BOARD OF SUPERVISORS
COUNTY OF BUTTE, ST~,TE OF CALIFORNIA
RESOLUTION URGING THE ADOPTION BY CONGRESS OF
THE UNITED STATES, OF SENATE .BILL 1275 REGARDING
FEDERALwSTATE CONFLICT OVER CATER RIGHTS
7~3'HEREAS, this Board is of the opinion that a Federal••State
conflict exists with respect to water rights in the ~Testern States,
and
1~iEREAS, this Board believes that said conflict is prejudicing
the rights of the water users of this State and is creating
uncertanties in the law which will prevent the most beneficial use
of the water resources of this State and Nation, and
TnfEIEREAS, this Board has been advised and believes that the
legal theories proposed and advanced by attorneys representing the
United States Government in certain recent legal disgutes would be
most harmful to local interests and to the Nation as a ale if
accepted as law, and
AHEREAS~, certain agencies of the Federal Government refuse
to acknowledge State control of water resources despite the fact
that Congress has, on several occasions passed laws which recognize
the authority of the States to regulate and control the use of
water, and
"AHEREAS,. this Board believes that water law is real property
law, and that real property law is a mattEr for local* not Federal,
control.
NOW, THEREFORE, BE IT RESOLVED by the BOARD OF SUPERVISORS OF
THE COUNTY OF BUTTE, STATE OF CALIFORNIA, that said Board hereby
expresses its support for Senate Bill 1275 and urges its adoption
by the Congress of the United States.

BE IT FURTHER RESOLVED by said Board, that the County Clerk
of the County of Butte is authorized and directed to send copies
of this Resolution, duly certified, to the President of the United

States; the Vice President of the United States; the Speaker of
the House of Representatives; the Secretary of the Interior of
the United States; United States Senator Clair Engle; United States
Senator Thomas H. Kuchel; Congressman Harold To Johnson and to
such other and further individuals as the Chairman of this Board
may deem advisableo
