HomeMy WebLinkAbout40601 Ordinance No. 4060 2 I ~ BUTTE COUNTY ELECTRONIC FILING CAMPAIGN DISCLOSURE ORDINANCE 3 The Board of Supervisors of the County of Butte ordains as follows: 4 Section 1. Article I of Chapter 52 is added to the Butte County Code as follows: 5 "ARTICLE I 6 CHAPTER 52 ELECTRONIC FILING CAMPAIGN DISCLOSURE ORDINANCE 7 Section 52-1. Findings. The Board of Supervisors finds that public access to campaign & disclosure information is a vital and integral component of a fully informed electorate. 9 Transparency in campaign financing is critical in order to maintain public trust and support of io the political process. The online electronic filing system shall operate securely and effectively 11 and will not unduly burden filers. 12 Section 52-2. Purpose. The purpose of this Ordinance is to require online electronic filing b} 13 any elected officer, candidate, committee, or other person required to f le specified statements 14 reports, or other documents with the Butte County elections official as required by Chapter 4 0 15 the Political Reform Act in order to facilitate review and maximize the availability of Chi f 6 information to the public. 17 Section 52-3. Authority. This Ordinance is adopted pursuant to California Government Lo. t8 section 84615 which authorizes local agencies to utilize an online electronic filing system. 19 Section 52-4. Electronic Filing of Campaign Disclosure. Any elected officer, candida~ 20 committee, or other person required to file specified statements, reports, or other documents wi 21 the Butte County elections official as required by Chapter 4 of the Political Reform Act sh 22 electronically file all such statements, reports or documents according to procedures establish 23 by the Butte County elections official. However, in any case in which any person is required 24 file {a) an original statement, report or other document with the Secretary of State and (b) a co 25 of such statement, report, or other document with the Butte County elections official, the pers 2b ~ ~ may electronically file a copy with the Butte County elections official according to procedu 27 2$ 1 1 I 2 3 4 5 6 7 8 9 10 11 12 13 14 IS 16 17 18 19 20 21 z2 23 24 25 26 27 28 established by the Butte County elections official. Electronic filing is not required under the circumstances. The data shall be made available free of charge and available on the Internet. Section 52-5. Severability. If any provision of this Chapter or the application thereof to a person or circumstance is held invalid, the remainder of this Chapter, including the application such party or provision to other circumstances shall not be affected thereby and shall continue full force and effect. To this end, provisions of this Chapter are severable. The Board Supervisors hereby declares that it would have passed each section, subsection, subdivisi~ paragraph, sentence, clause, or phrase hereof irrespective of the fact that any one {i) or m+ sections, subsections, subdivisions, paragraphs, sentences, clauses or phrases are h unconstitutional, invalid or unenforceable." Section 2. The Clerk of the Board will publish the Ordinance codified in this Chapter as requi by law. The Ordinance codif ed in this Chapter shall take effect thirty {30) days after passage.
