BE TT RESOLVED by the Board of Supervisors of the County of Butte, State of California, as follows: 1. That said Board hereby declares that it intends to sell that certain real property situate in the County of Butte, State ', of California, more particularly described as follows: II Commencing at the intersection of the northerly line of Montgomery Street with the westerly line of Marysville Road; thence S 4° 04' 35" W along said westerly line 163.15 feet to the true point of beginning. Thence N 78° 00' 27" W 76.04; thence S 66° 53' S2" W 238.12 feet to the easterly line of the lands of Otto Crum, et al, said lands are described by deed, as parcel two and are recorded in the office of the County Recorder of Butte County, State of California, in Book 1075 Official Records at Page 183; thence along said easterly line of Crum parcel as follows: S $° 39' 25" E, 475.11 feet and N 66° 04' 35" E, 206.47 feet to the westerly line of Marysville Road; thence along said westerly road line N 4° 04' 35" E, 463.14 feet to the true point of beginning. Containing an area of 2.72 acres more or less. 2. That the terms and conditions of said sale are as follows: (a) That the minimum price that will be acceptable for the said parcel of real property is $75,000.00. (b) That the purchase of said real property is to be paid in cash, as follows: 10% thereof to accompany bid and balance upon the final acceptance by the Board of Supervisors and the delivery of the deed to said real property. {c) That the form of conveyance shall be a Grant Deed. 3. That Tuesday, the 12th day of March, 1963, at 11:00 A.M. is hereby fixed as the time at which the-Board of Supervisors of the County of Butte, at a meeting of said Board, will receive sealed proposals to purchase said real property and will consider said sealed proposals, and the place of said meeting will be in -1- 1 2 3 4 '5 6 7 8 9 10 11 12 13 14 i5 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 the Supervisors' Room of the Courthouse, situate on Huntoon Street, in the City of Oroville, County of Butte, State of California. 4. That the County of Butte has been informed by the State of California that it may purchase from the State of California an access right to the property from Montgomery Street for the sum of $2,000.00 and that bids to the herein described real property will be accepted subject to County acquiring said access right for the sum of $2,000.00, which would be an addition to the minimum price herein set which is $75,000.00 or a total. minimum price of $77,000.00. 5. That a 5% commission will be paid to any licensed real estate broker. 6. That notice of the adoption of this resolution and the time and place of holding the meeting to consider sealed proposals for the purchase of said real property shall be given by posting a copy of this resolution, signed by the Chairman of the Board, in three (3) public places in the County not less than fifteen (15) days before the date of the meeting, and by publishing the notice in the County pursuant to Section 6063 of the Government Code, to wit, once a week for three (3) successive weeks. 7. At the time and place fixed herein for the meeting to consider sealed proposals for the purchase of said real property, the highest qualifying bid will be accepted, unless upon a call for oral bids, such oral bads shall exceed by at least 5% the highest written proposal. 8. The Board of Supervisors shall consider written proposals and oral bids separately and reserve the right to accept or reject a13 written proposals and/or oral bids. 9.
