2 AN ORDINANCE AMENDING CHAPTER 21,
3 SECTIONS 21-1 .3 THROUGH 21-1 . 4,
4 ENTITLED "TAXATION, " OF THE BUTTE COUNTY CODE
5 The Board of Supervisors of the County of Butte ordains as
6 follows :
7 Section 1. Section 21-1 . 3 of the Butte County Code is hereby
8 amended to read as follows :
9 21-1 . 3 - This ordinance implements in Butte County the
10 provisions of Revenue and Taxation Code section 95 . 3 (Amended by
11 Stats. 1996, Sec. 2 . Effective September 30, 1996) which
12 provide for the recovery by counties of property tax
13 administrative costs .
14 Section 2 . Section 21-1 .3.2 of the Butte County Code is
15 hereby amended to read as follows :
16 21-1 . 3 . 2 - "Local jurisdiction" means the County of Butte and
17 every redevelopment agency or successor agency, special
18 district, or other governmental entity, excepting incorporated
19 cities, for or on behalf of which Butte County provides property
20 tax assessment or collection services .
21 Section 3 . Section 21-1 .3 .3 of the Butte County Code is
22 hereby deleted.
23 Section 4 . Section 21-1.3 . 4 of the Butte County Code is
24 hereby deleted.
25 Section 5 . Section 21-1 .3 .5 of the Butte County Code is
26 hereby deleted.
27 Section 6. Section 21-1 .3. 6 of the Butte County Code is
28 hereby amended to read as follows :
1 21-1 . 3 . 6 - (a) The auditor-controller shall adjust each city' s,
2 local jurisdictions, and the county' s property tax allocation by
3 the amount determined in accordance with the requirements of
4 section 95 . 3 of the Revenue and Taxation Code.
5 Section 7 . Severability. If any provision of this ordinance
6 or the application thereof to any person or circumstances is for
7 any reason held to be invalid by a court of competent
8 jurisdiction, such provision shall be deemed severable and the
9 invalidity thereof shall not affect the remaining provisions or
10 other applications of the ordinance which can be given effect
11 without the invalid provision or application thereof.
12 Section S . Effective Date and Publication. This ordinance
13 shall take effect 30 days after the date of its passage. The
14 Clerk of the Board of Supervisors is authorized and directed to
15 publish this ordinance before the expiration of 15 days after
16 its passage. This ordinance shall be published once, with the
17 names of the members of the Board of Supervisors voting for and
18 against it, in the Chico Enterprise-Record, a newspaper of
19 general circulation published in the County of Butte, State of
20 California.
21 PASSED AND ADOPTED by the Board of Supervisors of the County of
22 Butte, State of California, on the 14th day of June, 2016, by the
23 following vote:
24 AYES : Supervisors Wahl, Kirk, Lambert, Teeter and Chair Connelly
25 NOES : None
26 ABSENT: None
27 NOT VOTING: None
