AN ORDINANCE FOR THE COUNTY OF BUTTE, STATE OF CALIFORNIA,
ADOPTING THE 1955 EDITION OF THE UNIFORM BUILDING CODE, THE
1955 EDITION OF THE UNIFORM PLUMBING CODE, AND THE 1953 EDITION
OF THE hTATIONAL ELECTRICAL CODE TO REGULATE THE ERECTION,,
CONSTRUCTION, ENLARGEMENTS ALTERATION, REPAIR, MOVING,,.
CONVERSION„ OCCUPANCY, HEIGHTS AREASx PLUMBING,, WIRING, AND
MAINTENANCE OF BUILDINGS AND STRUCTURES IN THE UNINCORPORATE
AREAS OF BUTTE COUNTY; PROVIDING FOR THE ISSUANCE OF PERMITS
AND THE COLLECTION OF FEES THEREFORr ; PROVIDING PENALTIES
FOR THE VIOLATION THER•EOF,, ADD REPEALING ORDINANCES IN
CONFLICT THEREWI
The BOARD OF SUPERVISORS of the COUNTY OF BUTTE, State of
California, DO ORDAIN as follows:
Section I -TITLE:
This Ordinance shall be known as the "Building Ordinance of the
County of Butte", and may be cited by such title.
Section II -PURPOSE:
The purpose of this Ordinance is to safeguard persons and property
within the County of BButte by establishing minimum standards for building
construction, including installation of plumbing and electrical systems,
Section III -PROHIBITION ANB SCOPE:
(a) It shall be unlawful for any person, firm or corporation to erect,
construct, enlarge, alter, repair, move, improve, convert, equip, use, occul
or maintain any building or structure in an unincorporated area of the County
of Butte, State of California, or to cause the same to be done contrary to or in
violation of any of the provisions of the codes adopted hereby,
(b) The provisions of this Ordinance shall apply to all buildings or
structures in the unincorporated territory of the County of Butte, excepting
the construction, repairing and remodeling of farm buildings not used for
human habitation and any buildings which meet the following requirements:

1. Any sole single-family residential building or structure locate

on a parcel of land containing five (5) acres or more, and located fifty (50 or
more from all property lines.
Section IV -VOLUNTARY COMPLIANCE:
Any owner of a bulling exempted from the provisions of this Ordinanc
may obtain the services of the Building Department by applying for a building
permit and paying the fee.
Section V -DEFINITIONS:
Whenever in any of the codes adopted hereby the foIlowing names or
terms are used, such name or term shall have the meaning ascribed to it by
this section as follows, to wig
(a) "Agriculture",as used in this Ordinance, means the tilling of
soil and raising of crops, horticulture, floriculture, small livestock farming,
dairying and/or animal husbandry, including all uses accessory and incidental
thereto.
(b) "Building Official", "Plumbing Official", "Administrative
Authority", "Chief Electrical Inspector", shall mean all members of the Butte
County Building Division of the Butte County Department of Public Works.
(c) The "Building Department" shall mean the office of the Buildi
Division of the Butte County Department of Public Works,
(d) The "Board of Appeals" shall mean the Board of Appeals as
ovi.ded for in Section 204 of the Building Code and approved by the Butte
ounty Board of Supervisors.
(e) "City" shall mean the County of Butte when referring to a
olitical entity or the unincorporated area of said County when referring to
rea,
(f) "City Clerk" means County Clerk of Butte County,
(g) "City Council" means the Board of Supervisors of the County
Butte.
(h) "Fire Chief" shall mean the Chief of the Fire Protection
District wherein lies any proposed building site, or in any area not under the
iurisdiction of a Fire Protection District., the same shall mean the Chief Ran

~~ of the State Division of Forestry, Butte County, California.

(i) "Housing Act" means the State Housing Act presently set forth
in Division 13, Part 1 of the Health and Safety Code of the State of California.
Section VI -CODES ADOPTED BY REFERENCE:
For the purpose of establishing proper regulations for construction
for installation of Plumbing and Electrical systems the following codes, or
portions thereof, hereinafter set forth, are hereby adopted and made a portion
of this Ordinance by reference without further resolutions or posting thereof.
Three (3) copies each of these codes, all certified by the County Clerk to be
true copies, are now on file for the use and examination by the public in the
office of the County Clerk of the County of Butte.
Section VI-A - BUILDING CODE:
The Building Code for Butte County shall be the 1955 Edition of the
Uniform Building Code and appendix, as adopted by the Pacific Coast Building
Officials Conference, subject to the following changes and exceptions:
1, Omit Section 103 of Chapter 1, Section 205 of Chapter II and
'Fable 3A,
2. Paragraph D of Section 202 is amended to read as follows:
"Upon. presentation of proper credentials the Building Officer or his
duly authorized representative shall have the right during reasonable hours to
enter any building in the discharge of his official duties, or for the purpose of
making inspection, reinspection, or test of any building or structure except
that they are not empowered to enter any dwelling while the same is occupied
a dwelling, without the consent of the occupant thereof."
3. Section 1601 of Chapter 16 is amended to read as follows:
"For the purpose of this Code,. the entire unincorporated area of the
County is hereby declared to be, and is hereby, established as a fire district,
and said fire district is to be known as "Fire Zone No. 3"r
4. Omit Section 6001, 6003 and 6004, in Chapter 60.
Section 6-B -PLUMBING CODE:
The Plumbing Code for Butte County shall be the 1955 Edition of the
Uniform Plumbing Code, as adopted by the Western Plumbing Officials Associa
~tion, subject to the following changes and exceptions:
{a) Omit Section 1. 1, 1, 2, 1. 3, 1.4, Section 10 of 1, 5, paragraph
(1 and 4 of 1.8, paragraph A, B and D of 1, i1, and all of part 2 of "A
(b) Section 1. 6 is amended to read as follows:

"The Administrat~CV~ Authority and Assistant shall carry proper ~
credentials of his office, upon exhibition of which they shall have
the right during reasonable hours to enter any and all buildings in the
discharge of their official duties, or for the purpose of making any
inspection, reinspectioa or test of the installation of plumbing
appliances and equipment contained therein, except that they are not
empowered to enter any building wh~.e the same is occupied as a
dwelling, without the consent of the occupant thereof "
(c) Omit Section 805(30 of Chapter 8, and all Sections of
Chapter 11.
(d) Section 206(b) of said ~Jniform Plumbing Code is :.thereby
amended by deleting the following words;, "not less than two {2) inches in over-
all depth", and inserting in lieu thereof, "not less than one and three quarters
{1 3/4) inches in overall depth".
(e) Section 315(4) of said Uniform Plumbing Code is hereby
amended by deleting from the last sentence the following words: "or less than
one (1) foot below the surface of the ground".
(': {f) Section 406 of said Uniform Plumbing Code is hereby amended
by deleting subsection (c), and inserting in lieu thereof! "{c) Each cleanout
shall be installed so that it opens in a direction opposite to the flow of the soil
or waste or at right angles thereto,)
{g) Section 504( a) of said Uniform Plumbing Code is hereby amend
by adding to the first paragraph at the end thereof the following words] "but
need not exceed four inches", Section 504 of said Uniform Plumbing Code is
further amended by adding thereto subsection (d) as follows, to witF "{d) min-
imum vent size shall be one and one-half (1~ inches".
(h) Section 506(b) of said Uniform Plumbing Code is hereby
amended by striking and deleting the following words, "nor Less than ten (10)
feet in every direction from any lot line, alley ar street excepted".
(i) Section 608 of said Uniform Plumbing Code is hereby amended
by striking and deleting from the last sentience the following words, "no
domestic dishwashing machine shall be directly connected to a drainage syst

The Electrical Code for Butte County shall be the 1953 edition of the

Section 7 -PERMITS AND FEES:
(a) No provision of this Ordinance shall be construed as preventing
any person from doing work an any building or structure in conformity with
the provisions of this Ordinance, The Building Department shall issue a pez
t•o any owner, his lessee or agent, permitting such person to construct, enl~
alter, repair, move, convert, plumb, wire, install, change, do work in, on
about, any building upon his property, but such work shall in all respects
conform to the provisions of this Ordinance.
No permit shall be required to be paid by the County of Butte, a Scho
District, the State of California., or the U. S, Government, when work is
being done on the official property of such agency and is to be used for goverm
mental or educational purpose.

Section 8 - AMENDMELVTS:
If a proposed amendment is considered by the Board of Supervisors to
be in the best interest of the people, the Board shall fix a time for hearing
and direct that the sizbstanee of the proposed ;amendment be published at lea
once in a newspaper of general circulation, printed and pdotished iri the Couz
said publication small be at least ten (10) days prior to the date fixed for the
hearing.
Section 9 - SEVERABILITY:
If any section, subsection, sentence, clause or phrase of this
Ordinance is for any reason held to be unconstitutional, such decision shall
not affect the validity of the remaining portions of this Ordinance. The Board
of Supervisors declares that it would have passed this Ordinance in each
section, subsection, clause or phrase thereof, irrespective of the fact that
any one or more sections, subsections, or phrases be declared unconstitution
Section 10 -REPEAL OF EXISTING ORDINANCES:
Except as herein otherwise provided, and subject to any other condi-
tions of this Ordinance, all Ordinances and parts of Ordinances in conflict
herewith are hereby repealed.
Section 11
Any portion of any of the Codes adopted hereby, which are in conflict
with this Ordinance as set forth, are hereby omitted,
Section 12 -PENALTIES:
Any person, firm or corporation violating any part of this Ordinance
shall be deemed guilty of a misdemeanor, and upon conviction thereof shall
be punishable by a fine of not more than $500.00, or by imprisonment in the
county jail for not more than six (6) months, or by both such fine and impriso
ment. Each separate day or any portion thereof during which any violation

occurs or continues shall be deemed to constitute a separate. offense and upon'
conviction thereof shall be punishable as herein provided.
Section 13 -EFFECTIVE DATE: ppg;ATIVE DATE:
This': Ordinance shall take effect thirty (30) ~ days after the date
