HomeMy WebLinkAbout4121 1 2 Ordinance No. 4121 3 4 AN ORDINANCE AMENDING BUTTE COUNTY CODE CHAPTER 26, ENTITLED "BUILDINGS," TO ADOPT THE "2016 CALIFORNIA 5 BUILDING STANDARDS CODE" AND ADDITIONAL AMENDMENTS FOR "FLOOD HAZARD PREVENTION" 6 7 The Board of Supervisors of the County of Butte ordains as follows: 8 Section 1. Intent. 9 It is the intent of the Board of Supervisors, in adopting this Ordinance, to provide 10 minimum standards for the regulation of building construction and to protect the public safety, 11 health,property and welfare in the County of Butte by adopting the 2016 edition of the 12 California Building Standards Code, Title 24 of the California Code of Regulations, Parts 1, 2, 13 2.5, 3, 4, 5, 6, 8, 9, 10, 11, and 12 by reference without further publication, subject to the 14 definitions, clarifications, deletions, and amendments set forth in this Ordinance. It is also the 15 intent of the Board to adopt amendments relating to state legislation (SB-5, 2007) regarding 16 flood hazard prevention. 17 In adopting this Ordinance, Butte County is complying with state law which will become 18 effective January 1, 2017, as well as making amendments to accommodate existing local 19 administrative procedures that do not conflict with state law. 20 Conflicts with other laws, rules, etc: In the event a conflict between this Code and any 21 law, rule or regulation of the Federal or State Government occurs, the requirement which 22 establishes the higher standard of safety shall govern. Failure to comply with such standard of 23 safety shall be a violation of this Code. The Authority having jurisdiction shall determine the 24 establishment of the higher standard of safety and interpretation of such standard. Page 1 of 18 1 Section 2. Section 26-1 of the Butte County Code is amended to read as follows: 2 "26-1 California Building Standards Code, Title 24 of the California Code of Regulations, 3 Parts 1,2, 2.5, 3, 4, 5, 6, 8, 9, 10, 11, and 12 Adopted by Reference. 4 In order to protect the public safety, health, property, and welfare in the County of Butte, and to 5 provide minimum standards for the proper regulation of building construction, the following 6 parts of the 2016 edition of the California Building Standards Code, Title 24 of the California 7 Code of Regulations, are hereby adopted, incorporated, and made part of this chapter by 8 reference without further publication: 9 Part 1 California Administrative Code including the Appendices thereof. 10 Part 2 California Building Code Volumes 1 and 2 including Appendix Chapters 11 C, I, 1, and K. 12 Part 2.5 California Residential Code including Appendix Chapters H, 1, and Q. 13 Part 3 California Electrical Code including the Informative Annex Chapters A, 14 B, C, D, F, G, and I. 15 Part 4 California Mechanical Code including Appendix Chapters B, C, and D. 16 Part 5 California Plumbing Code including Appendix Chapters A, B, D, G, I, and 17 J. 18 Part 6 California Energy Code including the Appendix Chapter. 19 Part 8 California Historical Code including the Appendix Chapters. 20 Part 9 California Fire Code including Appendix Chapters 4, B, BB, C, CC, D 21 only Section 103.6, G, and I. 22 Part 10 California Existing Building Code including the Appendix Chapters. 23 Part 11 California Green Building Standards Code. 24 Part 12 California Referenced Standards Code. Page 2 of 15 1 1997 Uniform Housing Code, Chapter 10. 2 1997 Uniform Code for the Abatement of Dangerous Buildings. 3 The 2016 California Building Standards Code parts and appendices listed above are 4 hereby declared to be the building code for Butte County and shall apply to and govern all 5 building construction in the unincorporated areas of the county as hereinafter provided subject to 6 the definitions, clarifications, deletions, and amendments set forth herein." 7 Section 3. Section 26-2 of the Butte County Code is amended to read as follows: 8 "26-2 Definitions. 9 The 2016 California Building Standards Code as adopted by Section 26-1 is amended to 10 read as follows: 11 Whenever any of the following names or terms are used in the California Building 12 Standards Code, such name or term shall have the meaning ascribed by this section as follows: 13 Building Official: The Building Division Manager of Butte County or his/her designated 14 representative. 15 Limited Agricultural Building: A building meeting the definition of"Agricultural 16 Building" in Part 2, California Building Code, Volume 1, Section 202 and also found on the list 17 set forth in Part 2, California Building Code, Volume 2, Appendix C, C101.1." 18 Section 4. Section 26-3 of the Butte County Code is amended to read as follows: 19 "26-3 Board of Appeals. 