HomeMy WebLinkAbout41571 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 Ordinance No.415 AN ORDINANCE OF THE COUNTY OF BUTTE AMENDING SECTION 26-2, OF CHAPTEF 26, ENTITLED "BUILDINGS," AND SECTION 28A-1, OF CHAPTER 28A, ENTITLES "MOBILEHOME AND MOBILEHOME LOT STANDARDS," OF THE BUTTE COUNTY CODE The Board of Supervisors of the County of Butte ordains as follows: Section 1. Section 26-2, entitled "Definitions," of Article I, entitled "In general," of Chapter 26, entitled "Buildings," of the Butte County Code is amended to read as follows: "26-2 Definitions. The 2016 California Building Standards Code aE adopted by Section 26-1 is amended to read as follows: Whenever any of the following names or terms are used in the California Building Standards Code, such name or term shall have the meaning ascribed by this section as follows: Building Official: The Building Division Manager of Butte County or his/her designated representative. Limited Agricultural Building: A building meeting the definition of "Agricultural Building" in Part 2, California Building Code, Volume 1, Section 202 and also found on the list set forth in Part 2, California Building Code, Volume 2, Appendix C, C101.1. Mobile/manufactured home: A housing structure transportable in one (1) or more sections, designed and equipped to be used with or without foundation system, certified under the National Manufactured Housinc Construction and Safety Standards Act of 1974 (42 U.S.C. section 5401 et seq.). The County shall not grant a permit for the installation of a mobile/manufactured home if such mobile/manufactured home is older 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 than ten (10) years of age. The age measurement period shall be fro: the year of manufacture of the home to the year of the permi application. Mobile/manufactured home does not include recreationa vehicle, park trailer, or commercial modular as defined in Divisio 13, Part 2, Chapter 1, of the Health and Safety Code. Section 2. Section 28A-1, entitled "Mobilehome and mobilehome to standards adopted by reference," of Chapter 28A, entitled "Mobilehom and Mobilehome Lot Standards," of the Butte County Code is amended t read as follows: "28A-1 Mobilehome and mobilehome lot standards adopted by reference. In order to provide minimum standards for the construction, use, maintenance and occupancy of mobile/manufactured home lots anc mobile/manufactured homes and installations for supplying fuel gas, water, and electricity thereto and the disposal of sewage therefrom, subchapter 1, commencing with section 1000, of chapter 2, entitlec "Mobilehome Parks Act," of title 25 of the California Code of Regulations is hereby adopted, incorporated and made a part of thin chapter by reference, without further publication, as though set forte at length herein. This chapter shall apply to and govern all mobilehomes, manufactured homes, travel trailers and recreational vehicles, and accessory structures, and all such utility, installations, located outside of mobilehome parks in the unincorporated areas of the county. At any time following March 28, 2019, the County shall not grant a permit for the installation of mobile/manufactured home if such mobile/manufactured home is older than ten (10) years of age. Section 3. Severability. If any provision of this Ordinance o the application thereof to any person or circumstances is for an reason held to be invalid by a court of competent jurisdiction, suc provision shall be deemed severable, and the invalidity thereof shal not affect the remaining provisions or other applications of th Ordinance which can be given effect without the invalid provision o application thereof. Section 4. Effective Date and Publication. This Ordinance shall tak effect thirty (30) days after the date of its passage. The Clerk o the Board of Supervisors is authorized and directed to publish thi Ordinance before the expiration of fifteen (15) days after it passage. This Ordinance shall be published once, with the names o the members of the Board of Supervisors voting for and against it, i the Chaco Enterprise -Record, a newspaper of general circulatio published in the County of Butte, State of California.
