RESOLUTION AND NOTICE -ECLARING INTENTION TO SE1L PROPERTY
{Government Code Section 25526 et.seq.)
BE IT RESOLVED by the BOARD OF SUPERVISORS of the County of Butte,..
State of Cali3ornia, as follows:
1. That said Board hereby declares that it intends to sell that
~ certain parcel of property situate an the County of Butte, State of California,
~ more particularly described as follows:
Parcel No. 1
A portion of Lot 63, Orovi]1e-Wyandotte Fruitlands, Unit
No. 3 filed in the. office of the Recorder of the County of
Butte, State of California in Map Book 11, at pages 19 and
20, more particularly described as fQ11aWS: Beginner at
the most Northerly corner of Lot 6~ of said Subdivision,
said corner also being on the. centerline of the right-of-
way of the Oroville-Wyandotte Irrigation District ditch;
thence South 3$°02' East along said centerline 122.12
feet to the true point of beginning; thence North 5~°56148"
East 136.36 feet, to a point (being also on the Westerly
right-of-way line of the County road known as the Olive
Highway} in a non-tangent curve concave to the Northeast,
having a radius of 2,060.00 feet, a radial line of said
curve through said point bearing South 54°56148" West;
thence Southerly along said auxve and Westerly right-of-
way lane of said road through a central angle of 5°43142" and
an arc length of 205.86 feet to the Easterlyy line of that
certain parcel of land deeded from Edward C. Wubbens and
Agnes M. Wubbens to the County of Butte and recorded in
said Recorderls office in Book $20 Official. Records, page
393; thence South 3°451 West along said Easterly boundary
lOg.74 feet to the centerline of said ditch right-of-way
and the Westerly line of said Lot 63; thence along said
line the following courses and distances: North 73°191
West 45.00 feet; North 63°5?1 West 5~+~45 feet; North
55°56` West 50.00 feet; North ~-1°141 West 50.00 feet;
North 33°581 West 75.00 feet; North 38°021 West 36.93 feet
to the true paint of beginning. -Containing an area of
0.665 acre, more or less, which excludes that area within
the right-of-way of said Oroville-Wyandotte Irrigation ditch.
Parcel 1-A: Anon-exclusive Right-oY--Way or easement over
the following described parcel: Commencing at the most
Northerly corner of Lot 64 pf said Subdivision, said corner
also being on the centerline of the right-of-way of the
Oroville-Wyandotte Irrigation District ditch; thence along
said ditch centerline youth 38°021 East 122.12 feet to the "
true point of beginning; thence North 54°56148" East
136.36 feet, to'a point (being on the Westerly right-of-
way line of the County road known as the Olive Highway) in
a non-tangent curve concave to the Northeast, having a
radius of 2,060..00 feet, a radial lane of said curve through
said point bearing South 54°56*48" West; thence Northerly

of said ditch; thence along said centerline, South 38°02'

Said non-exclusive xight-of..way is for the benefit of and
appurtenant to the property described 3.rn deed from Edward
C. Wubbens and Agnes M. Wubbens tv the County of Butte,
dated May 2, 1958, and recorded May 6, 1958, in Book 820,
Official Recgrds at page 393, and shall inure to the benefit
of and may be used by all persons who may hereafter become
the owners of said appurtenant property qr any parts or
portions thereof.

2. That the terms and conditions of said sale are as fo3lows:
(A) That the minimum prise that will be acceptable for said parcel
of property is the sum of Four Thousand Eight Hundxed Five Dollars ($4,805.00).
(B) That said purchase price is to be paid in cash as fellows:
Ten (10) percent thereof to accompany bid and balance upon close of escrow to
be established with title company upon acceptance of bid.
(C) County to furnish and pay for title insurance.
(D) County warrants that the leaching Yield and the present septic
tank. ca,n he used after the house situate on said property 3s moved.
(E) That the house situate on said premises sha31, within ninety
{90) days after sa1e~ be moved to a flistance of not closer than twenty
west
feet to County~s South/right-of~way line of Olive Highway.
(F) Any vandalism, or damage to the house after this date and
before award of bid wi11 be repaired or replaced at the County expense or a
Yaix and equitable adjustment will be made in the bid to repair or replace
same. As of this. date all plumbing fixtures and lighting fixtures are i.n.
place but one pane of the front window and two panes of the bedroom jalousie
window bxaken and the back door bell missizag. ',
3. That Monday, the 3rd day of July, 3.961, at 11:00 A.M. of said
day is hexeby faxed as the time at which the Board of Supervisors of the Gounty I'
of Butte, at a regu7.ar meeting of said Board, wi31 receive sealed propos~.ls to
purchase said property, and w331 consider said sealed proposals, and that the
place of said meeting wi11. be in the Supervisors' Room of the Court House

situate on Huntoon Street in the City of Oroville, County of Butte, State of
California.
4. That no commission will be paid to any licensed real. estate
I broker.
5. That notice of the adoption of this Resolution and the tame and
place of holding the meeting to consider sealed proposals for the sale of
said property, shall be given by posting a copy of this Resolution, signed by
the Chairman of the Board, 3.n three (3) public places in the County, not
less than fifteen (15} 41ays before -the date of the meeting and by publishing
notice in the County pursuant to Section 6063 of the Government Code, to wit,
once a week for three successive weeks.
6. At the time and place fixed herein for the meeting to consider
sealed proposals for the purchase of said property, the highest, qua~.ifying
bid will. be accepted unless upon a call for oral bids such oral bid shall
exceed by at least five pexcent (5~) the highest written-proposal.
', "~. That said Board wi]~. consider written proposals and oral bids
for said property and reserves the right to accept or reject all written
proposals and~or oral bids on said property.
8. The foregping Resolution was duly adopted and passed at a
regular, open meeting of said Board held on the 12th day of June, 1961,., upon
roll call. by the fo]~.owing vote ;
