2 AN ORDINANCE AMENDING ARTICLE XVIII, SECTION 2-151

4 The Baard of Supervisors of the County of Butte ordains as follows:
5 Section 1. Article XVIII, Section 2.151 of the Butte County Code is amended to read as follovtirs:
6 " 2-151 Duties of department.
~ The duties Co be performed by the department of development services shall be as follows:
$ (a) Building division. The building division shall administer all building
9 regulations adopted by the county and appropriate state building
10 regulations, and issue all permits related thereto.
11 (b) Planning division. The planning division shall administer all technical
12 matters pertaining to planning and zoning pursuant to regulations adopted
13 by the county.
14 (c) Director or designee(s).
15 (1) Notwithstanding any other provision of this Cade to the contrary providing
16 for the submission of permit and land use entitlement applications to the
17 department of development services, the director of development services, or his
18 or her designee, shall establish procedures, requirements and forms for the
19 submission of such applications, including, but not limited to, procedures far pre-
20 application screening of any development proposing the use of a sewage system or
21 domestic water. Pre-application screening regarding such developments may
22 require the developer to submit verification that any proposed sewage disposal
23 system or domestic well, or sewer or domestic water service provided by a special
24 district or other entity, is feasible and available to serve the proposed development
25 No permit or land use entitlement application shall be received for any proposed
26 development which has not successfully completed all required pre-application
27 screening procedures.

1 (2) The director of development services, or his or her designee, shall perform
2 such other duties and functions as may be assigned from tune to time by the board
3 of supervisors."
4 Section 2. Severability. If any provision of this Ordinance or the application thereof to any person or
5 circumstances is for any reason held to be invalid by a court of competent jurisdiction, such provision
6 shall be deemed severable, and the invalidity thereof shall not affect the remaining provisions or other
7 applications of the Ordinance which can be given effect without the invalid provision or application
8 thereof.
9 Section 3. Effective Date and Publication. This Ordinance shall take effect sixty (60) days after the date
10 of its passage. The Clerk of the Board of Supervisors is authorized and directed to publish this ordinance
11 before the expiration offifteen {15) days after its passage. This Ordinance shallbe published once, with
12 the names of the members of the Board of Supervisors voting far and against it, in the Chico Enterpries-
13 Record, a newspaper of general circulation published in the County of Butte, State of California.
14 PASSED AND ADOPTED by the Board of Supervisors of the County of Butte, State of
15 California, on the 10`h day of January 2006 by the following vote:
16 AYES: Supervisors Connelly, Dolan, Houx, Yamaguchi and Chair Josiassen
17 NOES: None
ABSENT: None
