ORDINANCE RESCINllING THE
COMMUNITY HEALTH CARE ORDINANCE
WHEREAS, the County of Butte adopted Ordinance 3826 creating the "Tobacco
Monies Ads-isory Commission in August 2002; and
WHEREAS, ordinance 3846, adopted in April 2003 amended and codified Ordinance
3826 as sections 2-190 through 2-193 of the Butte County Code; and
WHEREAS, the purpose of the Tobacco Monies Advisory Commission was to make
recommendations to the Butte County Board of Supervisors and the Children and
Families Cammission regarding the appropriation of tobacco-related funds available
within Butte County and to monitor the success of the programs and services supported
by those funds; and
WHEREAS, the Children's and Families Commission has a committee and
subcommittee structure that provides for similar recommendations and oversight of
tobacco-related programs. making the Tobacco Monies Advisory Commission redundant;
and
WHEREAS, the Public Health llepartment has implemented various education and
prevention programs to reduce tobacco use in Butte County, especially among young
adults and children; and
WHEREAS, a recent survey of merchants in the unincorporated area of Butte County
found 97% compliance with the tobacco access laws prescribed under the California Stop
Tobacco Access to Kids Enforcement Act, demonstrating the success of education and
prevention programs administered within the county.
NOW, THEREFORE, BE IT ORDAINED AS FOLLOWS:
Section I. Community }Iealth Care Ordinance Redundant
The People of the County of Butte find and declare that the intent of provisions of~
Ordinance 3826 passed and adopted by the Board of Supervisors, County of Butte on
August ] 3, 2002 are fulfilled by the committee and subcommittee structure of the
Children and Families Commission making the provisions of Ordinance 3826 and 3$46
redundant.
Section 2. Ordinance 3826 and 3846 Repealed arld Rescinded
Ordinance 3826, codited by Ordinance 3846, are both hereby rescinded and repealed in
their entirety.
Passed and adopted by the board of Supervisors of the County of Butte this 14th day of
February , 2006, by the following vote:
AYES: Supervisors Connelly, Dolan, Houx, Yamaguchi and Chair Josiassen