20 The 2016 California Building Standards Code as adopted by Section 26-1 is amended to 21 read as follows: 22 Section 113 of Chapter 1, Division II, of the 2016 California Building Code; Chapter 1, 23 Division II, Section R112 of the 2016 California Residential Code; Chapter 1, Division II, 24 Section 107.0 of the 2016 California Mechanical Code; Section 89.108.8 of California Article Page 3of18 1 89, General Code Provisions, of the 2016 California Electrical Code; and Division II, Section 2 107.0 of the 2016 California Plumbing Code are deleted. The local appeals board of the county 3 which was established by Resolution# 13-144 by the county board of supervisors shall hear any 4 and all appeals regarding the application and enforcement of this chapter. The decision of the 5 Board of Appeals is final and not appealable except to the courts, and the Board of Appeals shall 6 have no authority to waive the technical requirements of this code." 7 Section 5. Section 26-3.1 of the Butte County Code is amended to read as follows: 8 "26-3.1 Amendments, additions and deletions. 9 The 2016 California Building Standards Code as adopted by Section 26-1 is amended to 10 read as follows: 11 (a) California Building Code: The following sections of the 2016 California Building Code, 12 Chapter 1, Division II, are amended to read as follows: 13 Section 101.4.4 "Property Maintenance" is amended to read as follows: The provisions 14 of the 1997 Uniform Housing Code and 1997 Uniform Code for the Abatement of Dangerous 15 Buildings shall apply to existing structures and premises; equipment and facilities; light, 16 ventilation, space heating, sanitation, life and fire safety hazards; responsibilities of owners, 17 operators and occupants; and occupancy of existing premises and structures. 18 Section 103 "Department of Building Safety" is deleted in its entirety. 19 Section 105.3.2 "Time limitation of application" is amended to read as follows: An 20 application for a permit for any proposed work shall expire one (1) year after the date of filing, 21 unless the permit has been issued. 22 Section 105.5 "Expiration" is amended to read as follows: Every permit issued by the 23 building official under the provisions of this code shall expire by limitation and become null and 24 void after one (1) year from the date of issuance of such permit. Provided, however, that if the Page 4 of 1 S 1 building or work authorized by such permit was commenced prior to such expiration and no 2 changes have been made or will be made in the original plans and specifications for such 3 building or work, a renewal permit may be applied for within 30 days of the original permit 4 expiration date. If application for a renewal permit has not been made within said 30 days, or if 5 work was not commenced pursuant to the original permit, a new permit application and fees will 6 be required. A renewed permit shall expire and become null and void one (1) year from the 7 expiration date of the original or previously renewed permit. Any mechanical, electrical, or 8 plumbing permit issued in conjunction with a building permit shall remain active as long as the 9 building permit is active. 10 Section 105.8 "Transferability" is added to read as follows: A permit may be transferred 11 from the original permittee to another person due to a change of ownership or contractor or 12 death. 13 Section 111.1 "Use and Occupancy" is amended to read as follows: No building or 14 structure shall be used or occupied, and no change in the existing occupancy classification of a 15 building or structure or portion thereof shall be made until the building official has issued a 16 certificate of occupancy therefor as provided herein. Issuance of a certificate of occupancy shall 17 not be construed as an approval of a violation of the provisions of this code or of other 18 ordinances. Provided, however, that no certificate of occupancy is required for Group R, 19 Division 3, and Group U Occupancies. 20 Section 112.3 "Authority to disconnect service utilities" is amended to read as follows: 21 The building official shall have the authority to authorize disconnection of utility service to the 22 building, structure or system regulated by this code and the codes referenced in case of an 23 emergency, where necessary to eliminate an immediate hazard to life or property. The building 24 official shall have the authority to authorize disconnection of utility service to the building, Page 5 of 1; 1 structure or system regulated by this code and the codes referenced when any building service 2 equipment is maintained in violation of Section 105 of Chapter 1, Division II, of the 2016 3 California Building Code, or of the codes adopted in Section 26-1, or in violation of a notice 4 issued pursuant to the provisions of Section 114 of Chapter 1, Division II, of the 2016 California 5 Building Code. The building official shall notify the serving utility, and whenever possible the 6 owner and occupant of the building, structure or service system, of the decision to disconnect 7 prior to taking such action. If not notified prior to disconnecting, the owner or occupant of the 8 building, structure or service system shall be notified in writing, as soon as practical thereafter. 