HomeMy WebLinkAbout39611 ~ Ordinance No . 3961 3 SPECIFIC PLAN AMENDMENT 06-01: ORDINANCE AMENDING THE 4 M-1 ZONE OF THE NORTH CHICO SPECIFIC PLAN TO ALLOW AS 5 CONDITIONAL USES, SUBSTANTIALLY SIMILAR USES TO THOSE 6 SPECIFIED IN CHAPTER 7, PAGES 7-19 AND 7--20 OF THE NORTH 7 CHICO SPECIFIC PLAN. 8 9 The Board of Supervisors of the County of Butte ordains as follows: 10 11 Sectron 1. Pages 7-19 and 7--20 of Chapter 7 of the North Chico Specific Plan are amended to read as follows: 12 1. Site Requirements 13 -Lot Area Required: None 14 -Lot Width Required: None 15 -Front Yard Required: 10 feet minimum, 20 feet average. 16 -Rear Yard Required: None, except where the rear yard 17 abuts an R district, in which case the rear yard shall be not less than five (5) feet. 18 -Side Yard Required: None, except when the side of a 19 lot abuts upon the side of a lot in an R district, in which case the abutting side yard shall not be 20 less than five (5) feet; and except where the side yard on the street side of a corner lot abuts on an ~1 R district, in which case the side yard on the 22 street side shall be one-half the front yard required in such R districts. 23 -Maximum Building Coverage: 600 24 -Minimum Landscaped Open Space: 50 of lot area, including parking lot interior and perimeter 25 landscaping. ~( -Maximum Building Height: 50 feet 27 i 1 --Parking Requirements: Off-street parking shall be provided at the rate as required by Butte County 2 Code section 24-240. 3 2. Uses Permitted (1) Wholesale and storage warehouses; 4 (2) The assembly and storage of goods, materials, 5 liquids and equipment {except the storage of inflammable matter or explosives or materials which ~ create dust, odors or fumes); (3) The manufacturing, processing, fabricating, 7 assembling, refining, repairing, packaging, and treatment of goods, materials and praducts by power S {oil, gas or electric), including, by way of example 9 and illustration, but not limited to, the manufacturing, fabrication. and assembling of lp bathroom shower and patio partitions, enclosures and doors, windows and store fronts of aluminum, plastic 11 anal fiberglass, or other suitable material, and the processing, finishing, polishing anal anodizing of 12 aluminum extrusions and castings, assaying, broom 13 and brush manufacturing, die casting, draying, freighting or trucking yards or terminals, heavy 14 equipment rental or sale, heating and ventilating service shops, jewelry manufacturing, lumberyards, 15 packaging plants, public utility service yards, 16 truck repairing and overhauling and welding shops; {4} Dyeing and rug cleaning plants, veterinary hospitals 1~ and animal shelters and boarding kennels, cabinet and wordworking shops, construction and material 1$ yards ; 19 3. Uses Re irin Use Permits 20 The following uses are permitted subject to securing a 21 use permit in each case: 22 (a} Storage of Inflammables; 23 (b) Manufacturing of acids, explosives, fertilizer, glue, gypsum, lime, plaster of paris, pulp and 24 paper, beet sugar, crushed rock, sand and gravel, cement, concrete and/or asphalt batching plants, 25 concrete and clay products; (c} Industrial uses which might be objectionable by 26 reason of emission of noise, offensive odor, smoke, dust, bright light, vibration or involving the 27 handling of explosives or dangerous materials; 2 1 (d} Recycling facilities as per section 24-275; (e) Uses substazztially similar to other uses listed in 2 this zone. 3 Section 2. Severability. If any provision of this 4 Ordinance or the application thereof to any person or 5 circumstances is for any reason held to be invalid by a 6 court of competent jurisdiction, such provision shall be 7 deemed severable, and the invalidity thereof shall not 8 affect the remaining provisions ar other applications of the 9 10 Ordinance which can be given effect without the invalid 11 provision or application thereof. 12 Section 3. Effective Date and Publication. This 13 Ordinance shall take effect thirty ( 3 0 } days after the date 14 of its passage. The Clerk of the Board of Supervisors is 15 authorized and directed to publish this ordinance before 16 the expiration of fifteen (15) days after its passage.
