HomeMy WebLinkAbout63-142RESOLUTION N0. 63-142 BOARD OF SUPERVISORS COUNTY OF BUTTE, STATE OF CALIFORNIA RESOLUTION DECLARING THAT THE PROVISIONS OF THE HEALTH AND SAFETY CODE OF CALIFORNIA, SECTIONS 24391, 24392 AND 24393 ARE UNNECESSARY FOR THE PRESERVATION OF AIR Q'UALI'TY WITHIN THE COUNTY OF BUTTE ~FIHEREAS, the Board of Supervisors of Butte County have reviewed the air quality standards established by the California State Department of Public Health; and 'WHEREAS, pursuant to Section 24394 of the Health and Safety Code of the State of California, this Board has held a public hearing on the air quality of the County of Butte; and TAIHEREAS, no evidence was presented that air quality in Butte County has ever exceeded, or even approached, the limits prescribed in said standards for an "adverse" level.; N03~7, THEREFORE, BE IT RESOLVED by the Board of Supervisors of the County of Butte, State of California, that it hereby finds that the air quality in the County of Butte has not at any time exceeded or even approached, the limits prescribed by the air quality standards of the Department of Public Health as "adverse". BE IT FURTHER RESOLVED that the Board of Supervisors of the County of Butte, State of California, hereby declare that the provisions of Sections 24391, 24392 and 24393 of the Health and Safety Code of California are unnecessary for the preservation of air quality in the County of Butte, and said Sections shall not be operative within the County. BE IT FURTHER RESOLVED that the Clerk of this Board shall file a copy of this Resolution with the Motor Vehicle Pollution -1- Control Board and with the Department of Motor Vehicles. PASSED AND ADOPTED by the Board of Supervisors of the County of Butte, State of California this 26th day of November, 1963, by the following vote: AYES: Supervisors A17d zedge, Giles, McKillop, Pryde and Chaixsnan Steinegger NOES : None ABSENT: None ~j Emil G.