9 California Building Code: The following sections of the 2016 California Building 10 Code, Appendix J, are amended to read as follows: 11 Appendix J, Section J101.1 "Scope" is amended to read as follows: The provisions of 12 this chapter apply to grading, excavation and earthwork construction, including fills and 13 embankments necessary for the support of foundations that are supporting the structures 14 constructed by these building codes. All other grading on the property that is not associated with 15 a structure and its associated permits is subject to Butte County Code Chapter 13, Article I, 16 Grading. Where conflicts occur between the technical requirements of this chapter and the 17 geotechnical report, the geotechnical report shall govern. 18 Appendix J, Section J101.2 "Flood Hazard Areas" is amended to read as follows: The 19 provisions of this chapter shall not apply to grading, excavation and earthwork construction, 20 including fills and embankments, in floodways within flood hazard areas where design flood 21 elevations are specified. All grading in flood hazard areas shall be performed in accordance with 22 the Butte County Flood Ordinance, Federal Emergency Management Agency (FEMA) 23 guidelines and any other regulations of the county pertaining to grading operations. 24 (b) California Electrical Code: The following subsection of the 2016 California Electrical Page 6 of 16 1 Code is added to read as follows: 2 Subsection (b)(5) is added to Section 89.108.4.1 Permits. of California Article 89, 3 General Code Provisions, of the 2016 California Electrical Code to read as follows: 4 (b)(5) No permits shall be required for the installation, alteration or repair of 5 agricultural water pumps used solely for agricultural purposes. 6 (c) California Mechanical Code: The following subsection of the 2016 California 7 Mechanical Code is added to read as follows: 8 Subsection 104.2 (6) of Chapter 1, Division II, Administration, of the 2016 California 9 Mechanical Code is added to read as follows: 10 (6)No permits shall be required for the installation, alteration or repair of agricultural 11 water pumps used solely for agricultural purposes. 12 (d) California Plumbing Code: The following subsection of the 2016 California Plumbing 13 Code is added to read as follows: 14 Subsection 104.2 (3) of Chapter 1, Division II, Administration, of the 2016 California 15 Plumbing Code is added to read as follows: 16 (3)No permits shall be required for the installation, alteration or repair of agricultural 17 water pumps used solely for agricultural purposes. 18 (e) The following provision shall apply to permits under the 2016 California Residential Code, 19 2016 California Electrical Code, 2016 California Mechanical Code, 2016 California Plumbing 20 Code and 2016 California Fire Code: 21 The rules concerning time limitation of application, expiration,transferability, and use 22 and occupancy shall be as specified in subsection (a) above in the amendments to Chapter 1, 23 Division II, of the 2016 California Building Code, Sections: 105.3.2, 105.5, 105.8, and 111.1, 24 respectively." Page 7 of? 1 Section 6. Section 26-21 of the Butte County Code is amended to read as follows: 2 "26-21 - Official maps. 3 (a) The Butte County Board of Supervisors hereby adopts the flood insurance study ("FIS") 4 produced by the Federal Insurance Administration ("FIA") of the Federal Emergency 5 Management Agency ("FEMA"), and accompanying flood insurance rate maps ("FIRM") and 6 flood boundary and floodway maps ("FBFM") with map index dated January 6, 2011, and all 7 subsequent amendments and revisions, as the official maps to be used in determining those 8 areas of special flood hazard. The FIS and attendant mapping present the minimum area of 9 applicability of this article, which area may be supplemented by ordinance adopted by the 10 Board of Supervisors based on studies and on recommendations from the Floodplain 11 Administrator. The FISs, FIRMs, and FBFMs are on file with the Butte County Department of 12 Public Works at 7 County Center Drive, Oroville, California. 13 (b) The Butte County Board of Supervisors hereby adopts the United States Army Corps of 14 Engineers Comprehensive Study 2002 map and the California Department of Water Resources 15 Urban Level of Flood Protection Chico Study Area 2013 map, and all subsequent amendments 16 and revisions, as the best available maps of the 200-year floodplain and incorporates them into 17 the official 200-year floodplain maps. The official 200-year floodplain maps will reflect the 18 boundaries of the Urban FIood Protection—FP Overlay Zone established on the Zoning Map and 19 in Section 24.47.1 of the Zoning Ordinance. The official 200-year floodplain maps will be 20 reflected on 200-year flood mapping information shown in Figure HS-2 of the General Plan's 21 Health and Safety Element." 22 Section 7. Section 26-22 of the Butte County Code is amended to read as follows: 23 "26-22 - Permits. 