BE IT RESOLVED by the BO?ARTI OF SUPERVISORS of the County of Butte, State o.f California, that said Board finds and determines, and hereby declares, as follows,- to wit:.- 1. That public interest and necessity require the acquisition of the fee title to that certain County FTighway known as "Speedway; situate south of Chico and in the County of Butte, State of Californian 2. That public interest and necessity require the acquisition of the fee simple title in and to the real property hereinafter described, together with all improvements situate thereon, and it is hereby found and determined that public inter- est and necessity require acquisition of the fee title to said zeal prapexty herein described{ and all improvements situate thereon. 3. That the proposed acquisition of fee title to an already existing public road is to permaLt:~ the free and unrestricted use of the real property hereinafter described by County as a public road; that said proposed use is most compatible with the greatest public good and the least private injuryp 4. That the County Counsel of the County of Butte is hereby authorized and empowered as follows: (aj To acquire, in the name of the County of Butte, a fee simple estate in and to the hereinafter described zeal property, or interest in real propertyr and all improvements thereon by condemnation in accordance with the provisions of the Streets and Highways Code, Code of Civil Procedure and the -1- iii ;. ~_~~~ 1 Constitutipn of the State of California relating to eminent 2 domains 3 (b) To prepare and prosecute fox the County of Butte 4 such proceedings in the proper court, having jurisdiction thereof, 5 as are necessary for such acquisition. 6 (c) To make application to said Court fox an order 7 fixing the amount of such security in the way of moneys deposited 8 as said Court may direct, and fox an order permitting the County 9 of Butte to take immediate possession and use of said real 10 property, or interests, ox improvements in said zeal property, 11 =,~d) To make deposit of such security out of pxoper 12 funds under the control of the County of Butte, in such amounts 13 so fixed and determined and in such manner as said Court in 14 which condemnation proceedings are pending, may direct{ and the 15 auditor is authorized to make said deposit immediately upon the 16 court making said order., 17 The real property, or interest in real property, 18 and/or improvements thereon which the County of Butte isQ by 19 this resolution, authorized to acquire in fee simple for said 20 public good and improvement, is situate in the County of Butte, 21 State of Cal,iforniac more paxti.cularly described as followss 22 P~FtCEL ONE: The Northwesterly 50 feet of Dots 1 and 2~ lying between parallel lines as 23 shown ova that certain map entitled,.
