BOARD OF SUPERVISORS
COUNTY OF BUTTE, STATE OF CALIFORNIA
RESOLUTION CORRECTING DEED AND AUTHORIZING EXECUTION
THEREOF.
WHEREAS, on Tuesday, the 12th day of March, 1963, pursuant to
Notice duly and properly given, bids were opened for the purchase of
property commonly known as the Montgomery Street Property; and
WHEREAS, the Shell Oil Company was the successful bidder; and
WHEREAS, all of the conditions contained in said Notice of
Intention to Sell have been performed; and
WHEREAS, on the 6th day of August, 1963, a Resolution was
passed, authorizing execution of the Deed; and
WHEREAS, the description has been corrected; and
WHEREAS, the prior Deed has not yet been recorded;
NOW, THEREFORE, BE IT RESOLVED by the BOARD OF SUPERVIS0RS of
the County of Butte, State of California as follows:
1. That the prior Deed of August b, 1963 shall be destroyed
and rescinded.
2. That the Chairman of said Board be, and he is hereby
authorized to execute the Deed from the County of Butte to Shell
Oil Company for the following described property:

A portion of the Northwest quarter of Section 18,
Township 19 North, Range 4 East, M.D.B.&M., described
as follows:
COMMENCING at the intersection of the Northerly line of
Montgomery Street with the Westerly line of Marysville
Road, said point of commencement being North 4° 04' 35"
East 654.6 feet from the Southeast corner of that
certain parcel of land described in deed to the County
of Butte, State of California, recorded December 8, 1920
in Book "187" of Deeds at page 210; thence, Southerly
along said Westerly line of Marysville Road, South
4° 04' 35" West 163,15 feet to the Southeast corner of
that certain parcel of land described in deed to the
State of California, recorded June 12, l9bl, in Book

"1120" at page 504, Official Records of the County of
Butte, State of California, and the true point of
beginning for this description; thence, leaving said
Marysville Road and along the Southerly line of said
State of California parcel, North 78° 00' 27" West
76.04 feet; thence continuing along said Southerly
line of the State of California parcel, South 66° 53' 52"
West, 237.96 feet to a point in the Easterly line of that
certain parcel of land described in deed to Otto A. Peter
recorded February 26, 1929 in Book 24 at page 446,
Official Records, County of Butte, State of California;
thence, southerly along said Peter line, South 8° 41' 52"
East 473.58 feet; thence North 66° 04' 35" East 206.47
feet to a point in the Westerly line of said Marysville
Road, from which point the Southeast corner of said
Peter Parcel bears South 4° 04' 35" West 28.31 feet;
thence, along said Westerly line of Marysville Road,
North 4° 04' 35" East 463.14 feet to the point of
beginning. Containing 2.728 acres more or less.
PARCEL TWO:
The right of access over and across a portion of the
right-of-way line between the land described as Parcel
ONE above and Montgomery Street, a Public Roadway, said
right-of-way is described as follows:
BEGINNING at a point distant N 66°53'52" E. 33.40 feet
from the Southwest corner of that certain parcel of alnd
acquired by the State of California, be Deed dated
April 10, 1961 recorded June 12, 1961 in Book "1120" at
page 504, Official Records of Butte County, said point
also being distant S 80° 58' 25 " E 626.53 feet from the
"B2" line at Engineer's Station "B2" 32+11.96 of the
Department of Public Works' 1956 Survey from Oroville to
Jarbo Gap, road IIT-But-21-Ov1,B; thence from said point
of beginning along the Southerly line of said Parcel,
N 66°53'52" E 204.72 feet; thence S 78°00'27" E 76.04
feet to a point that is 875.33 feet Southeasterly,
measured at right angles from the "B2" line at Engineer's
Station "B2+' 33+15.43 of said survey.
PASSED AND ADOPTED by the Board of Supervisors of the County of
Butte, State of California, this 27th day of August, 1963, by the
following vote:
