2 COUNTY OF BUTTE STATE OF CALIFORNIA
3 RESOLUTION AUTHORISING ACQUISITION OF REAL, PROPERTY BY EMINENT
DOMAIN NECESSAktX FOR THE CONSTRUCTION OF A COUNTY HIGHWAY
4 KNOWN AS LINCOLN STREET EXTENSION, IN TEiE
COUNTY OF BUTTE, STATE OF CALIE'ORNIA.

BE TT RESOLVED by the BOARD Ok` SUPERVISORS of the County
6
of Butte, State of California that said Board finds and determines
7
and hereby declares, as follows, to wit:

1. That public interest and necessity require the
9
acquisition, construction and completion by the County of Butte
10
of a public improvement, namely, a county highway known as
31
"Lincoln Street Extension", known as Project No. 171-58-1.

2. That public interest and necessity requires the
13
acquisition for said improvement of the real property, or interest
14
in the real property, hereinafter described, together with'all
15
improvements situate thereon, and it is hereby found and
16
determined that public interest and necessity requires construction
17
of said improvement and the acquisition of said real property
18
hereinafter described, and all improvements situate thereon.
19 .
3. Said proposed public improvement is planned and
20
located in a manner-which wi11 be most compatable with the
21
greatest public good and the least pxivate injury.

4. That the County Counsel of the County of Butte is
23
hereby authorized and empowered as follows:
24
(a) To acquire, in the name of the County of Butte,
25
a fee simple estate in and to the hereinafter described real
26
property, or interes in real property, and all improvements
27
thereon by condemnation in accordance with the provisions of the
28
Streets and Highways Code, Code of Civil Procedure and the
29
Constitution of the State of California relating to eminent domain.

(b~ To prepare and prosecute for the County o£ Butte
31
such proceedings in the proper court, having jurisdiction thereof,
32
as are necessary for-such acquisition.

~, (c) To make application to said Court for an order
2 fixing the amount of such security in the way of moneys deposited
3 as said Court may direct, and for an order permitting the County
¢ of Butte to take immediate possession and use of said real
5 property, or interests, or improvements in said real property
g as a right of way for a public highway for public use.
q (d~ To make deposit- of such security out of proper.
g funds under the control of the County of Butte, in such amounts
g so fixed and determined and in such manner as said Court in
3,0 which condemnation proceedings are pending, may direct, and the

13 property, and/or improvements thereon which the County of Butte
],¢ is, by this Resolution, authorized to acquire for said public
15 improvement, is situate in the County of Butte, State of
lg California, more particularly described as follows:
17 Lot 281, according to that certain map entitled,
"Official Niap of the Lee Higgins Tract, near
lg Oroville, Butte County, California", which map
:: was recorded in the office of the County Recorder
lg of the County of Butte, State of California,
April 7, 1910, in Volume 6 of Maps, at page 73.

The foregoing Resolution was introduced by Supervisor
21
Pryde , who moved its adoption, seconded by Supervise
22
Pittman and said Resolution was duly adopted and
23
passed this 3rd day of April, 1961, an roll call by the following
