2 AN ORDINANCE REPLACING
ORDINANCE 4135
3 REGARDING BOARD OF SUPERVISORS MEMBER COMPENSATION

The Board of Supervisors of the County of Butte ordains as
5
follows :
6
Section 1 . Purpose. This proposed ordinance replaces
7
Ordinance 4135, which increased the annual Salary of Board of
8
Supervisors Members by 4 . 3876% effective July 1, 2017 . This
9
ordinance increases annual salary of all Board of Supervisors
10
Members currently holding office by 2 . 89% retroactive to July 1,
11
2018, pursuant to judicial salary increases of 2 . 89% effective
12
July 1, 2018 . Such an increase is expressly provided for by
13
Section 3 of Ordinance 4135 and reaffirmed in this ordinance.
14
Section 2 . Salary. The annual salary for the overtime
15
exempt position of Board of Supervisors Member is set at
16
$60, 997, retroactive to July 1, 2018 .

Section 3 . Annual Salary Adjustment. upon notification from
18
the Judicial Council of California of any increase in the salary
19
for judges, as specified in Government Code Section 68203, the
20
Board of Supervisors may adopt an ordinance or amended ordinance
21
increasing the salaries of each Board of Supervisor Member by
22
the same percentage increase as the judges, however, the annual
23
increase in salary of each Board of Supervisors Member shall. in
24
no case exceed five percent and shall not become effective prior
25
to the effective date of the related increase in salary for
I judges . Any ordinance changing supervisorial salaries shall
2 become effective no earlier than 60 days from the date of its
3 final passage .
4 Section 4 . Mileage. Each Board of Supervisors Member shall be
5 provided a monthly mileage allowance of six-hundred and twenty
6 dollars ($620 . 00) per month for all within-County travel .
7 Additionally, each Board of Supervisor Member shall be reimbursed
8 at the current IRS allowable rate for all work-related travel in
9 his or her private vehicle outside of the County.
10 Section 5 . Other Expenses. Each Board of Supervisors Members
11 shall be reimbursed for actual and necessary expenses incurred in
12 the course of official county business, including meals and lodging
13 and all other necessary expenses, other than mileage expenses
14 included above, which shall be incurred by them, subject to normal
15 budgetary and appropriation controls and the most current Butte
16 County Travel Policy, as included in the Butte County Personnel
17 Rules, .
18 Section 6. Cell Phone Allowance
19 a. Each Board of Supervisors Member may opt to be provided
20 a County-owned cell phone for business purposes . Any
21 personal charges incurred while using the County-
22 provided cell phone must be reimbursed to the County
23 Auditor-Controller on a monthly basis .

1 b. Each Board of Supervisor Member may opt to receive a
2 monthly cell phone allowance of seventy dollars ($70 . 00)
3 for use of a privately owned cell phone to conduct County
4 business .
5 Section 7 . Other Benefits. All other benefits for each Board
6 of Supervisors Member shall be consistent with the benefits in the
7 most current Resolution Regarding Benefits of Butte County Board
8 of Supervisors Members as long as the benefit is not exempted by
9 other applicable plans or documents .
10 Section 8 . Repeal. Any and all other ordinances or ordinance
11 provisions which are contrary to the salary and expense allowance
12 provisions in Sections 2 through 7 above are hereby superseded and
13 repealed as of the effective date of this ordinance .
14 Section 9 . Severability. If any provision of this Ordinance
15 or the application thereof to any person or circumstances is for
16 any reason held invalid by a court of competent jurisdiction, such
17 provision shall be deemed severable, and the invalidity thereof
18 shall not affect the remaining provisions or other applications of
19 the Ordinance which can be given effect without the invalid
20 provision or application thereof.
21 Section 10 . Effective Date and Publication. This Ordinance
22 shall take effect on December 29, 2018, which is greater than sixty
23 (60) days after the date of its passage. The Clerk of the Board
24 of Supervisors is authorized and directed to publish a summary of
25 this ordinance before the expiration of fifteen (15) days after
1 its passage. This ordinance shall be published once, with the
2 names of the members of the Board of Supervisors voting for and
3 against it, in the Chico Enterprise Record, a newspaper of general
4 circulation published in the County of Butte, State of California.

6 PASSED AND ADOPTED by the Board of Supervisors of the County of
7 Butte, State of California, on the 23rd day of October, 2018, by
8 the following vote :
