3 COUNTY OF BUTTE, STATE OF CALIFORNIA
4 RESOLUTION ESTABLISHING COUNTY SERVICE AREA
TO BE ENTITLED "COUNTY SERVICE AREA NO. 5."

6 WHEREAS, heretofore, on the 30th day of July, 1963, the
7 BOARD OF SUPERVISORS of the COUNTY' OF BU'T`TE, State of California,
$ adopted and passed a Resolution of Notice of Intention to
9 establish a county service area to be entitled "COUNTY SERVICE
10 AREA NO. 5"; and
I1 WHEREAS, said Resolution fixed the 20th day of August,
12 1963, at 11:00 o'clock a.m. of said day, in the Board of Superviso
13 .Room of the Butte County Courthouse, in the City of Oroville,
14 State of California, as tk~e time and place for the public hearing
15 on the establishment of said area; and
16 WHEREAS, said Board, at said time and place, proceeded
17 to hear arguments both for and against the establishment of said
18 area; and
19 WHEREAS, no written protests against the establishment
20 thereof were filed in accordance with Section 25210.17 of the
21 Government Code;
22 NOW, THEREFORE, BE IT RESOLVED by the BOARD OF
23 SUPERVISORS of the COUNTY OF BUTTE, State of California, as
24 follows:
25 1. That said Board hereby finds and determines that
26 proceedings herein were conducted pursuant to Section 25210.1
27 et seg. of the Government Code, and that publication and notices
2S were given pursuant thereto, and that said Board finds and
29 determines that the extent to which the services described in
the Re.s.olution of Intention are extended county services;

2. That said Board hereby determines to establish said

32 county service area.

1 3. That the boundaries of said service area are hereby
2 finally determined and established as the same as are shown on
3 Exhibit A, attached hereto, entitled "Description of the
4 Boundaries of County Service Area No. 5", said Exhibit is
5 incorporated herein by reference and made a part of this
6 resoluti:an.
7 4. That the name of said service area so established
8 is "COUNTY SERVICE AREA NO. 5."
9 5. That the type of extended county services to be
10 provided within said area is street lighting.
11 6. That a tax sufficient to pay for all such services
],2 which are furnished on an extended basis shall be annually
13 levied upon all taxable property within said area.
14 7. That said county service area is established for all
15 purposes subject only to compliance with the requirements of
16 Chapter 8, Part 1, Division 2, Title 5 of the Government Code
17 and subject to the provisions of Article 2.5, Chapter 2.2,
lg Part 2, Division 2, Title 3 of the Government Code of the
i9 State of California.
g0 PASSED AND ADOPTED by the BOARD OF SUPERVISORS of the
21 County of Butte, State of California, this 20th day of August,
22 1963, by the following vote:

Description of the Boundaries of COUNTY
SERVICE AREA NO. 5
All that certain real property situate in the County df
Butte, State of California, described as Follows:
PARCEL I
All that portion as shown on that certain map entitled
"Town of Richvale" filed in Book 6 of Maps, Page 53,
Butte County Records, and more particularly described as
follows:
BEGINNING at the southeast corner of Lot 461 of
said Town of Richvale; thence North 89° 13' 00"
West, 1240.00 feet to the Southwest corner of-Lot
426, said point being also the Southwest corner
of that certain subdivision entitled "Thengvall
Tract Unit 1" filed in Book 30 of Maps, Page 11,
Butte County Records; thence Northerly along the
Westerly boundary of said Thengvall Tract and its
projection, North 00° 36' 00" East, 369.00 feet;
thence South 89° 13' 00" East, 180.00 feet to the
Northwest corner of Lot 12 of said Thengvall Tract;
thence South 77° 34' 07" East, 267.46 feet to the
Northwest corner of Lot 15 of said Thengvall Tract;
thence South 89° 13' 00" East, 266.00 feet to the
Northwest corner of Lot 1S of said Thengvall Tract;
thence North 75° Ol' 00" East, 70.00 feet to a
point on the Westerly right of way of Park Way as
shown in said Thengvall Tract; thence North 14° 59'
00" West, 4.93 feet; thence North 75° Ol' 00"
East, 180.00 feet to the Northeast corner of Lot
19 of said Thengvall Tract; thence South 14° 59' 00"
East, 91.99 feet to the Northwest corner of Lot 22
of said Thengvall Tract; thence North 75" OZ' 00"
East, 200.00 feet to the Northeast corner of said
Lot 22, said point is on the Westerly right of way
of Midway Drive; thence Southeasterly along said
right of way, South 14° 59' 00" East, 280.59 feet;
thence South 00° 36' 00" West, 83.46 feet to the
point of beginning.
PARCEL II
The Southerly 65 feet of Lot 150 and the Northerly
85 feet of Lots 420, 421, 422, 423, 424 and 425 as
shown on Map entitled, "Town of Richvale," which map
was filed in the office of the Recorder of the County
of Butte, State of .California, January 17, 1910 in
Book "6" of Maps, at page 53.
PARCEL III
The North 15 feet of Lot 150 and the South half of
Lot 343 according to map entitled "Town of Richvale,
which map was filed in the office of the Recorder
of the County of Butte, State of California,
January 17, 1910 in Map Book "6" at page 53.
EXCEPTING THEREFROM the strip of land heretofore
conveyed to Drainage District No. 100 of Butte
County by deed dated June 29, 1918 and recorded
July 10, 1918 in Book "170" of Deeds, at page
313, records of Butte County, California.
