerk of the Board of Supervisors is authorized and directed, before the
xpiration of fifteen (IS) days after its passage, to publish this Ordinance once, with the names of
tiers of the Board of Supervisors voting for and against it, in the Enterprise-Record a newspaper
ublished in the County of Butte, State of California.
PASSED AND ADOPTED by the Board of Supervisors of the County of Butte, State of
California, on the 30`" day of August 2005 by the following vote:
