Purpose. This ordinance amends Section 20-133 of Chapter 20, Subdivisions retarding the maximum length of a cur-de-sac streets, consistent with the California Code o Regulations Title 14-Natural Resources; Division 1.~-Department of Forestry and Firs Protection; Chapter 7-Fire Protection; Subchapter 2-SRA Fire Safe Regulations; Article 2 Emergency Access; Section 1273.09 (14 CCR 1273.09) adopted pursuant to Public Resource Code Section 4290. Section 2. Butte County Code Chapter 20 Section 133 is repealed and re-enacted ti read as follo~e~s: (a) 2d-133 Cur-de-sac streets. The maximwn length of a cur-de-sac street, including all cur-de-sac streets accessed fron that cur-de-sac street, shall depend upon the minimum parcel size specified in the zoning applicable to the parcels served by the street. The maximum street length shall no' exceed the following cumulative lengths, regardless of the number of parcels served: 1. Parcels zoned for less than one acre - 800 feet 2. Parcels zoned for 1 acre to 4.99 acres - 1320 feet 3. Parcels zoned for 5 acres to 19.99 acres - 2640 feet 4. Parcels zoned for 20 acres or larger - X280 feet 1 3 ~t S 6 7 8 9 10 11 12 li 1~ 1~ 16 l7 is 19 20 21 ~~ ~; ~~ 75 The cul-de-sac street length shall be measured ti-om the property line of the first parcc that has no access other than the cul-de-sac street and which is nearest the intersectiot that begins the street to the end of the road surface at its farthest point. Where a cul- sac street crosses areas of differin~~ rc~ned parcel sires, rc:quirin;~ dit`ferent len~~th limits the shortest allowable street length shall apply. (b) Where parcels are zoned ~ acres or larger, standard turnarounds shall be provided at maximum of ] 320 foot intervals. (c) Each cul-de-sac street shall have a standard turnaround constructed at its terminus. (d) Where the cul-de-sac street length already exceeds the maximum length allowed above. then the parcel shall not be allowed to subdivide without providing circulation with an approved access to reduce the cul-de-sac length to at or below the length allowed under this section. This ordinance is enacted pursuant to Government Code s~- Section 66411, Article I, Section 1 of the Butte County Charter, and Article X1 Section 7 of the California Constitution. Sectioa~ 4. Sever~bi~ity. If any provision of this Ordinance or the application thereof to and person or circumstances is for any reason held to be invalid by a court of competent jurisdiction such provision shall be deemed severable, and the invalidity thereof shall not affect the remaining provisions or other applications of the Ordinance which can be given effect withou the invalid provision or applicatian thereof. The Clerk of the Board of Supervisors is authorized and directed publish this ordinance before the expiration of fifteen (1 ~} days after its passage.