24 (a) Additional requirements in flood hazard zones and the 200-year floodplain. Within Page 8 of 18 1 flood hazard Zones A, AE, AH and AO, on the official maps there are additional requirements 2 in conjunction with the issuance of development permits for new construction, substantial 3 improvements and other developments, including the placement of manufactured homes and 4 pre-fabricated buildings, as set forth in this article and subsection (b) below. Within the 200- 5 year floodplain shown on the official 200-year floodplain maps, additional requirements apply to 6 County approval of any new development or use involving development agreements, 7 discretionary building permits or entitlements, ministerial permits for construction of a new 8 residence, or tentative subdivision or parcel maps for a project, as set forth in this article and 9 subsection(c) below. These permits cannot be issued until specific findings are made and 10 approved by the floodplain administrator, as set forth in Section 26-24 (c). 11 (b) Application. To obtain a development permit in said zones, the applicant shall first file 12 an application therefore in writing on a county form furnished for that purpose by the 13 department of Development Services and approved by the director of Development Services. 14 Every such application shall: 15 (I) Identify and describe the work to be covered by the permit for which application is 16 made; 17 (2) Describe the land on which the proposed work is to be done by lot, block, tract 18 and house and street address, or similar description that will readily identify and 19 definitely locate the proposed building or work; 20 (3) Indicate the use or occupancy for which the proposed work is intended; 21 (4) Be accompanied by plans and specifications for the proposed development 22 drawn to scale, and showing the dimensions and elevation of the site on which the 23 proposed work is to be done, existing and/or proposed structures, fill, storage of 24 materials and drainage facilities; Page 9 of 16 I (5) Be signed by the permittee or his authorized agent who may be required to submit 2 evidence to indicate such authority; 3 (6) Be accompanied by: 4 a. The proposed National Geodetic Vertical Datum ("NGVD") elevation of the 5 lowest floor of all structures or, in the case of any nonresidential structure which 6 will be floodproofed, the proposed NGVD elevation to which it will be 7 floodproofed; or 8 b. In AO zones, the minimum vertical distance above the highest adjacent 9 grade for the lowest floor; 10 (7) Be accompanied by all appropriate certifications required for lowest floor 11 elevations for all structures, floodproofing of nonresidential structures, wet 12 floodproofing and floodway encroachments; 13 (8) Give such other information as reasonably may be required by the county. 14 (c) Application. To obtain a development permit in a 200-year floodplain, the applicant shall 15 first file an application therefore in writing on a county form furnished for that purpose by the 16 Department of Development Services and approved by the Director of Development Services. 17 Every such application shall: 18 (1) Identify and describe the work to be covered by the permit for which application is 19 made; 20 (2) Describe the land on which the proposed work is to be done by lot, block, tract and 21 house and street address, or similar description that will readily identify and definitely 22 locate the proposed building or work; 23 (3) Indicate the use or occupancy for which the proposed work is intended; 24 (4) Be accompanied by plans and specifications for the proposed development drawn Page 10 of 1: 1 to scale, and showing the dimensions and elevation of the site on which the proposed 2 work is to be done, existing and/or proposed structures, fill, storage of materials and 3 drainage facilities; 4 (5) Be signed by the permittee or his authorized agent who may be required to submit 5 evidence to indicate such authority; 6 (6) Be accompanied by: 7 a. The proposed National Geodetic Vertical Datum ("NGVD") elevation of the 8 lowest floor of all structures or, in the case of any nonresidential structure which 9 will be flood proofed, the proposed NGVD elevation to which it will be flood 10 proofed; or 11 b. The minimum vertical distance above the highest adjacent grade for the lowest 12 floor; and; 13 c. Documentation of a study indicating whether the flood depths that would occur 14 in a 200-year flood event would be equal to or greater than 3 feet in depth 15 compared to the proposed NGVD elevation, if flood-depth information is not 16 available from the County for the project location. Any study provided must be 17 consistent with Department of Water Resources modeling assumptions. 18 (7) Give such other information as reasonably may be required by the county." 19 Section 8. Section 26-24 of the Butte County Code is amended to read as follows: 20 "26-24 - Same—Criteria for evaluation. 21 (a) The county, in reviewing all applications for new construction, substantial 22 improvements, prefabricated buildings, placement of manufactured homes and other 23 development(s) (as defined in section 26-29 of this article), and when reviewing the work 24 being performed, will: Page 11 of 1: 1 (1) Obtain, review, and reasonably utilize, if available, any regulatory flood elevation 2 and floodway data from federal, state or other sources, until such other data is provided 3 by the Federal Insurance Administration in a flood insurance study; 4 (2) Require the use of construction materials and utility equipment that are resistant to 5 flood damage; 6 (3) Require the use of construction methods and practices that will minimize flood 7 damage; 8 (4) Require buildings, manufactured homes and pre-fabricated buildings to be designed 9 or anchored to prevent the flotation, collapse or lateral movement of the structure or 10 portions of the structure due to flooding; 11 (5) Assure electrical, heating, ventilation, plumbing and air conditioning equipment 12 and other service facilities shall be designed and/or located so as to prevent water from 13 entering or accumulating within the components during conditions of flooding; 14 (6) Assure encroachments, including fill, new construction, substantial improvements 15 and other development, shall be prohibited in any floodway unless approval is provided 16 by the Central Valley Flood Protection Board and written documentation by a 17 registered professional engineer demonstrates that the encroachments will not result in 18 any increase in flood levels during the occurrence of the base flood discharge. Such 19 written documentation shall be provided to the floodplain administrator or designee; 20 (7) Require, for all new construction and substantial improvements, that fully enclosed 21 areas below the lowest floor that are subject to flooding shall be designed to 22 automatically equalize hydrostatic flood forces on exterior walls by allowing for the 23 entry and exit of floodwaters. Openings in foundation walls shall comply with the 24 requirements set forth in current FEMA Technical Bulletins and shall be certified by a Page 12 of 16 1 registered professional engineer or architect. Such certification shall be provided to the 2 Director of Development Services or designee; and 3 (8) Require the completion and submittal of an Elevation Certificate, FEMA Form 81- 4 31 or a more current comparable FEMA approved form, at three (3) stages in the 5 process, as set forth in the Building Elevation Information (Survey Required) section of 6 the form: a Construction Drawings Certificate to be submitted prior to the issuance of 7 the building permit; a Building Under Construction Certificate to be submitted prior to 8 the approval of framing inspections; and a Finished Construction Certificate to be 9 submitted prior to the final inspection of the building permit. Such certification shall be 10 provided to the Director of Development Services or designee. The following exception 11 to this requirement applies to manufactured homes and pre-fabricated buildings: the 12 Building Under Construction Certificate shall not be required. 13 (b) The county, in addition to the requirements in subsection (a) of this section, will: 14 (1) Require, within areas designated as Zones AE and AH on the official map, that the 15 following standards are met: 16 a. The lowest floor elevation of new residential structures and substantial 17 improvements to residential structures shall be elevated a minimum of one (1) 18 foot or more above the BFE. 19 b. The lowest floor elevation of new or substantially improved nonresidential 20 structures shall either meet section 26-24(b)(1)(a); or, such nonresidential 21 structures, together with attendant utility and sanitary facilities, shall: 22 1. Be floodproofed so that below the BFE the structure is watertight 23 with walls substantially impermeable to the passage of water, 24 2. Have structural components capable of resisting hydrostatic and Page 13 of 1: 1 hydrodynamic loads and effects of buoyancy, and 2 3. Be certified by a registered professional engineer or architect that 3 the design and methods of construction are in accordance with 4 accepted standards of practice for meeting the provisions of this 5 subsection. Such certification shall be provided to the Director of 6 Development Services or designee; 7 (2) Require within any area designated as Zone AO on the official map, that the 8 following standards are met: 9 a. The lowest floor elevation of new and substantially improved residential 10 structures shall be elevated above the highest adjacent grade at least one (1) foot 11 higher than the depth number specified in feet on the official map {at least three 12 (3) feet if no depth number is specified). 13 b. The lowest floor elevation of new or substantially improved nonresidential 14 structures shall either meet section 26-24(b)(2)(a) or such nonresidential 15 structures, together with attendant utility and sanitary facilities, shall: 16 1. Be floodproofed below the elevation as specified under section 26- 17 24(b)(2)(a) so that the structure is watertight with walls substantially 18 impermeable to the passage of water, 19 2. Have structural components capable of resisting hydrostatic and 20 hydrodynamic loads and effects of buoyancy, and 21 3. Be certified by a registered professional engineer or architect that the 22 design and methods of construction are in accordance with accepted 23 standards of practice for meeting the provisions of this subsection. Such 24 certification shall be provided to the Director of Development Services Page 14 of 18 1 or designee; 2 (3) In an A Zone, without BFE's specified on the FIRM (unnumbered A Zone), all 3 structures, residential and nonresidential, shall be elevated at least one (1) foot above 4 the BFE as determined by methods comparable to those in a Flood Insurance Study or 5 by using the detailed methods as described in the most current edition of FEMA 6 publication, FEMA 265, "Managing Floodplain Development in Approximate Zone A 7 Areas—A Guide for Obtaining and Developing Base (100-year) Flood Elevations" or 8 any successor FEMA document. 9 (4) Assure that in regard to manufactured homes that the following standards are met: 10 a. Areas designated Zone AO: 11 1. All manufactured homes that are placed or substantially improved 12 shall be elevated on a permanent foundation system such that the lowest 13 floor is elevated above the highest adjacent grade at least one (1) foot or 14 more than the depth number specified in feet on the official map (at least 15 three (3) feet if no depth number is specified), 16 2. All manufactured homes that are placed or substantially improved 17 shall be anchored to resist flotation, collapse or lateral movement, and 18 installed in accordance with the requirements set forth in the current 19 FEMA Publication entitled "Manufactured Home Installation in Flood 20 Hazard Areas." 21 b. Areas designated Zones A, AE and AH: 22 1. Require that all manufactured homes to be placed or substantially 23 improved be elevated on a permanent foundation system such that the 24 lowest floor of the manufactured home is elevated one (1) foot or more Page 15 of 1: 1 above the regulatory flood elevation, and shall meet the provisions of 2 subsection (b)(3)(a)(2) of this section; 3 (5) Require, within Zones AH and AO, adequate drainage paths around structures on 4 slopes, to guide floodwaters around and away from proposed structures. 5 (c) In addition to the requirements in subsection(a) and subsection (b) above, the County 6 will: 7 (1) Require, in urban or urbanizing areas within the areas identified by the Official 200- 8 year floodplain maps determined to have a potential flood depth of 3 feet or greater, that 9 a finding be made. The four potential findings are: 10 a. The project has an Urban Level of Flood Protection from flood 11 management facilities that is not reflected in the most recent map of the 200-year 12 floodplain; 13 b. Conditions imposed on the project will provide for an Urban Level of 14 Flood Protection; 15 c. Adequate progress has been made toward construction of a flood 16 protection system to provide an Urban Level of Flood Protection for the project, 17 as indicated by the Central Valley Flood Protection Board for state projects, or by 18 the floodplain administrator for local projects; or 19 d. The project is a site improvement that would not result in the development 20 of a habitable or non-habitable structure and would not increase risk of damage to 21 neighboring development or alter the conveyance area of a watercourse in the 22 case of a flood. 23 Findings shall be based on substantial evidence. Substantial evidence necessary to 24 determine findings shall be consistent with criteria developed by the Department of Water Page 16of18 1 Resources. These criteria are detailed in the report Urban Level of Flood Protection Criteria 2 published in November 2013, but may be updated in the future. County staff should refer to the 3 department's website for the latest information/criteria. 4 (d) The Director of Development Services or designee shall, upon completion of building 5 construction, certify to the floodplain administrator, compliance with the provisions of this 6 section. 7 (e) The floodplain administrator shall complete a biennial report and submit it to the 8 Federal Emergency Management Agency." 9 Section 9. Severability. 10 If any provision of this Ordinance or the application thereof to any person or 11 circumstances is for any reason held to be invalid by a court of competent jurisdiction, such 12 provision shall be deemed severable, and the invalidity thereof shall not affect the remaining 13 provisions or other applications of the Ordinance which can be given effect without the invalid 14 provision or application thereof. 15 Section 10. Effective Date and Publication. 16 This Ordinance shall take effect thirty (30) days after the date of its passage.
