AND REPEALING INCONSISTENT ORDINANCES AND PROVIDING PENALTIES, The Board of Supervisors of the County of Butte, State of California, do ordain as. follows: ~ E~'FxON 1, (a) Every person who lives in the unincorporated area of the County of Butte and who owns or keeps a dog that is over four months old shall register his dog during the month of July of each year or within thirty (30) days after said dog reaches the age of four months or within thirty (30) days after such person moves into the unincorporated area of the County of Butte, (b) Every person who owns or controls a kennel or other place in the unincorporated areas of the County of Butte where more than five (5) dogs are kept for breeding purposes, training, sale or other commercial purposes, shall attain a kennel license during the month of .Tuly of each year or within thirty (3fl) days after the kennel is established. SECTION 2: (a) The fee for registration shall be Three Dollars ($3.00). ~ (b) The fee for a kennel license shall be Tin Dollars ($1.0, 00). SECTION 3: The County Clerk shall be responsible for providing registration and kennel license applications and registration tags, and kennel licenses, Dogs may be registered and kennel licenses obtained at the County Clerk's office or at other places designated by said clerk or by the poundman, SECTION 4: (a) No registration tag shall be issued for a dog unless proof has been presented that said dog has been vaccinated against rabies at a date such that the period of time elapsing from the date of vaccination to the expiration of the registration being issued shall not exceed thirty (30) months in the base of vaccination with chick en•.bryo vaccine ar eighteen (18) months in the case of vaccination with nerve tissue -vaccine, ~1~ ~ o2D i l 2 : 3 '4 5', r' _ 6 7 8 '9 10 7.1 12 13 14 I i I Z5 16 X17 18 X19 20 21 22 23 24 25 26 27 28 29 30 31 32 (b) No kennel license shall be issued unless proof has been presented that all dogs owned by the kennel owner or operator in the kennel have been vaccinated against rabies in the manner prescribed above, nor shall any kennel license be issued until the poundmaster or his authorized representati has first issued a certificate that the kennel is operated in a sanitary and proper manner so as not to corstit ute a nuisance to the neighborhood. {c) To facilitate the administration of this ordinance, the County Clerk and other persons authorized to register dogs and issue kennel licenses are hereby authorized to accept registration and kennel license fees for dogs and kennels not meeting the vaccination requirements in (a} and (b) above and to give a receipt therefor without issuing a registration tag. The County Clerk shall arrange for proof of vaccination to be returned by mail, Th.e dog or kennel owner shall be allowed thirty (30} days from the date of his receipt to present proof of vaccination to the licensing authority. Upon receipt of proof of vaccination against rabies as required in subseEtion (a) above, the licensin authority shall mail or otherwise present to the dog owner or kennel owner the registration tag or kennel license, In the event that proof of vaccination is not returned to the licensing authority within thirty (30} days from the date of the ee receipt, then the fee shall be forfeited to the County of Butte and the dog or kennel shall not be registered or licensed. SECTION 5: When a persons dog is registered he shall be given a registration tag which shall be fastened to the dog's collar or harness and worn by said dog at all timeso SECTION 6: Any unregistered dog or dog not wearing his registration tag may be impounded. If the dog is not claimed after a period of seventy two (72) hours, said dog may be disposed ofe .Any unregistered dog may be claimed at the pound if the owner pays, the pound keeper the cost of boarding and feeding the. dog and the registration fee of $3.00, On receipt of the registration fee, a receipt shall be issued and if proof of vaccination against rabies as required in Section 4 (a) is presented, a registration tag shall be given the person, If H 2~ l :~: 12 3 4 5 6 ~, 7 8 9 ', 10 11 12 13 14 15 16 17 18 1.9 20 21 22 23 24 25 26 27 28 29 30 31 32 such proof is not presented the provisions of Section 4 (c) shall prevail. SECTION 7: The Health Officer may order the holding in isolation or quarantine at the pound any dog which is rabid, suspected of being rabid, or which has bitten a person, and upon the order of the Health Officer, the poundkeeper shall so hold any such dog.. Any dog having bitten a person and being ordered to be held at the pound by the Health Officer may be redeemed by the owner at the end of the quarantine or isolation period upon payment of the cost of boarding and feeding such dog during its stay at the pound. SECTION 8: It shall be unlawful to interfere with, oppose or resist any authorized person collecting or impounding dogs under the provisions of this Ordinance. Such authorized person shall wear a badge and may go upon private property in pursuit of a dog, or may go upon private property other than in pursuit of a dog for the purpose of enforcing this Ordinance,. after previous written. notice to the dog owner, to comply with the provisions of this Ordinance, Nothing in this section contained shall authorize entry into any private dwelling, nor the abridgment of any constitutional immunity from search or seizure, SECTION 9: The Board of Supervisors may appoint a poundmaster, or designate a county official or employee as poundmaster. The poundmaster shall enforce this Ordinance and the laws of the State of California pertaining to the regisM tration, vaccination control and disposition of dogs. The poundmaster shall collect and dispose of dead animals in public places, SECTION 10: ' It shall be the duty of the sheriff, his deputies, the constables and other authorized persons to enforce this Ordinance, - SECTION 11: Any person who violates the provisions of this Ordinance is guilty of a misdemeanor, and upon conviction thereof shall pay a fine of not less than Five Dollars ($5.00) or more than Fifty Dollars ($50, 00) for each such violaM tion. 3~+ ,; e _~ __ 1 SECTION 12: 2 If any section, subsection, sentence, clause or phrase of this Ordinance I~ 3 is for any reason held by a court of competent jurisdiction to be unconstitutiona 4 or invalid, such decision shall not affect the validity of the remaining portion S of this Ordinance. The Board of Supervisors of the County of Butte hereby 6 declares that they would have passed this Ordinance and each section, subs 7 section, sentence, clause and phrase thereof, irrespective of the fact that any 8 one or more sections, subsections, sentences, clauses or phrases is declared 9 illegal or unconstitutional, 10 SECTION 13: 11 Butte County Ordinance No. 484 pertaining to the same subject matter 12 as is covered by this Ordinance and all ordinances amending said Ordinance 13 No, 484, and all ordinances or parts of ordinances in conflict herewith, are 1~1 hereby repealed, ~15 SECTION 14: 16 This Ordinance shall take effect July 1, 1958, and before the expiration 17 of fifteen (15) days after.. its passage, it shall be published with the names of 18 the members voting for and against the same in Gridley Herald v 19 a newspaper published in the County of Butte, State of California. 20 The foregoing Ordinance was duly adopted and passed by the Board of 21 Supervisors. of the County of Butte, State of California, at a regular meeting '22 on the 2Sth day of .May, 1958, by the following vote: 23 AYES.: Bupervisors~, Huggins, Kepple, Pryde and Chairman Alexander 24 NOES: Supervisor Black 25 ABSENT: None 26 27 airman of the .oar o upervisors of the County of Butte, State of 28 California.
