HomeMy WebLinkAbout63-100RESOLUTION OF IA'TENTION N0. h3-100 IN THE t~iATTYR Orr' THE COIvSTRUCTIO'~ OF CL1tTAIN 1NiPROVEMENTS AND AkPURTENANCES 1N C01.'LE`Z zaClt~S ~iSSESSMENT DISTRICT, COUNTY OF BUTTE STATE OF CF:LYr O~w:NIt: BE IT RESOLVED by the Board of Supervisors of the County of Butte, State of California, that i4 is the intention of the said Board of Supervisors to order the following work to be done and improvements to be made under the provisions of Division 7 of the Streets and I?ighways Gode of the State of California (Improve- ment Act of 1911} , to Gait: Improvement of fu11 length and c-x_tent of Fairhill Drive, Loma Vista Drive, sndora Circle, Heather Circle, Deerwoad Drive, L~;unter Drive, Melrose Drive, Morrell Circle and Foothill Bcu'_evard, within the boundary of Copley Acres Subdivision, by constructing gravel base pavements wits. asphaltic surface and road- side gutters, surface and underground drainage facili- ties with necessary appurtenances, caster mains and canter services and appurtenances, fire hydrants, road excavation and removing t'aerefrom and disposing of all refuse and surplus materials. Construction of water mains and necessary appurtenances in the following locations: EAS~~ieENT N0. 1 A strip of land 10.00 feet in width and being the westerly IO.GO feet of the Easterly 18 feet of Lot 315 as shown an that certain map entitlad, "0-fficial Map of Oroville Wyan- dotte Fruit Lands, Unit 'ivo. 6`°, which map was filed in the office of the Recorder of the County of Butte, State of California, on March. 8, 1929, in Map Boolc 10 at Pages 3A, 4A and 5A, said 10.00 foot strip being parallel to the Easterly line of said Lot 315. EASEMENT NO, 2 A strip o~land 10.00 Legit in caidth -running through a portion of the East half of the L:,ast half of Section 22, Toonship 19 North, Range 4 East, h:. D.B. & M., and more particularly described as gallows: ]3e~inning at a point on the D:o•rth line of said Section 22; distant South 89045° West, 355.53 feet from the Northeast corner of said Section 22; thence from said Point o= Begin- ning, following along the centerline of said 10.00 foot wide easement, South 12o59s East, 671.34 feet and South 677.09 feet to the point on the Northerly boundary of Copley Acres Subdivision, as shown an the filed map thereof, recorded on the 1st day of 9ugust 1963, in Map Book: 30 at Pa~es 38,'39 and 40 , said point being distant South 89x59 57'°C~Test, 191.47 feet from the Northeast corner of said Copley Acres Subdivision, said point also being the end of the easement herein described. D AUG ~ 31~6~ - 1 T ~ESSIE A©GE~S, Cognty Clerk ,FEEpK OF 7HE 'BOIINIIaF E ~"D ._...... .... ~ 8y _ ...._........_ .. ~~~~ BE IT F1IRTHER RESOLVED that said improvements be constructed in said streets, avenues, roads, lanes, courts, places, and/or public ways hereinabove described and in the particular locations set forth and shown on the plans and specifications on file in ' the office of the County Clerk of the County of Butte; together with the construction of all appurtenances thereto, including necessary fittings, trenchings, grading and regrading, excavation and fill, removal of obstructions, connections to existing services, back filling, reconstruction of existing ground surface as required to conditions existing prior to commencement of construction, all in the particular locations as the same are shown on the plans and specifications on file in the office of the County Clerk of the City of Butte. That the location of the works to be constructed pursuant to this Resolution of Intention is shown upon the plans and specifi- cations which are on file in the office of the County Clerk of the , County of Butte, and said plans and specifications are referred to for the specific locations of the works and structures to be con- structed. That the structures and work and improvements herein des- cribed are to be constructed to the grades and sub-grades and eleva- Lions which are shown upon the plans and specifications which are on file in the office of the County Clerk of the County of Butte. A11 of the work will be done to said lines and grades. All of said work shall include, without duplication, any and all streets, intersections, terminations and opposite termina- tions occurring within the limitations of said work. The attention of all persons is directed to the fact that all of said classes of work above described may not be constructed upon all of the streets and/or public ways above described in their entirety, but only upon the particular locations as shown on the plans and specifications hereinabove referred to, to which the attention of all persons is directed for a description of the work, location of the several classes of work, a description of the classes - 2 - of work to be done upon each of the several public streets or rights of way named, a description of the streets and rights of way, and for all other information contained in the said plans and specifications hereinabove referred to pertinent to the doing - and completion of the work and improvements herein proposed; and WHEREAS, said contemplated work and improvements, in the opinion of this Board of Supervisors of the County of Butte, is of more than local or ordinary benefit, said Board of Supervisors hereby makes the expenses and costs of said work and. improvements chargeable upon a district, which said district said Board of Supervisors hereby declares to be the district benefited by the work and improvements herein described; said district shall include that territory in the County of Butte, State of California, which is shown on that certain plat or map on file in the office of the County Clerk of the County of Butte, and which is entitled and described, "Map Showing Boundaries of Proposed District to be Assessed for Improvements in Copley Acres Assessment District, County of Butte, State of California", and which said map or plat indicates by a boundary line, the extent of the territory included in the proposed district and covers all details as to the extent of the territory included in the proposed district and covers ail details as to the extent of the area to be assessed; said map or plat is, by thhs reference, incorporated herein and made a part hereof. Excepting from the area shown and delineated on said map or plat, hereinabove referred to, the area of all public streets, avenues, lanes, roads, drives, courts, places, public parks, and a1I easements and rights of way therein contained belonging to the public, and alsp excepting from the area shown, and delineated on said map all property owned by the United States of America, the State of Cali- fornia, the County of Butte, and any other public agent mandatory of the Government, school board, educational, penal or reform in- stitution or institution for the feebleminded or the insane which is in use in the performance of a public function, and also specifi- ca11y excepting therefrom any property belonging to the United States _ 3 _ of America of the State of California, whether in use in the perform- ance of a public function or otherwise. NOTICE TS HEREBY GIVEN that serial bonds shall be issued in the manner and form provided in Part 5, Division 7, of the Streets and Highways Code of the State of California (Improvement Act of 1911) to represent unpaid assessment of Fifty Dollars ($50.00) or over, which said bonds shall bear interest at the rate of six per cent (6%) per annum and the last installment of which bonds shall mature fourteen (14) years from the 2nd day of~January next succeeding the next September 1st following their date. Said bonds shall be payable to bearer, and may be redeemed as provided in the Improvement Act of 1911, and there shall be added to the redemption clause in said bonds the following words: ..together with a premium of 5 per cent of said unpaid principal," NOTICE IS HEREBY GIVEN that the total estimated cost of the entire project and the total estimated amount to be assessed upon the properties benefited is the sum of $224,400.00. NOTICE IS HEREBY GIVEN that on Tuesday, the 10th day of September, 1903, at the hour of t~.of said day, at the meeting place of the Board of Supervisors of the County of Butte, California, any and all persons having any objections to the grades to which said work is proposed to be done or to the boundaries of the district proposed to be assessed to pay the cost and expenses of said work, may appear before said Board of Supervisors of the County of Butte and show cause why said improvements should not be carried out in accordance with this Resolution of Intention, and may present written protest not later than the hour hereinabove set for heaxing against the doing of said work, the grades to which said work is to be done, or the extent of the territory to be assessed to pay the cost and expenses thereof. NOTICE TS HEREBY FURTHER GIVEN that the owners of more than sixty per cent (60%) of the area of property within the above de- scribed district to be assessed to pay for the cost and expenses - 4 - of said work have petitioned this Board of Supervisors for the doing and performance of said work and that therefore the Special Assessment Tnvestigation, Limitation and Majority Protest Act of 1931 does not apply to these proceedings. The County Clerk of the County of Butte shall cause this Resolution of Intention to be published twice in the OR4VILLE MERCIIRY, a daily newspaper of general circulation published and circulated in the County of Butte, which said newspaper is hereby designated as the newspaper in which shall be printed and published all notices, resolutions, oxders and other matters required to be published in the proceedings taken pursuant to this Resolution of Intention and under the provisions of the said "Improvement Act of 1911" and amendments thereto; the first publication of said notice shall be not less than ten (10) days prior to the date herein fixed for hearing on this Resolution of Intention. The Engineer of TnTOrk shall cause to be conspicuously posted along the line of said contemplated work and improvement, and on all the open streets within the Assessment District, notice of the passage of this Resolution of Intention in the time, form and manner required by law. Breference to labor shall be given only in the manner pro- vided by law. Veterans and resident local labor shall be given preference by the Contractor wherever possible, if skill and work- ing ability permit without increasing the ultimate cost of the work and improvement to the County of Butte and its officers. All proposals or bids shall be accompanied by a check payable to said County of Butte and certified by a responsible bank for an amount which shall not be less than ten per cent (10%) of the aggre- gate of the proposal or by a bond for said amount and so payable, signed by the bidder and two sureties who shall justify, before any officer competent to administer an oath, in double the said amount and over and above all statutory exemptions, or by a corporate surety bond in said amount satisfactory to the Superintendent of Streets. Said proposals or bids shall be delivered to the County Clezit J D of the County of Butte on or before 10:45 o'clock A.M. of the 3~& day of September, 19b3, at the office of said County Clerk in the Butte County Courthouse, Oroville, California, and the hour of 11:00 o'clock A.M, at said place and said day is hereby fixed as the time and place of a public meeting at which said bids will be publicly opened, examined and declared by the County Cle~c of the County of Butte. Said bids, after being publicly opened, examined and declared, will be calculated by the Engineer of Work, his report returned to the County Clerk, and the report of the results of the bidding and the calculation of the Engineer of Work will be reported to the Board of Supervisors of the County of Butte at the next regular meeting thereof The Board of Supervisors reserves the right to reject any and all proposals or bids should it deem this necessary for the public gaol, and also the bid of any bidder who has been delinquent or unfaithful in ar~y former contract, with the County of Butte. ~,~ r Plans and specifications may be obtained at the office of the Engineer of Worlc, Walter B. Grimes, located at 1338 Mangrove Avenue in the City of Chico, California. A deposit of Ten Dollars ($10.00) will be required for each set of plans and specifications, refundable upon return of said plans and specifications within ` 30 days after opening of bids. The legal opinion of Sturgis, Den-Dulk, Douglass & Anderson, of Oakland, California, will be furnished at no expense to the contractor, certifying as to the validity of the contract, assess- ment, warrant, diagram and bonds.
