Section 1. Sectior~ 1~--41.4 is add~d ~a the Butte Courity Code as '

a} Purpose. River Road between State H~ghway 32 and West
Sacramento Avenue is a narrow, ~wo ~an~, Coun~y ~oad wi~h di~t
shoulders . Durin.g certair~ times. ~specialY~r suinmer ho~iday
weekends, vehicl~~ are densely parked on both sides of ~he paved
road such ~ha~ ~here is no plaGe ~or pedes~rians to wa3.k a~~ ~he
pa~red road. Many of ~he pedestri,ans wa~.king on the pav~ed road
are carryzng i3n~lated flnating devices o~cu.pying even more ~pace
on the paved road. These cond~.tYOns create a lzazard to
pedes~rians due to the h~.gher veh~.c~e traf~ic using the paved
road, and they create a hazaxd ~or d~i.vers of vehic~es who must
s1.ow down, stop, or t~r ~o avo~d the p~destrians. It further
creates a sa~ety hazard by inhibiting the free aGCess af
err~ergency vehic7.~s . The pv.rpos~ of the parking prohibition

of River Road, the ~ast sid~, in order to allow p~d~st~iarss ta
walk along this sid~ o~ the road ~o avoid being expo~ed to
veh~cle traf~ic on the paved road, as wel~ as to al~ow passe~ger
and emerg~ncy vehicl~s to t~a~el more freely wi~hou~ obstr~ction
by p~d~st~ians on the paved road. Ca~ifornia V~hic~e Code
section ~2507 autho~i~es a ~ocal authority to prohibit or
res~riC~ the stopping, parking, or s~anding o~ vehicles on~
stree~s or highways.
b) Prohibition. Tt is unlawful to stop~ park, or 1e~ any
vehzcl~ stand on the eas~ side of R~ver Road between State'~'
Highway 32 and West Sacramento Avenue, except far a reasonable
area ~ox customer parking in tront o€ Scotty's Boa~ Landing as
posted.
C} Pos~~n~. The areas where s~appzng, parking, or stan.d~.ng of
vehic3.es zs pxohibited shall be marked acco~dingl.y with s~gns
giving notice o~ ~he r~strictions in acco~-dance with the
Cal.i~oxnia Manual o~' Uni~orm Traf~ic Contro~ Devices. The signs
sha].~. give nat~ce tha~ the ax~ea is a"Tow--away Zone" and tha~
tovs~ing charges sha~l be at the vehicle owne~s expense.
d) R~mova~.. Any veh~.c~e stopped, pa~ked, or 1e~t standa.ng in
viola~ior~. of this section may be removed by a.r~.y peace o~fiae~,
as def~.ned i.n Chap~er 4.5 (commencing with section S30) o~ Tit1e~
3 of Pa~t 2 0~ the Pena~. Code.

a) Purpose. State Highway 32 be~ween River Road a~d ~he'
Sacrament~o River is a two lane, high speed, S~a~e Highway. The
posted speed limit along State Hzghway 32 i~ 55 mph, and vehicle
traff~c along zt can be h~avy at times. During certain t~mes,
especza~~y summer ho~iday weekends, vehi~les are densely parked
on bo~h sides of the paved highway such that there is no place
~o~ pedestrians to walk off ~he paved highway. Many o~ th~
pedestrians wa~king on ~he paved hxghway are ca~ry~ng inflated
floating dev~ces occ~pyzng even mo~e space on the paved h~ghway.
Pedest~ians must also cross the bridge over the Sacramento Ri~er•
which has no sidewalks or safe area for waZk~ng. The~e
conditaons create a hazard to pedest~ia~s due ta ~he high
vehicle traffic using ~he paved highway, and they create a
haza~d for dxz~vers of vehicles who must s~.ow down, stop, ax ~ry
~a ava~.d the pedestrians. zt ~urther creates a sa~e~y hazard by
inhibiting the fr~e aceess of emergency veh~cles. The pu~pose
of the parking prohib~.tian es~ablish~d by this sect~.on is ~o
prohibit park~.ng an both sides ot State H~.ghway 32 in oxder ~o
a~.low pass~~ger and emergency vehicles to trave~, more ~reely
wi~hou~ abst.ruction by pedestrians on the pav~d highway.

3 b) Prohibition. Zt is un~aw~~l ~o s~op, let stand, or park
~ any vehicle on both sides af ~~a~e Highway 32 betwee~ River Road
5 and ~he Sacramen~o River.
6~) Pos~ing. fihe areas where stopping, stand~ng, v~ parking of
7 vehicles is proh~bi~ed shal~ be marked accardingly with signs
8 g~v~ng notice of the restrictions in accordanc~ wi~h the
9 Cal~~ornia Ma~ual o~ Unzform T~affic Control D~vic~s. The signs
10 sha1~ gzve notice that the ar~a is a"Tow~away ~a~e° and tha~l

12 d} Removal. Any vehicle s~opped, l~ft standing, o~ parked in
13 viola~ion o~ this section may b~ removed by any peace a~~icer~
1~ as de~ined in Chapt~r 4.5 (commencing w2~h sect~on 8347 0~ Title
15 3 of ~art 2 of the Pena~ Code.

~7 Sectzon 3. Severabi~zty. If any provision ~~ this Ordinance or
18 the app~icatxon thereof to any person vr ci~cums~ances is for
19 any reas~n held ~o b~ invalid by a cou~~ of co~peten~
20 ju~isdictzon, such provision shall be deemed severable, and ~he
2~ invalidity ~hereaf sha11 not affect the remain~ng provisions or
22 o~he~ appl~cations o~ the Ordi~a.nce which can b~ given ef~ect
23 withou~ ~he invalid provisYOn or app~ication ~hereof.
