BY EMINENT DOMAIN NECESSARY FOR THE CONSTRUCTION OF
5 A COUNTY HIGHWAY' KDTOWN AS COHASSET HIGHWAZ'', TN THE
COUNTY_OF_B_UTTE, STATE OF CALIFORNIA

BE IT RESOLVED by the BOARD OF SUPERVLSORS of the County of
Butte, State of California that said Board finds and determines,

and hereby declares, as follows, to wit:

1. That public interest and necessity require the acquis-
10
ition, construction and completion by the County of Butte of a
11
public improvement, namely a county highway known as Cohasset
12
Highway, between Chico Airport and Keefer Road, and known as
13
Qroject k`.A,S. 1336(1) in the County of Butte, State of California
14
2. That public interest and necessity requires the

acquisition for said improvement of the real property, or interest
16
in the real property, hereinafter described, together with all
i~
improvements situate thereon, and it is hereby found and determine
18
that construction of a county highway is a public use, authorized
is
by law and that public interest and necessity requires the
20
construction of said improvement, and the acquisition of said
21
real property hereinafter described, and all improvements
22
situate thereon.

3, Said proposed public improvement is planned and located
24
in a manner which-will be most compatible with the greatest public
25
good and the least private injury.
26
4. That the County Counsel of the County of Butte is
27
hereby authorized and empowered as follows:
28
(a) To acquire, in the name of the County of Butte, a
29
fee simple estate in and to the hereinafter described real propert
30
or interest in real property, and all improvements thereon by
31
condemnation in accordance with the provisions of the Streets
32

1 and Highways Code, Code of Civil Procedure and the Constitution
2 of the State of California relating to eminent domain.
3 ~b) To prepare and prosecute for the County of Butte
4 such proceedings in the proper court, having jurisdiction thereof,
5 as are necessary for such acquisition.
6 (c) To make application to said Court for an order fixing
7 the amount of such security in the way of moneys deposited as
8 said Court may direct, and for an order permitting the County
9 of Butte to take immediate possession and use of said real
10 .property, or interests, or improvements in said real property
I1 as a right of way for a public highway for public use.
12 (d) To make deposit of such security out of proper funds
13 under the control of the County of butte, in such amounts so
14 fixed and determined and in such manner as said Court in which
15 condemnation proceedings are pending, may direct, and the
16 Auditor is authorized to make said deposit immediately upon the
17 Court making said order.
18 The real property, or interest in real property, and/or
19 improvements thereon which the County of Butte is, by this
20 resolution, authorized to acquire for said public improvement
21 in fee simple, is situate in the County of Butte, State of
22 California, more particularly described as follows:

A portion of the east one-half of Section 27, and the
24 Northeast quarter of Section 34, T. 23 N., R. 1 E.,
M.B.B.&M., more particularly described as follows:

Beginning at the northeast corner of said Section 27;
26 thence S 00°06`28" E along the east line of said
Section 27 a distance of 2623.97 feet to the east
27 quarter corner of said Section 27; thence S 00°35`02"
E 7.69 feet; thence S 55°11'40" W 401.35 feet; thence
28 S 39°37` 23" W 488.10 feet; thence S 34°28'52" W
259.91 feet; thence S 20°36'17" W 440.38 feet; thence
29 S 11°52'13" W 1300.40 feet; thence S 8°58'42" W

A portion of the east half of Section 34, T. 23 N.,
R_ 1 E., M.D.B,&N1., more particularly described
as follows:
Beginning at the northeast corner of said Section
34; thence along the north line of said Section 34
S 88°33'36" W 1327.72 feet to the true point of
beginning of this description; thence S 00°50'00"
E 4100.98 feet; thence along the arc of a 1000 foot
radius curve, concave to the east through a central
angle of 17° 09'35", an arc length of 299.49 feet;
thence radial to said curve S 72°50'25" W 40,00
feet to a point. on the existing right of way line
of the Cohasset Highway (from this point centerline
for construction Station 207+95.14 P,C,C. for F.A.S.
1336(1) bears N 72°57'27" E 41.17 feet); thence along
the following courses and distances: (1} N 17°09'35"
W 264.50 feet (2) N 40°5.7'57" W 67.70 feet {3}
S 89°38'52" W 20.00 feet (4} N 00°21'08" W 80.00
feet (5) N 89°38'52" E 20.00 feet (6} N 39.°47'40"
E 80.23 feet (7} N 0°47'10" W 394&.22 feet to the
north line of said Section 34; thence along the
north line of said Section 34; N 88°33'36" E
59.9.0 feet to the true point of beginning. Except
that portion now owned or occupied by the County
of Butte, containing an area of 4.538 acres after
said exception.
5. That it is hereby found that public interest and
necessity .requires the acquisition of a right of entry and
temporary easement for detour purposes during the construction
period of said county highway, and not to exceed one year, in
and to the hereinafter described real property, to wit:

and the County Counsel of the County of Butte is hereby authorized

and empowered to do any and all things set forth in Paragraph 4

hereof to acquire a writ of immediate possession of said right

of entry and temporary easement for the public use as a detour
11
as hereinbefore set forth.

The foregoing resolution was introduced by Supervisor

Alldrad~ae who moved-its adoption, seconded by

Supervisor Prude and said resolution was duly adopted

and passed this 8th day of May, 1961, on roll call by the followin
