An Ordinance Amending Chapter 1 -General Provisions and
Chapter 3 -Fees of the Butte County Code
The Board of Supervisors of the County of Butte ordains as follows:
Section 1. Purpose. This proposed ordinance amends Chapter 1-General Provisions of the
Butte County Cade by amending Section 1-1$ to allow for the Board of Supervisors to authorize
the waiver of any and all County fees that maybe legally waived and are established by and
under the authority of the Board of Supervisors and adding Section 1-19 -Reserved. In addition
the proposed ordinance amends Chapter 3 -Fees by amending Section 3-40.5 -Waiver, Refund
or Transfer of Fees. to remove discussion of waivers.
Section 2. Butte County Code Section 1-18 is amended to read as follows:
1-18 Waiver of fees.
The Board of Supervisors may waive all or part of any fee set forth in the Butte County
Code that they have the legal authority to waive, if the applicant is a public entity ornon-profit
charitable organization or if the Board of Supervisors finds that it is otherwise in the public
interest to do so.
Section 3. Butte County Code Section 1-19 is added as follows:
1-19 Reserved
Section 4. Butte County Code Section 3-40.5 is amended to read as follows:
3-4Q.5 Refund or transfer of fees.
All or part of any fee specified in this article maybe ~ivefl; refunded or transferred to a
related application upon the order of the Board of Supervisors, if the applicant is a public entity
or non-profit charitable organization or if the Board of Supervisors finds that it is otherwise in
the public interest to do so.
Section 5. Severability. If any provision of this Ordinance or the application thereof to any
person or circumstances is for any reason held to be invalid by a court of competent jurisdiction,

such provision shall be deemed severable, and the invalidity thereof shall not affect the
remaining provisions or other applications of the Ordinance which can be given effect without
the invalid provision or application thereof.
Section 6. Effective Date and Publication. This Ordinance shall take effect thirty (30) days
after the date of its passage. The Clerk of the Board of Supervisors is authorized and directed to
publish this ordinance before the expiration of fifteen (15) days after its passage. This Ordinance
shall be published once, with the names of the members of the Board of Supervisors voting far
and against it, in the Enterprise Record , a newspaper of general circulation
published in the County of Butte, State of California.

California, on the 22nd day of July, 2008, by the following vote:
AYES: Supervisors Connelly, Kirk, Dolan, Yamaguchi, and Chair Josiassen
