That said Board finds that Notice of Abandonment of the hereinaft described real property as county highway has been duly given in accordance with Section g55 of the Streets and Highways Code of the State of California; and 2. That said Board finds from the evidence produced at the hearing upon the abandonment of said real property as a county highway, that the same, fox a period of Five (5) consecutive years was impassible for vehicular travel, and during such perm. of time no public monies were expended for maintenance, and that said county highway is unnecessary and subject to abandonment pursuant to Sections 954, 955 and 956 of the Streets and Highways Code of the state of California. NOW, THEREFORE, in accordance with the foregoing, and the petition for abandonment filed herein, the Board of Supervisors of the County of Butte, State of California, hereby makes this order: 1. `T'hat the hereinafter described county highway be abandoned, and that said county highway is hereby declared to be abandoned as unnecessary is particularly described as ',follows: A11 that certain real property situate in the County of Butte, State of California, more particularly described as follows, to-wit: Beginning at the Southwesterly corner of Lot 1, in Block 5, as shown on that certain map entitled, "MAP OF STIRLING CITY", which map was filed in the office of the .Recorder of 'the County of Butte, State of California, August 3, 1903 in Map Book 4 at page 33; thence Easterly along the Southerly line of said Lot 1, 140 feet to 'the Southeasterly corner of said Lot; thence at aright angle Southerly 25 feat; thence Westerly para]~.el to the Southerly line of said Lot 1, 140 feet and thence at a right angle Northerly 25 feet to point of beginning. -1-- j l 2 3i 5 6' '7 18 i. '9 !10 !11 ill 13 14 !15 16 1:7 18 19 20 '21 22 23 I 2 25 2'6 2'7 28 ' 2~9 30 3'l 32 RESERVING, however to Pacific Gas and Electric Company and The Pacific Telephone and Telegraph Company the right to repair, maintain, operate, replace, remove and renew those lines of cables, wires, poles and other convenient structures, equipment, and fixtures for the operation of telephone lines, and for the transportation and distribu- tion of electric energy currently located in, upon, and over said portion of Lava Street. 2. The Clerk of this Board sha71 cause a certified copy of this Resolution and Order, attested by the Clerk under the seal of the Board, to be recorded in the office of the County Recorder.
