BE IT ICES®LVED by the B(bAR}~ Q~' SUP:ERVTSEDRS of the County of Butte, State of California, that said Board finds and determines, and hereby declares, as follows, to wits 1. That public interest and necessity require the acquisition, construction and completion by the County of Butte, of a public improvement, namely a County Highway known as Mangrove Avenue, and known as Project No. 55222, in the County of Buttes, State of California. 2. That public interest and necessity require the acquisition for said improvement of the real property, or interest in the real property hereinafter described, together with all improvements situate thereon, and it is hereby found and determined that the construction of a County Highway is a public us•e, authorized by law, and that public interest and necessity require the construction of said improvements and the acquisition of said real property hereinafter described, and all improvements situate thereon.- 3. Said proposed public improvement is planned and located in a manner which wi11 be most compatible with the greatest public good and the least private injury. 4, That the County Counsel of the County of Butte is hereby authorized and empowered as followst (a) To acquire, in the name of the County of Butte, a fee simple estate or suc`~ necessary interests in and to the -1- iii hereinafter described real property,. or interest in real property, and all improvements thereon by condemnation in accordance with the provisions of the Streets and Highways Code, Code of Civil Procedure and the Constitution of the State of California, relating to eminent domain. (b) To prepare and prosecute for the County of Butte such proceedings in the proper court having jurisdiction thereof, and make such deposits from County funds for fees and costs as are necessary for such acquisition. (c) To make application to said court for an order fixing the amount of security in the was of moneys deposited as said court may direct, and for an order permitting the County of Butte to take immediate possession and use of said real property, or interests, or improvements in said real property, as a right of way for a public highway for public use. (d) To make deposit of such security out of proper funds under the control of the County of Butte, in such amounts as fixed and determined and in such manner as said court in which condemnation proceedings are pending may direct, and the Auditor is authorized to make said deposit immediately upon the court making said order. 5. The real property, or interest in real property, and/or improvements thereon, which the County of Butte is, by this Resolution, authorized to acquire for said public improve- meats in fee simple, is situate in the County of Butte, State of California, more particularly described as follows; PARCEL N®. 1s All that certain real property situate in the County o~ Butte, State of California, described as follows; The Easterly 83,5 feet of the Northerly 70 feet of -2- Lot 8 in Block 6, according to that certain map entitled "Map of the Fourteenth Subdivision of the ,John Bidwell 1.2,ancho, near Chico, Butte Co., California" which map was recorded in the office of the Recorder of the County of Butte, State of California, August 14, 1907 in Book 6 of Maps at page 68, and more particularly described as follows Beginning at a point on the Northwesterly line of said Lot 8, which is the Southeasterly line of 10th Avenue distant thereon 131.5 feet Northeasterly from the most westerly corner of said Lot 8; thence Southeasterly and parallel with the Northeasterly line of the alley through said Block, as shown on said Map, a distance of 70 feet to a point perpendicularly distant 20 feet Northwesterly from the Southeasterly line of said Lot 8; thence Northeasterly and parallel with the Southeasterly line of said Lot 8, a distance of 83.5 feet to a point in the Northeasterly line of said Lot 8, which is the Southwesterly line of Mangrove Avenue; thence Northwesterly along the Northeasterly line of said Lot 8, a distance of 70 feet to the most Northerly corner of said Lot 8; thence Southwesterly along the Northwesterly line of said Lot 8, a distance of 83.5 feet to the point of beginning. PARCEL N®. 2; All that certain real property situate in the County of Butte, .State of California, described as follows, to wit s A portion of Lots 1 and 2 of Block 15, as the same are designated and delineated on that certain map entitled "Map of the Fourteenth Subdivision of the John Bidwell Rancho, near Chico, Butte Co,, Cali~roxnia" which map was filed in the office of the County Recorder of the County of Butte, State of California, August 14, 1907 in Volume 6 of Maps, at page b8A more particularly described as followst Beginning at the Southwesterly corner of said Lot 2; thence N 29~16r58"'~ along the westerly line of said Lots 2 and 1, and along the existing right of way line of Mangrove Avenue 233.22 feet to the most Northerly corner of said Lot 1; thence S 75o28r58't E along the Northerly 1ir~ of said Lot 1, a distance of 33.25 feet; thence leaving said Northerly line S 2308'12" E, 130,73 feet; thence S 25~43r E 80.39 feet to the Southerly line of said Lot 2; thence along said Southerly line 5.00 feet to the point of beginning.
