RESOLVED by the BOARD OF SUPERVISORS of the COUNTY OF BUTTEt STATE OF CALIFORNIA, as follows: 1. That said Board finds that Notice of Abandonment of the hereinafter described real property as a county highway has bean duly given in accordance with Section 955 of the Streets and Highways Code of the State of California; and 2. That said Board finds from the evidence produced at the hearing upon the abandonment of said real property as a county highway, that the same, for a period of five (5) consecu- tive years was impassable::for vehicular travel, and during such period of time no public monies were expended for maintenance, and that said county highways are unnecessary highways subject to abandonment pursuant to Sections 954, 955 and 956 of the Streets and Highways Code of the State of California. NOW, THEREFORE, in accordance with the foregoing, and the petition for abandonment filed herein, the Board of Super- visors of the County of Butte, State of California, hereby makes this order: 1. That the hereinafter described county highway be abandoned, and that said county highway is hereby declared to be abandoned as unnecessary is particularly described as follows, to wit: All of those certain 20 foot alleys through Blocks D, E, F, G, H and I in the Town of Nord, as said alleys and blocks are shown on that certain map entitled, "Town of Nord", filed in the office of the County Recorder of Butte County, State of California, in Map Book 1 at Page 8. 2. RESERVING AND EXCEPTING from the abandonment the - 1 - ~. ~, ~~;~~ 6 7 g 9 10 11 12 13 14 15 16 17 18 19 20 21 22 ~ 23 24 25 26 27 28 29 30 31 32 right at any time, or from time to time, to construct, maintain, operate, replace, remove and renew sanitary sewers and storm drain and appurtenant structures in, upon, over and across any highway or part thereof proposed to be abandoned and pursuant to any existing franchise or renewals thereof, or otherwise, to construct maintain, operate, replace, remove, renew and enlarge line of pipe, conduits, cables, wires, poles and other convenient structures, equipment and fixtures for the operation of gas pipe lines, telegraphic and telephone lines, railroad lines and for the transportation or distribution of electric energy, petroleum, and its products, ammonia, water, and for incidental purposes, including access to ,protect the property from all hazards, in, upon and over the highway or part thereof proposed to be aban.donec 3. The Clerk of this Board shall cause a certified copy Order, attested by the Clerk under the seal of the Board, to be recorded in the office of the County Recorder. The foregoing Order was introduced by Supervisor GILES who moved its adoption, seconded by Supervisor PRYDE and said Order was passed this 20th day of November, 1962, on roll call by the following vote: AYES: Supervisors Giles, Pittman, Pryde, Steinegger and Chairman Alldredge NOES: None ABSENT: None CHAIRMAN~OF THE`$OARD OF SUYFKV15ux5 OF TfiE COUNTY OF BUTTEr STATE OF CALIFORNIA.
