HomeMy WebLinkAbout62-010~_~~~ 'a 2 3 4 5 7 S 9 10 11 12 13 14 I 15 ~.6 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31. 32 RESOLUTION NO. 62- 10 BOARD OF SUPERVISORS COUNTY OF BUTTE, STATE OF CALIFORNIA RESOLUTION IN RE RESPONSIBILITY OF COUNTIES FOR THE MAINTENANCE OF PRISONERS WHO FORMERLY HAVE BEEN CARED FOR AT CITY E~.'ENSE; AND IN RE A REVIEW OF SHARED FINES UNDER SECTION 1463 OF TH'B PENAL CODE IN RELATION TO VIOLATION OF CITY ORDINANCES THAT PROVIDE FOR PENALTIES RATHER THAN FINES. WHEREAS, the Legislature in 1961 enacted legislation which makes it a violation of State law to be drunk in a public place; and WHEREAS, the effect of the legislation is to change the basic responsbility of counties and cities for the maintenance of jails; and Wf~REAS, the counties of California will now have the responsibility for the maintenance of larger numbers of additional prisoners who would normally have been cared for at cities' expense; and WHEREAS, cities have been and now are enacting ordinances providing penalties rather than fines for the violation of parking regulations, which in effect circumvent Section 1463 of the Penal Code; NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of the County of Butte, State of California, as follows: 1. That the Legislature be required to re-examine shared revenues between cities and counties in connection with fines and forfeitures in relation to prisoners and parking meter violations and alcoholic beverage license fees for the purpose of providing a larger share to the counties in light of these newly changed conditions. 2. That the Municipal Court Judges and Justice Court Judges be requested, through their respective associations, to restore the status quo in the matter by sentencing persons _1_ .11.~et~e 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 1.6 1'7 18 19 2d 21 22 23 24 25 26 27 28 29 30 31 32 convicted of being drunk in a public place within cities to city jails, until the problem created by the 1961 legislation is re-examined by the Legislature.
