2 AN ORDINANCE OF THE COUNTY OF BUTTE
3 AMENDING SECTIONS 3-1.64 OF CHAPTER 3 AND
4 SECTION IO-33.5 OF CHAPTER 14 OF THE BUTTE

6 The Board of Supervisors of the County of Butte ordains as follows:

8 SECTION I .Amendment to Section 3-164 of A icle XVII of Chapter 3 of the Butte
9 County,,Code.

1 I Section 3164 of the Butte County Code is amended to read as .follows:

13 Section 3-164 Amount of fees.

15 The amount of the fees assessed and levied pursuant to the provisions of this Article shall
16 be as set forth in the Table below, except as exempted by Section 3-166 or reduced by a
17 credit pursuant to Section 3-163 (C}, and shall be applicable as to all projects of the types
18 specified in section 3-163 for which application is made to the County of Butte for a
19 development permit on and after February 8, 2003:

5 SECTION 2 . Amendment to Section 10-33.5 of Article IV of Cha ter 10 of the Butte Count Code

7 Section 10-33.5 of Article IV of Chapter 10 of the Butte County Code is amended to read as follows:

9 10-33.5 Amount of street facility improvement fees.
0 The amount of the street facility improvement fees assessed and levied pursuant to the provisions of this Article
1 shall be as follows, except as exempted by section 10-36 of this article, and shall be applicable as to all projects of
2 the types specified in section 10-32 of this article for which application is made to the County of Butte for a
3 permit on and after September 16, 1988:

SECTION 3. Severability. If any provision of this Ordinance or the application thereof to any person or
circumstances is for any reason held to be invalid by a court of competent jurisdiction, such provision shall be
deemed severable, and the invalidity thereof shall not affect the remaining provisions or other applications of the
Ordinance which can be given effect without the invalid provision or application thereof.
SECTION 4. Effective Date and Publication. This Ordinance shall take effect sixty (60) days after the date of
its passage. The Clerk of the Board of Supervisors is authorized and directed to publish this ordinance before the
expiration of fifteen (15) days after its passage. This Ordinance shall be published once, with the names of the
members of the Board of Supervisors voting for and against it, in the Chico Enterprise Record, a newspaper of
general circulation published in the County of Butte, State of California.
PASSED AND ADOPTED by the Board of Supervisors of the County of Butte, State of California, on the
12th day of December , 200b, by the following vote:
AYES: Supervisors ConnelJ.y, Dolan, Yamaguchi and Chair Josiassen
