HomeMy WebLinkAbout4112 1 Ordinance No. 4112 2 AN ORDINANCE OF THE COUNTY OF BUTTE 3 REPEALING CHAPTER 51 OF THE BUTTE COUNTY CODE 4 ENTITLED "BUTTE COUNTY CONTRACTS/PROCUREMENT SUNSET PILOT 5 PROJECT" AND REPLACING IT WITH A NEW CHAPTER 51 ENTITLED 6 "TEMPORARY RETENTION OF THE PURCHASING POLICY MANUAL DURING 7 TRANSITION TO NEW POLICIES AND PROCEDURES" 8 9 1 Chapter 51 Temporary Retention of the Purchasing Policy Manual during Transition to 11 New Policies and Procedures 12 The Board of Supervisors of the County of Butte ordains as follows: 13 Section 1. 14 Article I. General Provisions 15 51-1 Authority and Title. 16 Pursuant to the authority granted in Article XI, section 7 of the California Constitution, the 17 Board of Supervisors does enact this Ordinance, which shall be known and may be cited as the 18 "Butte County Temporary Retention of the Purchasing Policy Manual during Transition to New 19 Policies and Procedures Ordinance". 20 21 51-2 Purpose 22 Upon the Board of Supervisors approval of the Center-Led Contracting/Procurement 23 Policies and Procedures, along with the new Chapter 46 of the Butte County Code, departments 24 that have been trained and certified will be governed by the new Chapter 46 and Center-Led 25 Contracting/Procurement Policies and Procedures. The purpose of the Butte County Temporary 26 Retention of the Purchasing Policy Manual during Transition to New Policies and Procedures 27 Ordinance is to allow departments to operate under the old Purchasing Policy Manual until 28 1 1 trained and certified under the new Center-Led Contracting I Procurement Policies and 2 Procedures. Untrained/uncertified departments will be governed by this Chapter 51 sunset 3 ordinance and follow the Purchasing Policy Manual—May, 2008 (Rev. 5-08)until trained and 4 certified in the Center-Led Contracting/Procurement Policies and Procedures, at which time 5 they will be governed by Chapter 46 and the Center-Led Contracting/Procurement Policies and 6 Procedures. 7 51-3 Application of Chapter. 8 9 Application of this chapter shall be limited to applicable contracting and procurement 10 transactions completed by departments that have not been trained and certified under the new 11 Center-Led Contracting/Procurement Policies and Procedures Manual. 12 Article H. Provisions of Temporary Retention of the Purchasing Policy Manual 13 51-4 Temporary Retention. 14 Purchasing transactions for departments not trained and certified in the Center-Led 15 Contracting/Procurement Policies and Procedures will retain the rights and responsibilities 16 defined in the old Purchasing Policy Manual. 17 51-5 Transition to new Policies and Procedures. 18 Once a department becomes trained and certified in the Center-Led Contracting / 19 Procurement Policies and Procedures, they shall no longer act under this ordinance. 20 21 Article III. Sunset of Temporary Retention of the Purchasing Policy Manual 22 51-6 Sunset of Temporary Retention of the Purchasing Policy Manual Ordinance 23 Upon completing training and certification of all County Departments in the new Center-Led 24 Contracting/Procurement Policies and Procedures,this ordinance shall sunset and terminate. 25 Section 2. 26 Severability. If any provision of this Chapter or the application thereof to any person or 27 circumstance is for any reason held to be invalid by a court of competent jurisdiction, such 28 I provision shall be deemed severable, and the invalidity thereof shall not affect the remaining 2 provision or other application of the Chapter which can be given effect without the invalid 3 provisions or application thereof. 4 Section 3. 5 Effective Date and Publication. This Ordinance shall take effect thirty (30) days after th- 6 date of its passage. The Clerk of the Board of Supervisors is authorized and directed to publisl 7 this Ordinance before the expiration of fifteen (15) days after its passage.
