HomeMy WebLinkAbout631ORDINI~NCE NO.. 631 AN ORDINANCE GOVERNING THE USES OF LAND AND CONSTRUCTION AND USES OF BUILDINGS ALONG THE SCENIC HIGHWAYS THE COUNTY OF BUTTE of The Board of Supervisors of the County of .Butte, State of California ~ does ordain as follows: SECTION. 1. For the purpose of promoting the public health,. safety and general wa~.fare, and more particularly for the purpose of preventing the creation of traffic hasards, promoting the prosperity of the people of the County of Butte, conserving land values along the Scenic High- ways, promoting the comfort and happiness of the people of the County of Butte, fostering pride in and attachment to the said County, and promot- ing the public tranquility and good order thereof, preserving and en- hancing the public scenic and aesthetic values, the Board of Supervisors of the County of Butte does hereby ordain and set forth an "S-H" (Scenic Highway) District and the following regulations established to govern the-uses of land and the construction and uses of buildings slang the Scenic Highways. SECTION 2. The provisions of an "S-H" (Scenic Highway) District shall apply to all property lying on each side and within five hundred (500) feet from the centerline of the following highways: a. State Sign Route 32, Chico: From Fir Street easterly to the Butte County Line; b. U.S. Highway ~.OA, Oroville: From Wiekts Corner northeasterly to the Butte County Lane; and c. U.S. Highway 1~OA, Oroville: From Canyon Highlands Drive Overcrossing easterly to the first bridge across the Feather River. SECTION 3. REGULATIONS The following regulations shall apply in an "S-H" District: 3.1 Uses Permitted: a. Lawful uses of land now established. b. Residential dwellings and accessory buildings. c. Agricultural uses and buildings. d. The following upon the securing of ~ Use Permit in each case: 1) Schools, churches, public utility buildings and structures, roadside stands for the salt of produce from the land fronting the highw'a~r within the district, ~ 3/ 3.2 Additional Uses Permitted: Certain additional uses are permitted upon the securing of a Use Permit in each case; said uses are highwap services primarily for the convenience of the traveling public, and including: a. Gasoline service stations. b. Restaurants c. Motels and Trailer Courts d. Public and quasi-public buildings and professional buildings e. Signs, billboards or advertising displays within three (3) miles from the present City Limits SECTION 1,.. ADDITIONAL REGULATIONS t~.l The following regulations shall apply in all parts of said district: a. No build~.ng or structure shall hereafter be located- within the district closer than fifty (50) feet from the right-of~-way of said highwap. b, Building Side Area: The building site ax°ea shall be the same as provided in the County Subdivision Ordinance. c. No signs, billboards or advertising displays shall be erected within the district e?~cept signs advex°tis- ing only the sale or lease of land upon which sign is placed, or the products grown or raised upon such property, and established or permitted uses on such property. d. Off-street Parking: Off-street parking area shall be as required by the Planning Commission. ~..2 Signs; billboards or advertising displays, except as pro- vided in Section 3.2, shall be permitted only to permitted uses, not to exceed forty (Ir,O) square feet in area and shall be pertinent to the permitted uses. SECTION 5. Use Permits: The application and procedure for Use Per- mits shall be as provided by the Butte County Zoning Er~ahling Ordinance. SECTION 6. All uses of land within the district not specifically authorized and permitted are prohibited. SECTION 7. The penalties for any violation of the zoning hereby imposed within the district shall be as provided in the Zoning Enabling Ordinance. In compliance with the provisions of the Zoning Enabling Ordinance, this Ordinance shall from and after its effective date be- come a supplement to and part of the Zoning Enabling Ordinance. -2- SECTION $. This Ordinance shall be and it is hereby declared to be ~.n full force and effect from and"after thirty (30) days-after the dale of its passage and before the expiration of fifteen (15) days after its passage, this Ordinance shall be published once with the names of the memt3aers voting for and against, in the Orovil.le Mercury ~ a news~baper published in the County of Butte, State of California.
