RESOLUTION No. 63-60
A RESOLUTION DETERMINING TO UNDERTAKE PROCEEDINGS PURStTANT
TO SPECIAL ASSESSMENT AND ASSESSMENT BOND ACTS FOR THE
ACC~UISITION AND CONSTRUCTION OIi IMPROVEMENTS WITHOUT
PROCEEDINGS UNDER DIVISION 4 OF THE STREETS AND HIGHWAYS
CODE
SIERRA DEL ORO, UNIT N0. 1
RESOLVED, by the Board of Supervisors of the County of Butte,
California, that
1•JH:EREAS, a written petition for undertaking proceedings pursuant
to special assessment and assessment bond acts, and to assess the cost
thereof upon the properties benefited by said acquisitions and improve-
ments, and waiving proceedings under Division 4 of the Streets and High-
ways Code, has been filed with the County Clerk of said County for the
acquisitions and improvements hereinafter described;
?r~1H~REAS, the costs and expenses of said contemplated acquisitions
and .improvements are to be chargeable upon an assessment district, the
exterior boundaries of which are the coterminous exterior boundaries
of the composite and consolidated area shown on the map thereof on file
in the office of the County Clerk which indicates by a boundary line the
extent of the territory included in the proposed district and which shall
govern for all details as to the extent of the assessment district;
WHEREAS, the public interest and convenience will be served by
the taking of said proceedings; and
WHEREAS, said~acquisitioi~s and improvements are more particularly
described, as follows:
{a) The improving of Magnolia Drive, Pinewood Drive, Magalia
Drive and Imperial Way for their entire lengths and widths within
Sierra Del Oro Unit No. 1 and Rosewood Drive from Northwood Drive
to Skyway by grading and the construction therein of untreated rock
base and double seal coat asphalt paving within Sierra Del Oro
Unit No. 1 and Rosewood Drive and storm drains and appurtenances
thereto.
{b) The acquisition of twelve-foot drainage easements between
Lots 13 and 14, 27 and 28, 55 and 56, 69 and 7a; 93 and 94, 34 and
3~; 48 and 4g; and across Lots 112, 113 and 114.
{c) The construction of all work and improvements and the
acquisition of all lands and easements auxiliary to any of the above
and necessary to complete the same.

NOW, THEREFORE, TT IS HEREBY FOUND, DETERMINED and ORDERED that
all of the ovmers of more than 60% in area of the property subject to
assessment for said proposed (acquisitions and' improvements have filed
with the County Clerk of this County a written petition for the con-
struction of improvements pursuant to appropriate special assessment
and assessment bond acts, without further compliance with the provisions
of Division 4 of the Streets and Highways Code.
TT TS FUR'T'HER FOUND, DETERMINED and ORDERED that said proceedings
for the acquisition and construction of said improvements shall be had
pursuant to the Improvement Act of 1911, and the bonds upon the unpaid
assessments thereof sha11 be issued pursuant to said Improvement Act
of lg 11 .
IT TS FURTHER FOUND, DETERMINED and ORDERED that the provisions
of Division 4 of the Streets and Highways Code be, and they are hereby,
dispe~-used with.
PASSED AND ADOPTED by the Board of Supervisors of the County
of Butte, California, on this ~'!th day of June ,
