COUNTY OF BUTTE. STATE OF CALIFORNIA RESOLUTION AND PROCLAMATION CALLING A SPECIAL ELRGTION TO DETERMINE WHETHER OR NOT THE DAYTON CEMETERY DISTRICT SHALL BE CREATED, BEING BOUNDED AND DESCRIBED AND HAVING THE NUMBER OF TRUSTEES AS SET FORTH IN THE RESOLTUION ADOPTED AND PASSED BY THE BOARD OF SUPERVISORS OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA, ON THE 23rd DAY OF APRIL, 1963, FIXING THE MANNER OF HOLDING SUCH SPECIAL ELECTION, ESTABLISHING AN ELECTION PRECINCT AND A POLLING PLACE THEREFORE, AND APPOTNTM~NT OF A BOARD OF ELECTION' AND PROVIDING FOR NOTICE THEREOF. WiIEREAS, the Board of Supervisors of the County of Butte, State of California, did on the 23rd day of April, 1963, adopt and pass a Resolution entitled ~~Resolution Adopting Boundaries of Dayton Cemetery District in the County of Butte, and Calling a Special Election to Determine Whether or not the District Shall be Created~~, which said Resolution established the boundaries of said Dayton Cemetery District, provided the number of Trustees therefor, and requested the Clerk of the Board of Supervisors to call a special election to determine whether or not said District should be formed, and WHEREAS'', the boundaries of said Dayton Cemetery District are described''as hereinafter set forth in this Resolution and Proclamation, NOW THEREFORE BE IT RESOLVED AND PROCLAIMED by the Board of Supervisors of the County of Butte, State of California, as follows: '', Section 1. That a special election be hereby called to be held on Tuesday, the 1+th day of J'tane , 1963, for the pairpose of submitting to the qualified electors of said Dayton Cemetery District, the following Measure, to wit: MEASURE'S Cemetery District, Yes / / Cemetery District, No / / -1- Section 2. That said proposed Dayton Cemetery District is in the unincorporated area of the County of Butte, and that there is hereby created a consolidated precinct for this special election to be known as ~~Dayton Cemetery District Special Election Precinct~~. That for the conduct o~ said Special Election the entire area of the Dayton Cemetery District shall constitute one voting precinct as hereinafter set forth.. Section 3. OFFICIAL BALLOT SPECIAL ELECTION DAYTON CEMETERY DISTRICT SPECIAL ELECTION PRECINCT BUTTE COUNTY, CALIFORNIA TUESDAY JUPIE ~~ ._ 1963 Ii~iSTRUCTiONS TO VOTERSt To vote on any measure, stamp a cross (X} in the voting square after the word 'YES ~ ~ or after the word "N0~-. All marks except the cross (X) are forbidden. All dis- tinguishing marks or erasures are forbidden and make the ballot void, If you wrongly stamp, tear or deface this ballot,. return it to the Inspector of Election and obtain another, On absentee voters ballots mark a cross (X) with pen or pencil. MEASURE SUBMITTED TO THE VOTE OF THE VOTERS MEASURE: Cemetery District, Yes / / Cemetery District, No / / -2- Section 4. Each voter to vote for such Measure submitted shall stamp a cross (X) in the blank space opposite the word "YES" on the ballot to the right of said measure, and to vote against such measure shall stamp a cross (X) in the blank space opposite the work "NO" on the ballot to the right of said measure. On absentee voters' ballots the c~'ass (X) may be marked with pen or pencil. Section 5. All persons qualified to vote in said Dayton Cemetery District Special Election Precinct upon the date of the election herein provided for, shall be qualified to vote upon said measure submitted at said election and it shall be the duty of the officers appointed to conduct said election to determine the eligibility of all persons seeking to emote at said election. Section 6, Said election shall be conducted and the vote thereof canvassed and the returns thereof made, and the result thereof ascertained and determined as herein provided and in all particulars as prescribed by this Resolution, said special election shall be held as provided for by law for the holding of such elections in the County of Butte,. State of California, and said election shall be held in all respects as nearly as practicable in conformity with the general election law. Section 7. The polls at the polling place hereinafter designated shall be opened at 8 o'clock a.m. of said election day and shall be kept open continuously thereafter until 7 o'clock p.m, of said day of election except as provided in the Erection Code, and the election officers shall there- upon proceed to canvass the ballots cast thereat. -3_ . Section 8. For the conduct of said elections the said Dayton Cemetery District Special Election Precinct shall constitute one voting precinet~ and the composite boundaries of which .are hereinafter described and shall be designated as Dayton Cemetery District Special Election Precinct. The returns of said election shall be made out and signed by the election officers and shall be by them deposited with the County Clerk, together with the ballots east at said elections and the vots thereof canvassed and the returns thereof made, and the results thereof ascertained and determined by the Board of Supervisors.- Section 10. If two thirds (2/3) or more of the votes are cast in favor of the formation of the District, the Board of Supervisors shall proceed with the organization of said -4-- District. Section 11. That said Board of Supervisors does hereby offer a reward of $100.00 for the arrest and conviction of any person who violates any of the provisions of .the Election Code; the rewards to be paid until the total amount hereinafter expended for the purpose reaches the svm of $10,000.00. Section 12, The County Clerk of the County of Butte is hereby directed to give notice of this special election as required by law, and to mail with the regular mailing of ballots to all electors in Dayton Cemetery District Precinct, a sample of the separate ballot for this special election and a notice substantially in the following forms NOTICE BY GOUNTX CLERK OF SPECIAL ELECTION IN DAYTON CEMETERY DISTRICT PRECINCT PURSUANT TO THE PROVISIONS OF DIVISION 12 OF THE ELECTIONS CODE AND PART 4 OF DIVISION 8 OF THE HEALTH AND SAFETY CODE. A card containing a summary of this notice of Special Election shall be mailed by the County Clerk to all electors within the following Butte County precincts; Durham 1, ~, 3, and 5, Dayton, Rosedale ~. and ~ The boundaries of which do not coincide with the boundaries of the Dayton Cemetery District Special Election Precinct, which Special Election Precinct is described as follows: Beginning at the intersection of the east and west centerline of Section 17, T21N, R2E,~ MDB&M, with the west levee of Butte Creek; thence southerly along said levee, to the centerline of Midway; thence northerly along said 1im:e to the centerline of White Drive; thence westerly along said line to the centerline of the Durham- Nelson Road; thence southerly along said line to the centerline of Pratt Grant Road; thence westerly along said line to the centerline of the Chico-Butte City Highway; thence northerly and northeasterly along said line to the north and south cent~l.ine of Sections 31, 30, 19 and 18, T21N, R1Es as projected into the Rancho -5- de Farwell; thence northerly along said line to the center of Edgar Slough; thence northeasterly up and along the center of Edgar Slough to the centerline of Crouch Avenue; thence southeasterly along said line to the centerline of Lone Pine Avenue; thence northeasterly along said line to the centerline of Elk Avenue; thence southeasterly along said line to the centerline of Chico-Butte City Highway; thence along said line to the centerline of Hegan Lane; thence easterly along said line to the centerline of Fimple Road; thence south- easterly along said line to the westerly line of Section 14, T21N, R1E; thence southerly along said line to the southwest corner of said Section 14; thence easterly along Section lines to the centerline of the Sathern Pacific Railroad; thence southeasterly along said line to the centerline of Midway; thence northeasterly along said line to the extension northerly of the easterly line of the A. F. Jones Subdivision of the Ferson Farm; thence southerly along said line to the east and west centerline of Section 18 and 17 of T21N, R2E; thence easterly along said line to the point of beginning. Polling placet_ Odd FP1lcrws Rniid~-nR Midway - Durham PURPOSE OF ELEGTIONz The puxpose of the election is to submit the measure hereinabove set forth to the qualified electors within said Dayton Cemetery District Special Election Precinct. Only qualified voters residing in Dayton Cemetery Distract Special Election Precinct, as described above, are entitled to vote at this election. A map of said District will be at the polling place. Section 13. Copies of the Resolution entitled~~Resolution Adopting Boundaries of Dayton Cemetery District in the County of Butte, and Calling a Special Election to Determine Whether or not the District Shall be Created~~, are on file in the County Clerk's Office in the Courthouse, Oroville, California, where they may be examined by any interested person. -6- Section 14.^ All resolutions and parts of resolutions of the Board of Supervisors of the County of Butte, State of California, in conflict herewith are hereby rescinded and repealed. Section 15. This Resolution being a Resolution calling and ordering a special election shall take effect immediately upon its passage and approval.
