An Ordinance Amending
Chapter 43 Public Health Department Fees
of the Butte County Code
The Board of Supervisors of the County of Butte ordains as follows:
Section 1. Butte County Code Section 43-1 is amended to read as follows:
43-1 Fees charged for services.
The Butte County Public Health Department is authorized to charge, in addition to any
other fees required by the County of Butte or the State of California, the following fees for
services it provides:
A. Food establishment: Each separate facility requires a separate plan review and/or
permit and the payment of the following fees:

P. Medical services The charges for medical visits, screening procedure, laboratory
examinations and medications are based upon estimates of the actual cost of delivering the
services. Selected charges are based upon state established reimbursement rates. All charges are
updated as necessary.
Q. Sliding Scale: The department utilizes a sliding scale to determine payment for selected
medical services. This process insures that the costs of services is not a prohibitive barrier to the
receipt of medically necessary services.
.Section 2. Authority. This ordinance is enacted pursuant to Government Code Sections
', 5b017(a) and b6016(b}, Article Y, Section 1 of the Butte County Charter, and Article XI Section
7 of the California Constitution.
Section 3. Severability. If any provision of this Ordinance or the application thereof to any
person or circumstances is for any reason held to be invalid by a court of competent jurisdiction,

such provision shall be deemed severable, and the invalidity thereof shall not affect the
remaining provisions ar other applications of the Ordinance which can be given effect without
the invalid provision or application thereof.
Section 4. Effective Date and Publication. This Ordinance shall take effect thirty {30) days
after the date of its passage. The Clerk of the Board of Supervisors is authorized and directed to
publish this ordinance before the expiration of fifteen {l5) days after its passage. This Ordinance
shall be published once, with the names of the members of the Board of Supervisors voting for
and against it, in the Chico Enterprise-Record, a newspaper of general circulation published in
the County of Butte, State of California.

California, on the 9~' day of November 2005 by the fallowing vote:
