2 AN ORDINANCE AMENDING CHAPTER 4,
3 ENTITLED "ANIMALS," OF THE BUTTE COUNTY CODE
4 The Board of Supervisors of the County of Butte ordains as follows:
5 Section 1. Purpose. This proposed ordinance amends Sections 4-4 related to penalties for
6 late kennel and dog licenses and Section 4-11 related to impoundments of animals.
7 Section 2. Section 4-4 of the Butte County Code is hereby amended to read as follows:
8 (a) The fee for kennel licenses shall be as adopted by Resolution of the Board of
9 Supervisors as part of the Butte County Master Fee Schedule. In the event a
10 kennel license is not obtained during the applicable period specified in section
11 4-3 above, there shall be a late fee of one hundred dollars ($100), in addition to
12 the applicable kennel license fee.
13 (b) Dogs maintained in a kennel licensed pursuant to the provisions of this chapter
14 are not subject to the license fees specified in subsection (d) below.
15 (c) All dogs maintained in the kennel shall be vaccinated against rabies in
16 compliance with California law and shall wear a collar and a tag provided at the
17 expense of the kennel owner or operator. Such tag shall identify the kennel
18 owner and the applicable Butte County kennel license number.
19 (d) Dog license fees shall be as adopted by Resolution of the Board of Supervisors
20 as part of the Butte County Master Fee Schedule.
21 (e) Dog license late registration penalty shall be $10.
22 Section 3. Section 4-11 of the Butte County Code is hereby amended to read as follows:
23 4-11 Fees for impoundment, boarding and transport.
24 The public health department shall charge and collect fees from animal owners for the
25 redemption of impounded animals as adopted by Resolution of the Board of
26 Supervisors as part of the Butte County Master Fee Schedule.
27 The first, second, third and subsequent impoundments of an animal or animals shall be
28 accumulated and counted within any twelve (12) consecutive month period. The

I penalty for impoundment is fifteen ($15) dollars for the 2nd impoundment and the
2 penalty for the 3"' and subsequent impoundments is thirty-five ($35) dollars.
3 Section 4. Severability. If any provision of this Ordinance or the application thereof to
4 any person or circumstances is for any reason field to be invalid by a court of competent
5 jurisdiction, such provision shall be deemed severable, and the invalidity thereof shall not
6 affect the remaining provisions or other applications of the Ordinance which can be given
7 effect without the invalid provision or application thereof.
8 Section S. Effective Date and Publication. This Ordinance shall take effect on July 13,
9 2017, which is 30 days after the date of its passage. The Clerk of the Board of Supervisors is
10 authorized and directed to publish a summary of this ordinance before the expiration of fifteen
11 (15) days after its passage. This ordinance shall be published once, with the names of the
�2 members, of the Board of Supervisors voting for and against it, in the Chico Enterprise-Record
13 and Oroville Mercury-Register, newspapers of general circulation published in the County of
14 Butte, State of California.
