An Ordinance Amending Sections 26-62 and 26-89 of Article Vl,
Enti#led "Regulations for Limited Density Owner-Built Rural Dwellings," of Chapter 26,
Entitled "Buildings," ofi the Butte County Code
The Board of Supervisors of the County of Butte ordains as follows:
Section 1. Section 26-62 is amended to read as follows:
Section 26-62. Intent and Application
(a) The provisions of this Article shall apply to the construction, enlargement,
conversion, alteration, repair, use, maintenance, and occupancy of Limited Density Owner-Built
Rural Dwellings and appurtenant structures. It is the intent of this Article that the requirements
contained herein shall apply to seasonally or permanently occupied dwellings, detached
bedrooms, and guest houses, located in rural areas and solely occupied as the principal
residence of the owner or the owner's family.
(b) Time Period Allowed For Construction of limited Density-Owner Built Rural
Dwellings. The provisions of this article shall be applicable and effective until December 31St
2015 at which time it shall terminate unless extended by subsequent ordinance.
Section 2. Section 26-89 is amended to read as follows:
Section 26-89. Fire Safety Regulations
A Limited Density Owner-Built Rural Dwelling permit application shall be reviewed by Cal Fire
Butte County for compliance with Public Resources Code sections 4290 and 4291, and Butte
County Cade.
All Limited Density Owner-Built Rural Dwellings shall comply with the "Materials and
Construction Methods For Exterior Wildfire Exposure" requirements found in the 2010 California
Residential Code, Section R327, or in the latest adopted version of the California Residential
Cade. Fire sprinklers shall be installed within all residential structures greater than one thousanc
two hundred fifty (1,250) square feet (Manufactured Homes are exempt from this requirement).

Residential fire sprinklers shall be connected to, and installed in accordance with, an automatic
residential fire sprinkler system that complies with Section R313 of the 2010 California
Residential Code or with NFPA 13D or current adopted Residential Code.
Section 3. Severability. If any provision of this Ordinance or the application thereof to any
person or circumstances is for any reason held to be invalid by a court of competent jurisdiction,
such provision shall be deemed severable, and the invalidity thereof shall not affect the
remaining provisions or other applications of the Ordinance which can be given effect without
the invalid provision or application thereof.
Section 4. Effective Date and Publication. This Ordinance shall take effect thirty (30} days after
the date of its passage. The Clerk of the Board of Supervisors is authorized and directed to
publish a summary of this ordinance before the expiration of fifteen (15) days after its passage.
This ordinance shall be published once, with the names of the members of the Board of
Supervisors voting far and against it, in the Enterprise Record, a newspaper of general
circulation published in the County of Butte, State of California.
PASSED AND ADOPTED by the Board of Supervisors of the County of Butte, State of
California, on the 24th day of April, 2012 by the following vote:
AYES: Supervisors Wahl, Kirk, Yamaguchi and Chair Lambert
