HomeMy WebLinkAbout578BUTTE COUNTY ORDINANCE NO« S78 AN ORDINANCE AMENDING ORDIlVANCE NO« ~k67 OF THE COUNTY OF AND RELATING TO JUNK DEALERS, JUNK COLLECTORS,, PAWNBROKERS,, SECONDHAND DEALERS, PEDDLERS AND AUCTIONEERS. WHEREAS Ordinance No, 572, enacted by the BOARD OF SUPERVISORS O~ the COUNTY OF BUTTES State of California, on the 4th day of February, 1957, and entitled, "An Ordinance Amending Ordinance No, 467 of the County of Butt relating to Junk Dealers, Pawnbrokers, and Secondhand Dealers", amended Article Three of Butte County Ordinance No, 467, by changing t hose sections of said Article Three numbered 71 to 90(a), but not amending nor affecting those sections of Article Three, being Sections 90(b) to 90(1), inclusive, and relating to auctioneers; and WHEREAS a change in the sequence of said sections and the contents Cher is now necessary; NOW, THEREFORE, the BOARD OF SUPERVISORS of the COUNTY OF State of California, DO ORDAIN as follows: 1. That Subsection (b) of Section 73, of Ordinance No. 467, as amended, shall now read as follows: "(b) For the purpose of this Article, a junk dealer is defined to be any person engaged in the business of buying, selling, or storing any junk as defined in Subsection (e) of this section, with a fixed place of business. " 2, That Subsection (c) of Section 73, of Ordinance No, 467, as amended, shall now read as follows: "(c) A pawnbroker is defined as a person, firm or corporation, engaged in the lending of money upon personal property, or purchasii personal property upon agreement to resell the same to the seller,or his assignee, at an agreed price. " 3. That Subsection {d) of Section 73, of Ordinance ND, 467, as amended, shall now read as follows: "(d) That the fees for the licenses granted hereunder shall be as follows: (1) Junk Dealer 2 Junk Collector 3) Pawnbroker 4) Second Hand Dealer (5) Peddler - $25k 00 per quarter 10, 00 per quarter for each - 30, 00 per quarter - $25.00 per full year - $ 5.00 per month, E, I~ a~ 7D 4. That Subsection (e) of Section 73, of Ordinance No. 467, as amended, shall now read as follows: "(e) Junk is defined as being any old iron, wire, brass, copper, tin, lead, rags, paper, bags, lumber, empty bottles, bones, parts of d~icycles, tricycles, baby carriages, automobiles, and other vehicles dismantled in whole or in part, and kept for sale or as junk, and all other similar personal property ordinarily defined and classi- fied as !junk'." 5. That Subsection (i) of Section 73, of Ordinance No, 467, as amended, shall now read as follows: 't(i) Junk, as herein defined, shall not be stored in the open, unless the premises upon which it is stored are enclosed by a fence of a type and height recommended by the Planning Commission and approved by the Board of Supervisors, and endorsed upon the license. granted, " 6, ThatSection:.77., of Ordinance No. 467, is amended to read as follows: "77. A peddler is defined to be a person without a regular established place of business, who travels from place-to-place, or who has a. public stand in any public store, sidewalk, or doorway of any unoccupied building, and who sells or offers, for sale any goc wares or merchandise in his possession, other than produ,ets proda or grown by such person." 7. That Sections 90(b) to 90(i}, of Article Three, of Ordinance No. 46'7, are to -remain and be in full force and effect, and to that end are hereby re-enacted, adopted and approved by reference, except as herein amended. 8. That Subsection (i) of Section 90, of Ordinance No. 467, as amended by Ordinance No. 499, shall now read as follows: "(i) Any person violating any of the provisions of Article Three, of Ordinance No. 467, shall be guilty of a misdemeanor," This Ordinance shall take effect thirty days after its passage, and before the expiration of fifteen days after its passage it shall be published with the names of the members voting for and against the same at least once in the arr~rS pig a newspaper published in the County of Butte, State of California.
