HomeMy WebLinkAbout61-103~~~. 1 RESOLUTION NO. 61- 103 '2 BOARD OF SUPERVISORS ~ COUNTY OF BUTTEr STA'T'E OF CALIFORNIA 4 RESOLU'T`ION ADOPTING SUGGESTED POLICY OF THE DEPARTMENT OF WATER RESOURCES, STATE OF CALIFORNIA, IN REGARD 5 TO PUBLIC AGENCY FACILITY RELOCATION. 6 WHEREASp the Department of Water Resources of the State 7 of California is considering the adoption of a statewide policy 'g in regard to public agency facility relocations; and g WHEREAS, said Department requested of the County of 10 Butte i.ts views in regard to said public agency facility lI relocations; and 12 WHEREAS, the County of Butte has considered the 13 proposed policy of said Department of Water Resources and the 14 recommendations submitted by the Department of Public Works of 15 the County of Butte; 16 NOW, THEREFORE, BE IT RESOLVED by the Board of 14 Supervisors of the County of Butte, State of California, as lg follows: lg 1. That said Board submits for consideration by the 20 Department of Water Resources the following policy in regard to 21 public agency facility relocations, to wit: 22 (a) The alignment to be selected shall be the one 23 that has the least overall economic cast as determined by ~ recognized highway engineering methods. Design and construction 25 skull be based on design standards for present-day traffic 26 conditions as described in the County Engineers' Association of 27 California's "Public Works Guide,".dated January, 1957. Wherever 28 possible, the desirable standards shall prevail and proper allow- 29 ance shall be made for truck traffic. 30 (b) All roads, rights of way and bridges, excepting 31 bridges of structural steel or of abnormal size, which are 32 provided as part oi~ the County road relocation, shall be -l- i! 3- ~l ~~o~~ y, G _ 1 transferred in fee to the County for ownership and normal 2 maintenance, The State shall assume the obligation for all 3 abnormal maintenance and abnormal cost for future widening or 4 enlargement. For the purpose of this policy, abnormal maintenance ~ shall be defined as the maintenance cost per mile in excess. of 8 that received per mile of County maintained highway from the 7 Highway User's Tax Fund, pursuant to Sections 2114 and 2116 of the $ Streets and Highways Code. 9 (c) Title to bridges constructed primarily of "10 structural steel or of abnormal size shall remain with State, 11 with State granting to County a perpetual easement over them. 12 Maintenance of such bridges shall be the obligation of State. 13 (d) All public agencies shall be treated equally 14 and any benefits granted to any public agency shall be extended 15 to all other public agencies as in the "most favored nation" 16 clause in treaties of the United States. 17 2. That the Clerk of this Board is instructed to 18 forward a certified copy of this Resolution to the Department 19 of Water Resources and to the Honorable Edmund G. Brown, 20 Governor of the State of California, and to any and all other 21 persons indicated by the Chairman of this Board. 22 The foregoing resolution was introduced by Supervisor 23 gryr3e who moved its adoption, seconded by Supervisor 24 StainP,ggar and said resolution was passed this 13th day 25 of December, 1961, on roll call by the following vote: 2g AYES: SUPERVISORS ALT,I}REDGE, PRYDE, STEINEGGER.
