BOARD OF SUPERVISORS
COUNTY OF BUTTE, BTATE OF CALIFORNIA
RESOLUTION AND ORDER VACATING PUBLIC UTILITY
EASEMENT IN ACCORDANCE 'WITH SECTION 50443 OF
THE GOVERNMENT CODE
W~TEREAS, the owners of the property located in Park Estates
Subdivision-have requested the vacation and abandonment of the
public utility easement hereinafter described, and
~lHEREAS, the Notice of Intention to Vacate County Easement i
was duly published anal posted, and hearing was duly held on
June 25, 1963, at the hour of 11 o'clock A. M., and no person
appearing to ob3ect to the same, and
`WHEREAS, Pacific Gas and Electric Company and Pacific
Telephone Company have indicated that they are not now, nor do
they in the future, intend toile said public utility easement, and
~iEREAS, the Planning Commission of the County of Butte,
to which said petition was referred, has recommended the
vacation and abandonment of said easement, and
1~HEREAS, said easement was established and dedicated on
April 20, 1962, by recordation of that certain subdivision
entitled e1Park Estates Subdivision°~ in Book 24 of Maps, at pages
35 and 36, Records of the County of Butte, and the easement was
not used continuously since that date.
NOW THEREFORE BE IT RESOLVED AND ORDERED by the BOARD OF
SUPERVISORS OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA, as follows:
to That the hereinafter described public utility easement
was not used continuously since the date of its dedication and
that said easment is unnecessary for present or prospective
public use.
2, That said public utility easement as hereinafter

described is hexeby abandoned and vacatedo
3. That said public utility easement is situated'',in the
County of Butte, State of California, and described as follows,
to wits
Those certain easements designated 12.00 foot ',public
utility easements along the back and side lines of
certain lots shown on that certain map entitled,
"Park Estates Subdivision°', which map was recorded in
the office of the Recorder of the County of Butte,
State of Californian on.P,pr31 20, 1962, in Map Book 24
at Pages 35 and 36, said easements more particularly
described as follows;
Easement No, is That certain 12.00 foot wide public
utility easement running along the Northerly,',or rear
line of Lots 11, 12, 13 and 14, along the Easterly or
rear line of Lots 8, 9, 10 and 11, and along the
Southerly or side line of Lot 8 all as shown on said
Park Estates subdivision map.
Easement No. 2s That certain 12.00 foot wide '', public
utility easement running along the rear or back line
of Lots 2~ 3, 4, 5, 6 and 7, and being the rear or
Easterly 6.00 feet of Lots 2, 3 and 4, and the rear or
Westerly 6000 feet of Lots 5, 6 and 7, all as '; shown on
said Park Estates Subdivision map.
Easement No. 3t A portion of that certain 12000 foot
public utility easement running along the side line, or
Southwesterly line of Lot 1, along the rear or South
easterly line of Lot 1, and along':: the side line or
Southeasterly line of Lot 7, all as shown on said
Park Estates Subdivision map, described as fo7.lows:
Beginning at a point on the Southwesterly Line of said
Lot 1, distant South 3957' East, 25x00 feet from the
most'Aesterly corner of said Lot i; thence South 39°57'
East, 115.00 feet along the Southwesterly line of said
Lot 1 to the most Southerly corner of .said Lot l; thence
North 50p30' East, 293.00 feet along the Southeasterly
line of said Lots 1 and 7; thence at right angles,
North 39°30'`Taest, 12.00 feet; thence South 50°30' Aest
281.00 feet? more or less, parallel with the South
easterly line of said Lots 1 and 7 to a point''distant
12.00 feet measured at right angles from the South
westerly line of said Lot 1; thence North 39°57' West,
103.00 feet, more or less, parallel to and distant
12.00 feet from the Southwesterly line of said Lot 1 to
a point distant North 50°03' East, 12.00 feet',from the
Point of Beginning, thence South 50°03' ~7est,L12.00
feet to the Point of Beginningo
4. That this Order of Abandonment and Vacation of Public
Utility Easement is made in accordance with Section 50443 of the

Government Code and the Clerk of this Board, in accordance with
Section 50445 of said Code, shall cause a Certified copy of this
Order, attested by said Clerk under seal, to be recorded in the
Office of the Recorder of the County of Butte.
THE FOREGOING Resolution and Order was duly PASSED ,AND
ADOPTED at the regular meeting of the Board of Supervisors of
the County of Butte, State of California, on the 25th day of
June, 1963, by the following votes
