An Ordinance Amending Chapter 4 -Animals of the Butte County Code
The Board of Supervisors of the County of Butte ordains as follows:
Section I. Purpose. This proposed ordinance amends Chapter 4, .Animals to omit specific
fee references. Fees are adopted by resolution of the Board of Supervisors as part of the Butte
County Master Fee Schedule.
Section 2. Butte County Code Section 4-31, regarding Wild or Exotic Animals, is
amended to read as follows:

(a) The application for a permit shall contain. the name of the applicant, his address,
the address of the proposed location of the animal if different from applicant's a~
a brief description of the applicant's plan for keeping the animal which shall
include the species of animal, the number of individuals of each species and a
description of the housing facilities for the animal. Permit fees are adopted by
Resolution of the Board of Supervisors as part of the Butte County Master Fee
Schedule.
(b) The permit shall be valid for a period of one (1) year from the date of its issuance
unless revoked or suspended. The permit shall cover either one (1) animal or a
collection, and the maximum number of specimens permitted to be kept shall be
specified in the permit. Whenever a new animal or collection is added so as to
exceed the maximum number permitted, a new permit must be secured and a new
fee must be paid, to the exceptions in subsection {c) of this section. The fee shall
be due and payable at the time of issuance of the permit and shall be a prerequisite
of such issuance.
c} Whenever, in any given permit year, there are new animals in a collection due to
the reproduction of members of the collection or due to trade, exchange or
replacement in the same number and of the same zoological order as the members
of the collection traded, exchanged or replaced, the new animals do not require an
additional permit during that year, provided the animal control officer is notified
in writing of the new animals within thirty (3a) days of acquisition.
Section 3. Butte County Code Section 4-45, Dangerous Animals, is amended to read as
follows:
4-45 -Application procedure.
An application for a dangerous animal permit shall be submitted in writing to the public
health director. The application shall be accompanied by a fee, as adopted by Resolution
of the Board of Supervisors as part of the Butte County Master Fee Schedule, and shall
contain the narr~e of the applicant, the applicant's address, the applicant's home and
business phone numbers, the address and description of the proposed location where the
animal will be kept, and a complete description and a color photograph of the animal.

Section 4. Authority, This ordinance is enacted pursuant to Government Code Sections
66017{a) and 66016{b}, Article I, Section 1 of the Butte County Charter, and Article XI Section
7 of the California Constitution,
Section 5. Severability. If any provision of this Ordinance or the application thereof to any
person or circumstances is for any reason held to be invalid by a court of competent jurisdiction,
such provision shall be deemed severable, and the invalidity thereof shall not affect the
remaining provisions or other applications of the Ordinance which can be given effect without
the invalid provision or application thereof.

Section 6. Effective Date and Publication. This Ordinance shall take effect thirty {30) day;
after the date of its passage. The Clerk of the Board of Supervisors is authorized anal directed to
publish this ordinance before the expiration of fifteen {15) days after its passage. This Ordinancf
shall be published once with the names of the m tubers of the Board of Supervisors voting for
and against it, in the ~ ~ , a newspaper of general circulation
published in the County of Butte, State of California.

California, on the 25th day of September, 2012, by the following vote:
