HomeMy WebLinkAbout63-110!z i2 ;; I i3 .4 ii '5 '8 ~7 8 i'9 10 11 12 ,. 13 ~4 l5 18 I 17 18 T9 20 '; 21 22 i 23 24 25 26 27 28 ~! 129 30 31 32 RESOLUTION No. 63-11.0 BOARD OF SUPERVISORS COUNTY OF BUTTE STATE OF CALIFORNIA RESOLUTION DECLARING POLICY OF THE BUTTE COUNTY E30SPITAL WHEREAS$ the Assembly of the State of California on the 20th day of May, 1963 passed Assembly Bill No. 59; and WI~EREAS~, the Governor of the State of California on May 21, 1963 signed said Assembly Bill; and WEiEREASr said Assembly Bi11, was enacted as an emergency measure within the meaning of Article IV, of the Constitution of the State of California; and WHEREASp said Assembly $ill added Section 462 to the Welfare and Institutions Code of the State of California, as folhows~ and; The cost of hospitalization furnished by a county to a recipient on or after the effective date of this section, and any judgment obtained by a county against the recipient to obtain re- payment of such costs, shall not constitute a lien against the real property of such recipient and no lien shall be taken therefor. WEiEREASt said Assembly Bill No. 59 added Section 2600.5 to the Welfare and Institutions Code, as follows: The policies established under Section 2600 shall not deny needed care in a county hospital, or contract hospital as defined in Section 4701 of this Code, to any person who meets the eligibility requirements for medical assistance for the aged under the provisions of Chapter 1 commencing with Section 4700) of Part 4 of Division 5, and shad not require the application of any property of such a person to his support or the ta7cing of any lien upon that property. NOWT THEREFOREt BE IT RESOLVED by the Board of Supervisors of the County of Butte, State of California, as follows c 1. Aid to Needy Blind c. Aid to Needy Disabled d. Medical Assistance for the Aged shall not be required to give liens to the County of Butte provided they qualify for the afore mentioned programs. 2. Persons needing care in a county hospital, or a contract hospital, who meet the eligibility requirements for medical assistance for the aged (as provided in Chapter 1, commencing with Section 4700 of the GYelfare and Institutions Code of the Sta~:e of California} shall not be required to grant a lien upon their real property to the County of Butte, 3. Nor shall any person be denied emergency medical or hospital care pending his giving security for reimbursement to the County of Butte for the care or hospitalization of that person.
