HomeMy WebLinkAbout63-091RESOLUTION N0. 63-91 BOARD OF SUPERVISORS COUNTY OF BUTTE, STATE OF CALIFORNIA RESOLUTION AUTHORIZING EXECUTION OF DEED WHEREAS, on Tuesday, the 12th day of March, 1963, pursuant to Notice duly and properly given, bids were opened for the purchase of property commonly known as the Montgomery Street Property; and WHEREAS, the Shell Oil Company was the successful bidder;_and WHEREAS, all of the conditions contained in said Notice of Intention to Sell have been performed; NOW THEREFORE, BE IT RESOLVED by the BOARD OF SUPERVISORS of the County of Butte, State of California, that the Chairman of said Board be, and he is hereby authorized to execute the Deed from the County of Butte to Shell Oil Company for the following described property: PARCEL ONE: A portion of Section 18, Township 19 North, Range 4 East, M.D.B.&M., more particularly described as follows: Commencing at the intersection of the northerly line of Montgomery Street with the~Westerly line of Marysville Road; thence South 4° 04' 35" West along said Westerly line, 163.15 feet to the true point of beginning for the parcel of land described herein; thence North 78° 00' 27" West, 76.04 feet; thence South 66° 53' S2" West, 23$.12 feet to a point on the Easterly line of the land described in that certain deed from the County of Butte to -Otto A. Peter, dated June 30, 1924 and recorded February 26, 1929 in Book "24" of Official Records, page 44b, records of Butte County, California; thence along the easterly line of said Peter parcel, as follows: South 8° 39' 25 " East, 475.11 feet and North 66° 04' 35" East, 206.47 feet, to a point on the. Westerly line of Marysville Road; thence North 4° 04' 35" East along the Westerly line of said Marysville Road, a distance of 463.14 feet to the true point of beginning. PARCEL TWO: The right of access over and across a portion of the right-of-way line between the land described as Parcel 1 above and Montgomery Street, a Public Roadway, said ~1- right-of-way is described as follows: BEGINNING at a point distant N. 66° 53' 52" E. 33.40 feet from the Southwest corner of that certain parcel of land acquired by the State of California, by Deed dated April 10, 1961, recorded June 12, 1961, in Book "1120" at page 504, Official Records of Butte County, said point also being distant S. 80° 58' 25" E, 626,53 feet from the "B2" line at Engineer's Station "B2" 32-X11.96 of the Department of Public Works' 1956 Survey from Oroville to Jarbo Gap, road III-But-2l-Ovl, B; THENCE from said point of beginning along the Southerly line of said Parcel, N. 66° 53' S2" E. 204.72 feet; thence S 78° 00' 27" E. 7b,04 feet to a point that is 875033 feet Southeasterly, measured at right angles from the "B2" line at Engineer's Station "B2" 33+15.43 of said survey. PASSED AND ADOPTED by the BOARD OF' SiJPERVISORS of the County of Butte, State of California, this 6th day of August, 1963, by the following vote: AYES: 'Supervisors Alldredge, Giles, McKillop, I'ryde and Chairman Steinegger NOES: None ABSENT: None Emil G.
