RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY
OF BUTTE AUTHORIZING THE FILING OF A DISCLAII~4ER
WHEREAS, the County of Butte has been served as a defendant
in an action to condemn a temporary easement in certain lands in
said County, which action is now pending in the District Court of
the United States in and for the DTorthern District of California,
Northern Division, entitled therein, "United States of America,
Plaintiff v. 1.80 acres of land, more or less, in the County of
Butte, State of California; JOE S. LOCKARD, et al., Defendants",
Civil No. 8397, and
~r1HEREAS, immediate possession of the land subject of this
action vaas granted the United States on the 7th day of November,
1961, and since said day the United States has been in possession
of said lands, and
WHEREAS, it appears that the County of Butte .has no interest
in the lands subject of said action, as described in the Complaint
on file in said action, and the Tax Collector of Butte County
advises that there are no existing liens for taxes against the lands
subject of said action.
NOir7, THEREFORE, BE IT RESOLVED, that said County of Butte
has and makes no claim to any title or interest in or to said lands
subject of this actin, or any compensate wh' h day h r fter be
awarded for the taking thereof, and the is hereby
directed and authorized to file an appropriate Disclaimer in the
above entitled action.
The foregoing Resolution was introduced by Supervisor
Giles who moved its adoption, seconded by Supervisor
McKillap and said Resolution was adapted on roll call
